As of this moment there are no public documents filed in court which verify the allegation. But court house sources claim the allegations have been active round the court house since before Montoya published his claims.

I find the lack of federal filings interesting. But I also find Villalobos failure to issue a denial on his facebook page also interesting. Let's assume what we have here is an out of control rumor which started at the court house and ended up on the internet. What would a competent campaign do? Post a denial on their facebook page. No such denial exists.

If this is an out of control false story, Armando Villalobos is not making things better by failing to issue a denial on his facebook page. Someone needs to tell him to issue a public denial, instead of through sources.

VILLALOBOS AND EDDIE LUCIO (NOT POLITICIANS) REPORTEDLY INDICTED

When I read this on Montoya's page the first thing I did was check the service I use for a copy of the indictment. As of this moment the federal clerk has not yet uploaded it for public viewing.

There appears to be confusion about Eddie Lucio. His office is in Brownsville not Austin, according to the State Bar. Years ago I found out he relocated to Brownsville when I met the realtor who sold him his house. I have no idea where people get the idea he is out of Austin.

BUT I have checked with a source who would know and the story is true. It is my understanding either Villalobos or Lucio or both are negotiating their arrest through counsel.

HERE IS THE KICKER

Several years ago I sued FBI Director Mueller to compel him to indict Villalobos and Limas, along with others. Attorneys for FBI Director Mueller called the allegations against Villalobos and Limas
fanciful." The trial judge found that the claims could not be proven and dismissed the lawsuit. The corrupt trial judge found I failed to produce evidence to support any of the claims. This was an outright lie.

After the Limas indictment, the court of appeals authorized me to pursue a fraud on the court claim against the judge and the US Attorneys office, along with FBI Director Mueller. At that point I had to drop it I was too sick. I am anemic without explanation or treatment, I am fatigued all of the time, and as my friends say always seem to be short of breath. I made a decision to say enough is enough and my health must come first.

The above is why I was shocked the FBI called me in to learn how I knew Villalobos and De La Garza had both been indicted. (CORRECTION: SHOULD NOT READ INDICTED, but served with subpoenas) You have SS Officer Mueller calling me a liar while you have his agents coming to me for information.

I have contacted a law firm who specializes in suing the FBI. There will be no suit. We are going to pursue a full Inspector General investigation against the US Attorneys who lied in court, and FBI Director Mueller.

I tell this story because people need to know just how corrupt the FBI really is. Mueller has no problem lying in federal proceedings. If he feels immune from accountability in federal proceedings when his office authorizes lies, how can we as a nation trust him to enforce the law?

I AM PROUD OF THE MONEY I SPENT

I do not regret one penny of the money it cost me to force the FBI's hand. I am certain it was several thousand dollars between air fare and filings. This same effort is going into insuring indictments at BISD.

We must now demand that whomever Commissioners Court appoints as the interim DA agrees to bring perjury charges against Carlos Quintanilla. We are still within limitations for both misdemeanor and felony perjury charges.

I CAN ASSURE MY READERS

I am working behind the scenes to bring more indictments. Right now I am waiting on a third party to provide me information. Once I have confirmation and the supporting document I will present it to the FBI in Dallas which is part of the Lubbock investigation into Healthsmart.

If one word can ever be used to describe me, it is utility. It is not enough that something has utility if there is an alternative which has even greater utility. I laugh at the politicians who pay the cyber politiqueras because in the larger scheme of things, the blog readership is not high enough to impact an election. I would submit Dominquez, and Begum are going to pay a price for their hiring of Montoya. Benavides has no real opponent, and Villalobos is just plain stupid. Nether of the former will lose enough votes to change the result, but the two latter may have sunk themselves. Now I do not fault Montoya - he figured a way to make a buck on the delusions of morons. Go Montoya - Montoya by no means is the problem. On the JP race just vote for anyone but Begum or Erin Garcia - we can sort it out in the run-offs.

My point being, compared to what I am working on behind the scenes, the utility of running a blog is negligible. But I do need the diversion of politics - in that with my friends I have a no politics discussion policy. I hope I have found a healthy balance in Balancing the Issues. I hope people will read Balancing the Issues - it is really a place for me to exercise my brain.

FINAL THOUGHTS AND NEW BEGINNINGS

I have no interest in blogging on local issues. But tomorrow's final post will be an archive type post wherein all of my research on BISD will be listed for easy access. As I develop new research the page will be updated. But tomorrow's page will be the last page. I do not have much hope for anything to change at BISD come November. I personally believe they will go from a 4 member majority to a 6 member majority. Think about it - who is going to defend "no vale la pena Peña?" They have to win just one of the four seats. I can only hope all of my research will be useful come November.

I will not support anyone who refuses to commit to suing the current majority, Healthsmart, Linebarger, Thompson Horton, and everyone who benefits from the settlements for conspiracy to defraud BISD, and their attorneys. I can assure you the day Thompson Horton is sued they will settle for a number more than enough to fund the litigation, while very publicly firing Arturo Michel. They have way too much to lose to not settle.

A NEW BEGINNING

I have always discussed my interest in critical thinking. While I am doing a lot behind the scenes on BISD which takes my time, I still need the diversion of a blog. Along these lines I have started a new blog which will not, again will not, included local politics. The format will be more discussion oriented to promote discussion on issues of the day which are not local. I will only blog on issues impacting the state as a whole, the nation, or the world. I will not even accept comments which go to local politics.

Until we have an educated populous, local blogging is meaningless. If you want to change things locally - run for office - put your name on the line. From what I have seen this is not an option in Brownsville. Blogging on local issues and expecting change is an exercise in futility.

OBITUARY

Last night a fixture in Brownsville, among those of us who love to fish, passed.

Jackie Williams was well known to all of the customers of Gordon's Bait and Tackle. She always received me with a warm welcome. Her husband Gordon is going through a great loss. I am sure all of Brownsville joins me in sending their prayers to the Williams family. Jackie will truly be missed.

US SUPREME COURT ORDERS SAN ANTONIO FEDERAL JUDICIAL PANEL TO CREATE NEW MAPS

In a nutshell, Texas cannot use the pre-redistricting maps. Texas cannot use the Legislative redistricting maps because they have not been precleared. The only option for Texas is to use maps drawn by the San Antonio federal judges.

The Supreme Court held that the federal courts must incorporate the policies of the state legislature unless they are illegal under the Voting Rights Act. The Supreme Court found that the three judge panel made changes which were not based on Voting Rights Act violations, but agrees that the legislative map cannot be used as a matter of law because it has not been precleared.

This means somehow the federal judges must find a way to draw maps which support the legislative maps, but are sufficiently different to be able to meet preclearance under the Voting Rights Act. Good Luck judges -

It is any one's guess what the final maps will look like or when they will be available for use in a primary.

So we are now in limbo - to be sure any map drawn by the federal judges will be met with an emergency appeal to the Supreme Court. It could take until November to even know the lines of the new districts.

UPDATE ON QUINTANILLA BANKRUPTCY

I simply do not get courts or attorneys - it has all become such a free for all - everything is simply a guessing game.

The Trustee has ordered the dismissal of his bankruptcy Chapter 13. I will upload the order to allow people to see it. But here is my problem with the order of planned dismissal. It clearly ignores he has an attorney and assumes he does not. It also fails to recognize his attorney did file some things last week, albeit incomplete.

For the record, I do not give a crap about his home or the bankruptcy. This entire exercise is about discovery of his finances. It is all being used behind the scenes to build a case. I do not want the bankruptcy dismissed. It will mean cutting off my source of information.

Such as redistricting - it is any one's guess. I cannot believe that the Trustee is unaware of the fact Quintanilla does have an attorney. If I have access to all of the filings, the Trustee certainly also has access to all of the filings.

To be clear on this point, the order seems to ignore the fact Quintanilla does in fact have an attorney and his attorney has in fact made filings.

The bottom line is, the courts, the lawyers, and the bankruptcy trustees cannot be trusted to get the job done right..

The federal court of appeals has ordered Antonio Juarez through his attorneys to respond to the Motion for Rehearing En Banc Filed by BISD and the Trustees being sued. They only do this if there are enough judges who see a possible problem with the opinion of the original panel.

I PRESENT TO YOU THE POLITICAL WHORES OF LINEBARGER

Here is my original post - the BV is in large measure about research. In light of what is happening with Linebarger I feel a need to remind people of my research on the issue. I only caught a small part of the BISD meeting - it was during the discussion on tax collection. It was clear Luci Longoria, Presas-Garcia, Saavedra and Escobedo were advocating for Linebarger.

The real funny part is Linebarger is going after Carlos Quintanilla in his bankruptcy - I am not sure which issue they have but someone has a claim for more than $4,000 in the Dallas County bad check office. Will Linebarger let Quintanilla off the hook if they get the contract? (Joe people - joke)

What I will be doing is, this is being orchestrated out of Linebarger's Austin office. The Travis County DA will receive a full criminal complaint against Linebarger for influence peddling. The DA can look at this meeting and see it is a 100% con job. I will let the Travis county DA work it out.

Item 11 on Wednesdays agenda is putting out bids for tax collection. The item was put on the agenda by Presas-Garcia.

Linebarger owns the corrupt 4. The TEA can do a study of these corrupt 4 and use the results to justify changing the laws to give Region One greater control over BISD. Of course nothing will happen because when it comes to corruption in the LRGV nothing ever happens.

Saavedra accepted $3,000 from Linebarger either directly or through their local advocates. She was not even on the Board at the time. Why would Linebarger be willing to give her $3,000 either directly or indirectly? How could she know in advance before bids and review of the bids that Linebarger would be better than the current company collecting taxes for BISD. Why does Linebarger seem to think Saavedra can be influenced with money? If Saavedra has a problem with Linebarner’s perception of her then she needs to denounce them.

If you remember the BV broke the story a week in advance that Escobedo wanted to give Oliveira the interim contract for legal counsel. Why would Linebarger who wants the tax collection contract donate $2,000 to Saavedra. She is not a board member - she would not have the information to know which company is best for the taxpayers - but Linebarger seems to think she is worth $2,000. Think about it

SOMETHING NICE ABOUT THE CITY COMMISSION

I was listening to the city commission meeting while preparing this. A group of homeowners fought and won on the issue of a recycling center. I am not concerned with the merits of the argument for either side. What I like is - this group of homeowners fought and won - why is this not happening at BISD?

Also I must give a hats off to the mayor - he raised the issue of not sending collections out to a law firm for municipal fees. Longoria fought tooth and nail to send the collections to a law firm which would increase the fines by 30 %. The mayor said no - it is time the city do the job rather than up the fees by 30% at a time the people cannot afford the fees. Nice job Mr. Mayor and city commissioners

I thought about holding this post for Monday because it is Dr. Martin Luther King Jr. Day. But then I thought it would demean the day. What is sad is the level of ignorance and bigotry in Brownsville which is celebrated as the norm in Brownsville. I would submit there is a direct correlation between the racism and bigotry in Brownsville and BISD's refusal to recognize the holiday in the name of Dr. Martin Luther King Jr.

A quick note - Jim Barton cannot engage in a conversation which requires critical thinking - which is why he tries to depict me as someone who sits at my desk and types all day. I am not Jim - I do not promote myself and all my actions. But I will bet everything I own I have donated and spent more money this year and every year for at least 20 years promoting and fighting for justice and education, than you have done your entire life.

Jim would have you believe he as a detective watching my house 24/7 and tapping my phone to know exactly what I do - he does not. I have spent my entire adult life putting myself on the line in the battles for civil rights. Ed Bradly did an entire 20 minute spot on me as the only lawyer in the US at the time willing to represent brown and black gays and lesbians being discharged from the military. My reward from the gay community was to boycott my business because I was representing the wrong people. People who know me know my history - fear has no motivation on me - this drives people nuts.

No Jim I do not sit all day - I advocate all day - use my money to help others- give my money away to others - My last TEA complaint cost me just over $120.00 in copies and postage - I never take money - I am in the trenches not the bars - which is why I am such a hot potato.

I spoke several weeks ago about a meeting at the FBI. An agent by the name of Karen Chastine called me and asked if I would agree to be interviewed by the FBI. They wanted to know how I knew both Villalobos and De La Garza had been served with subpoenas from the grand jury.

When I met this little racist shit Karen Chastine she addressed me as Mr. Cervanteeeeees. You would think before the FBI assigns someone to a community like Brownsville they would receive some race sensitivity training - yea - no this is the FBI. I corrected her and told her that under Spanish grammar you drop the second last name and only refer to the person by the first last name and that by the way it is pronounced "Cervantes" not Cervateeeeeeees. To prove her ignorance and imaginary power she went out of her way to say "I'm from the midwest Mr. Cervanteeeeeeees and will pronounce your last name as Mr. Cervanteeeeeeeeeees.

This is the best the FBI can do for Brownsville - the assignment of a punk ass Midwestern Anglo with no respect for our culture.

After I told the two agents how I knew about the two subpoenas Karen Chastine says to me "now give my your take on Luci Longoria." I told her the evidence we had on Luci including possible illegal donations from Carlos Quintanilla. I gave the agent a copy of the Mary Rey depo. I am to deliver a complete package at a later date. The conversation then turned to Enrique Escobedo. After that I left.

BLOGGERS TURN JP CAMPAIGN INTO "WHO IS THE BIGGEST RACIST CONTEST"

When I saw yesterday that Jim Barton posted a picture of students from Texas Southern University law school I nearly puked. What a racist piece of worthless shit this Barton really is. Then when he is called out on it he tried to shift the blame to me. I never mentioned the law school or the student demographics and I certainly never mentioned the school's history. All I stated was a known fact which has nothing, and I mean nothing to do with race. It is the worse law school in Texas.

A LITTLE HISTORY LESSON

During the days of Separate But Equal the State of Texas created this law school so that blacks and Latinos would have a place to go to learn to be lawyers. In the beginning - including as recent as some 25-30 years ago blacks and browns were given no real choice. If they wanted to graduate lawsuit they had to go to Texas Southern. They were not welcome at UT or University of Houston for example. During these days many very bright - top of their class blacks and browns attended Texas Southern. This is why today you find many judges who attended Texas Southern. Unlike when Erin Garcia went to Texas Southern, these judges attended when the brightest of the bright among blacks and browns had no choice - or very few choices. It is pathetic that Erin compares herself to these bright minds who faced head on the racial discrimination of days gone by. These lawyers and judges worked their asses off to only be told they were not welcome at the best law schools. This is not the case of Erin Garcia - shame on you Erin.

Affirmative action changed things. The brightest of the bright were now getting into UT, Yale, Harvard etc. This changed the academics of Texas Southern. What has happened now is the Anglos go to law school in Oklahoma once every other Texas law school has rejected them, and the blacks and browns tend to go to Texas Southern. The low pass rate on the bar at these schools has nothing to do with race, but a reality that for all races and genders they have become the law schools of last resort.

But when Barton posted a picture of nearly all black students he knew what he was doing - "look Erin Garcia went to law school with blacks" - in terms of qualification the student body is meaningless - which is why I only referenced the worst law school, because nothing else mattered. It is not the worse law school because of the student demographics, it is the worst law school because it is the school of last resort. It is mostly brown and black students because the worst of the worst among Anglos tend to be racists who prefer the bottom law schools in Oklahoma than attend a law school which was once exclusively for minorities. If the bottom of the barrel Anglos were not racists Texas Southern would have a more racially balanced student body.

It is sad Begum who is not qualified at any level to be a JP, and Erin Garcia who has shown nothing but contempt for voters rights and the First Amendment choose to use their supporters to divide Brownsville by making an issue of Begum's accent and pushing on people Erin went to a nearly all black law school

VILLALOBOS AND LONGORIA -

A PAIR BROWNSVILLE SHOULD FEAR

Below is a great article on Everardo Longoria's history of domestic abuse. As we must, we must assume the jury got the verdict of not guilty correct on the one case of domestic abuse which was tried. But what the facts do show at trial which are not disputed is, Longoria went to the home of his ex wife and in front of his children created a domestic abuse situation. As a police officer he knew or should have known removing a piece of disputed property from his ex wife's home is not how you solve these things. This tells us a lot about his personality.

There is a clear pattern here concerning Villalobos and domestic abuse - Jessica Tetreau called the BPD repeatedly with claims of domestic abuse. Although the law mandates that Villalobos investigate all claims of domestic abuse whether the spouse files charges or not, he does not. Villalobos ran cover for "police officer" Longoria over and over and over again. Only when it became impossible for Villalobos to avoid prosecuting Longoria was there a trial.

We see the same pattern with Jessica Tetreau - Villalobos repeatedly refused to take action against her husband after endless calls. Villalobos has no use for the law on domestic abuse and sees the abuse of woman as something society should tolerate - it is not. As part of his contempt for this issue what did he do?

On the day he announced for Congress he also announced his decision to prosecute Jessica Tetreau for domestic abuse. "Hey look at me as DA I am not afraid to prosecute woman who are domestically abused by their husbands." In the case of Jessica Tetreau the 911 call and police report vary enough that no competent DA would even consider the police report. But Villalobos sees it as an opportunity to be hard on public officials. Villalobos was not born a man - he was born a weasel.

I can only hope the family is looking to hire a top notch lawyer. It does not matter the jury found Longoria not guilty. A good lawyer will get the testimony of her ex wife and use it as evidence the BPD runs cover for its officers. A good lawyer will show how Presas-Garcia illegally forced Treviño out as Cummings principal and possibly creating the environment which lead to the death of Jaime Gonzalez.

As to the BPD I will bet the farm Brownsville's liability carrier will pay policy limits rather than chance a trial. I will also bet that if the family secures a lawyer who knows how to file a complaint with the Office of Civil Rights Enforcement federal criminal charges will be brought against both the BPD and BISD.

CUMMINGS OFFICIAL READY TO SPEAK, AND ED STAPLETON ARGUES VIEWING PICTURES OF SEXUALLY ABUSED CHILDREN IS PART OF OUR CONTEMPORARY COMMUNITY STANDARD

A Cummings administrator wants to speak. Apparently Jaime Gonzalez went into the main office very distraught over the fact he did not know where his girl friend was. The witness claims he was clearly emotionally distraught and needed someone to calm him down. Rather than calm him down another administrator decided to enrage him with dismissal of his anger and discipline by ordering him out of the office.

Had this administrator used minimum competence in dealing with Jaime, Jaime never would have returned with the pellet gun pulled. The administrator showed no interest in the fact that Jaime was extremely distraught. Jaime left the office and apparently bopped a kid on the head - like this never happens in school (but clearly wrong). Rather than try and calm Jaime down the administrator continued with a hostile approach. Apparently this is when Jaime pulled out the pellet gun.

Had the administrator been qualified in dealing with distraught children Jaime would be alive today. Sources inside Cummings are anxious to talk with the Civil Rights Enforcement Section. My source told me to have the family attorney seek the personnel files of all the Cummings administrators. Apparently one of the administrators may have something in their record which does not bode well for BISD. The source is not giving up the name of the administrator who inflamed the situation, but it is my understanding the source will give up everything to a federal investigator, including what is known about the administrator who inflamed the situation.

ED STAPLETON BRINGS SHAME TO BROWNSVILLE AND THE LEGAL PROFESSION

I was curious to find out what the status is with the trial of former Pan Am president Robert Hedrick. I found a motion to dismiss indictment number 5. I have read a lot of vile things in my life - but nothing so vile as this. Stapleton is asking that our courts declare that based on contemporary community standards it is okay to privately possess child pornography.

Jim in his little tirade against Cheezhem this morning fails to tell people he is a liar and remind people how he tried to shake down Carlos Masso for advertising dollars.

Jim in his attack on Cheezmeh claims clean hands on the issue of Melissa Zamora - a few too many beers has caused Jim to forget his own actions. Jim repeatedly printed the lies against Melissa Zamora until I called him out on it on facts. Jim in this morning post simply lies - he cannot run from reality - he is simply upset that Cheezmeh is making money as a cyber-politiquera group and his attempt to get money from Carlos Masso failed.

It was not Cheezmeh who took the lead against Fly Frontera - if anything Cheezmeh nearly got Fly Frontera approved through its support for Camarillo and his a Ménage à trois with Rodrigo Moreno and Erasmos Castro. The fact of the matter is, when Quintanilla and company started criminal background checks on Cheezmeh operatives it was the BV who called on the candidates to denounce the tactic, while it was Earsmos Castro and Rodrigo Moreno (working for Camarillo) who banned the BV from their facebook page for asking Camarillo tor denounce the criminal background checks.

It has been well established that Rodrigo Moreno openly worked with Carlos Quintanilla and Enrique Escobedo to bring about the mess we have at BISD. Erasmos Castro does not wipe his own ass without first consulting with Rodrigo Moreno. The decision to absolve BISD of any missteps in the death of Jaime Gonzalez is again another directive from Rodrigo Moreno. The majority of 4 must be protected at all costs, even it it means vilifying a dead emotionally disturbed 15 year boy. This is Brownsville Cheezmeh. With the exception of the homophobic attack on Sylvia Atkinson Cheezmeh has chosen to look the other way in terms of the BISD mess - again another directive from Rodrigo Moreno.

Something which never came out in the Mary Rey deposition was the game plan for power. Mary Rey told me that when dealing with her son Quintanilla told her - "wait until the next election when we control the sheriff." This is why Pat Lehmann created the false story about the jail commissary contract - it was all false - when the truth came out the jail ended up owing the vendor $7,000 - all because an audit was done. The truth showed that the vendor had no control over the money or the markup by the jail. The truth showed that the sheriff has the high mark up as a way to raise money for prisoner services. You either charge the prisoners for prisoner services or the taxpayer - the entire story was bogus for no other reason than to hurt Lucio's reelection and get elected someone who will give the contract to Pat Lehmann or someone tied to Pat Lehmann. In the end the prisoners would be paying the same.

You see cheezmeh is now part of that group with Rodrigo Moreno, Carlos Quintanilla, and Pat Lehmann to take control of Brownsville and Cameron county politics for their own financial end.

JIM ALSO LIES ABOUT FLY FRONTERA - A LIE IS ALWAYS BETTER THAN THE TRUTH

Jim tells you Craig Grove brought the issue up - true and false,. Craig has always been good with me - I must give that bias up front. He did help me look for a home at one point. Unlike so many other realtors he did not try and push me into a disaster of a home because the price was right. The first home we looked out I should have bought - It was a deal. I would highly recommend Craig as an agent who will look out for his clients.

Craig has always told the truth about Fly Frontera (try it Jim you may find it liberating). Craig posted on Cheezmeh's facebook page all of the coverage from the Brownsville Voice. Until then Cheezmeh did not have a word on the issue. All of Cheezmeh's research came from the Brownsville Voice. Craig found himself persona non grata when he would point out this truth, among other reasons.

But it was not the BV who started this - it was Melissa Zamora who started the outcry against Fly Frontera. This is a fact Cheezmeh and Jim Barton seem to never want to push as a reality.

By the time Rodrigo Moreno realized what was happening on Cheezmeh's page it was too late to stop it. He went to Erasmos Castro and told him to protect Camarillo at all costs. Camarillo and Rodrigo Moreno were big supporters of Fly Frontera. The cat was out of the bag so now they needed damage control. This is when I was banned from Cheezmeh's facebook. Craig Grove was banned next. We were speaking the truth and Rodrigo Moreno and Erasmos Castro did not like it.

Brownsville Cheezmeh did nothing to stop Fly Frontera - in fact on the night they appeared at the city commission they walked out before Quintanilla spoke. Quintanilla was given a full 30 minutes to speak unabated because Cheezmeh left him there to say what ever he wanted. The only reason Quintanilla lost that night was because the City of Brownsville was looking down the barrel of litigation with Pan Am over the fact Pan Am was told there was no incentive money at the same time Fly Frontera was being told there was. It had nothing to do with Cheezmeh.

Two people (entities) stopped Fly Frontera - Melissa Zamora and Pan Am - all the BV did was provide the research - but it did not stop it - Pan Am's threat of litigation is what brought it to an end. Had Camarillo won the election as mayor with the help of Erasmos Castro and Rodrigo Moreno - Fly Frontera would have gotten the money. Erasmos Castro was an accidental opponent of Fly Frontera.

These are facts people - facts you will never find coming from Jim Barton or Erasmos Castro.

His next post was from an "anonymous insider" at Veteran's memorial who was going to tell the truth about what is really happening at Veterans Memorial. Jim then took down the post. Any idiot could see the anonymous source was the kid. Honorable people do not use children as pawns in the game of politics. I cannot imagine what the BISD majority is now doing to this kid.

A CITY AND SCHOOL DISTRICT AT ODDS WITH OUR SPECIAL NEEDS CHILDREN AND ADULTS -

I know I can be as clear as humanly possible on the issue of the police officers who did the shooting, and people will not understand what I am saying. I cannot help people who decide upfront what reality is and then cannot be reasoned with.

My goal is to draw a link between the BISD and the COB on the issue of special needs children and in fact even adults. What is seen is a clear pattern of contempt for these children. This is a consequence of extreme incompetence at the level of the BISD and the COB. This is what happens when all hiring is done locally as part of a compadre system and not on merit. This is what happens when the BISD insists that competency is not to be considered when hiring the administrator over special services. This is what happens when you have a city commission always turning a blind eye to mismanagement and incompetence. I personally hope this family sues both the city and BISD and win millions. Will it change anything? - no - the liable parties will probably be promoted and made employees of the year.

Our police department has a major problem (note I said department - not officer) with a lack of proper training. Proper training keeps the police and citizens alike safer. Proper training is in the best interests of all concerned.

"A state grand jury has issued a scathing report against the Brownsville Police Department, despite no-billing several Brownsville police officers involved in a November 2008 armed standoff that left a mentally unstable man dead."

Two years later we now have a 15 year old boy dead because a poorly trained police officer (again, note I am putting the blame on the training and not the officer) could not discern the difference between a pellet gun and a real gun. (I've seen the picture and not buying it - proper training would have prevented this) The lack of training provided to our police officers resulted in this officer not knowing how to disarm this child. A child has a pellet gun and the officer cannot disarm him with a stun gun or by shooting it out of his hand? This is not Monday morning quarterbacking - this is using commonsense. We now know there was not engagement of the officers as originally alleged by the police. (The Herald has the statement - sorry I cannot upload it - docstoc appears to not be working)

Social networking is important in this story - people reporting to Cheezmeh through third parties who were inside the school reported three shots. The officers shot the victim twice. The AP is also reporting three shots by the police. This means in a school filled with children one bullet went stray - this is not evidence of a calm and professional response to the situation. The step-mother is claiming she saw three bullets wounds, not two as alleged by the BPD.

The police are playing games - the use of the word "engaged" is meant to mislead the public. Like I said we now know the original story was a lie. The interim police chief should be suspended immediately along with Charlie Cabler. Cabler as the city manager has had two years to address the issue of a lack of proper police training and has done nothing. We now have a dead child, a devastated family, and a two police officers who will suffer the emotional consequences of their actions for the remainder of their lives. The incompetence coming from our police department is shocking.

Look, I have nothing personal against this officers. I am assuming they acted according to their lack of training. It is the city of Brownsville to blame - this city demands incompetence at every level. This city commission has known for years about Cabler's mismanagement of the city and has chosen to take no action. The new members of the city commission need to take the lead and demand Cabler's immediate suspension.

The family needs to immediately contact the Office of Civil Rights Enforcement in Dallas. Dallas is where the Regional office is located.

In the 2009 case, the police officers would have been indicted but for a DA driven to obstruct justice. The grand jury is only as good as the DA. Years ago I did a grand jury referral for a family in a case wherein their daughter was murdered. The DA had the grand jury no bill the accused not withstanding he confessed to the neighbor and the police. Why? the DA was over several small west Texas counties. He decided no one would notice the death of a mentally ill woman living in a small run down trailer. Wrong - her family had a ton of money. It blew my mind while arguing the case before the grand jury to hear the DA tell them they were free to ignore the confession because the man was mentally ill. He was again no billed. My point - bad DA's can indict a ham sandwich while getting a confessed murderer no billed. This investigation must go outside Brownsville. If anyone knows this family have them contact me and I will prepare the complaint for them. Of course - I do this as a community activist and charge no fees and expect no fees.

BISD FAILS THE CHILDREN AGAIN- THE CUMMINGS CONNECTION

I recently did an ARD for a mentally ill child. BISD agreed to the ARD after the TEA opened the investigation. The ARD was in early December. BISD was informed of the child's mental health problems back in late August and did nothing. BISD considers mentally ill children to be problem children to be disciplined. I have several national organizations looking at a lawsuit against BISD over this abuse of this child by BISD and the principal at Stell. In fact when the truth came out Minny Zamora tried to get the child returned to Stell, but BISD's counsel ordered that the child remain at BAC unless the father dropped the TEA complaint. The matter is being reviewed for civil rights violations to include suit against BISD and the involved administrators. In this case it was the TEA that requested that the father file an additional complaint with the Office of Civil Rights in Dallas. It is being prepared.

To understand how incompetent BISD really is when dealing with mentally ill children just consider the ARD for this child which occurred after the TEA opened the investigation. At the meeting was the special needs administrator over the Pace cluster. I would insult incompetent people by calling him incompetent. The person leading the ARD says "anything else" after they finished and I said "what about the mental health accommodations?" This was the entire point of the ARD and it was not even addressed. We addressed it at that point. Some mental health children require constant observation. For example this child will not be allowed to congregate around other children without supervision. This is how you protect the disabled child and the other children. BISD proposed no accommodations for the child.

I then asked about the child being provided in school counselling to learn how to cope with the stress issues of being in school. I was blown away to learn she would not be provided the counseling because although it was December and BISD learned of the mental health disorders in August BISD saw no reason to send the child for an in house evaluation. Without the in house evaluation the child was not entitled to services. Never no mind a therapist and pediatric psychiatrist had already diagnosed the child and put the child on some very toxic medicine - toxic enough to require an entire cardiac work-up.

THINK ABOUT THIS

Here is a parent forcing BISD to attend to his child's mental health problems by filling a TEA complaint and even with that all in place BISD conducts an ARD and offers nothing to address the mental health issues of his child - nothing.

What chance does the average parent have with BISD when they do not have the pressure of the TEA or a family advocate helping them? The parent and child are screwed from day one.

A 15 YEAR OLD IN 8TH GRADE

Any 15 year old in 8th grade raises a question of possible previous or current learning disabilities. But then it is possible his parents enrolled him one year late. The family is reporting that in fact the child was very smart and doing well in school. I am 100% certain BISD failed this child. It is true the parent should have noticed the level of emotional disturbance in the child - but so to BISD. The problem is BISD just disciplines the mentally ill children instead of getting them help. This is exactly what they did with the Stell student and then sought to cover up their actions by lying about a non-existent protective order against the father as the reason they refused to work with the father. (You heard that right - the punk principal waived a bogus protective order at the father claiming it was why BISD was ignoring the demands of the father - the protective order was against some kid who use to attend Hanna and not the father.)

The ACLU filed a class action against Rhode Island over it use of truancy courts to manage mentally ill children. I am putting a package together for presentation to the ACLU to consider a similar lawsuit against BISD.

In the Pace case wherein the father dropped the TEA complaint because of the professional manner in which the principal handled the problem, this was the issue. The folder teachers told the principal in my presence that there was nothing in the child's file to indicate mental health problems. The TEA had already made findings against BISD for failing this child on the issue of mental health. I demanded to see the child's file (father gave permission) and low and behold all of the child's mental health records were right there in the file. Either the folder teachers lied at the meeting or never in fact even checked the child's folder - even after the TEA opened the investigation.

Again with this much advocacy from me and pressure from the TEA BISD was still blowing it.

THERE IS NO DOUBT IN MY MIND BISD FAILED

Jaime Gonzalez Jr., obviously was emotionally unstable at the time of the incident. All known evidence points to this incident being out of character for the child. This child has a folder at BISD. If anyone knows the parents or any family member please have them contact me. With their permission I will prepared the necessary complaints needed for a full investigation. BISD clearly failed this child. They either failed to insure the child got the care he needed, or assumed he was just bad and never bothered to use BISD resources to insure he got the help he needed. There is a story which needs to be told - but more importantly complaints need to be filed and a possible lawsuit needs to be filed. I am not interested in referring the family for a lawsuit. I only want to make sure they know how to file the proper complaints with both federal and state agencies. On these issues money is not an issue. As to state and federal complaints there is no money to be made by anyone. I only say this because I can just imagine the posts - this is about justice.

Again if someone knows the family I will help them through the process. This is purely voluntary on my part. Any complaints must be signed by the parents of Jaime and filed by them. My job is to simply help them through the process.

CITY OF BROWNSVILLE

In the case of the Stell child, there appears to have been a pile up of girls at the school. The principal's report may be in conflict with the original incident report. The parents are demanding a trial for their child. They are poor. The city of Brownsville has informed the father he has no right to the incident report. This is a basic violation of the child's civil rights. BISD police have also made it known they will never release the incident report. Without the incident report how does the father help his child with the defense? Based on what was read in open court it appears the child is telling the truth about coming to the aid of a friend who was on the bottom of some pile up.

The family is indigent. In municipal court you do not have the right to counsel unless it is in the interest of justice. The child cannot legally ask for counsel. The father cannot legally make a written request for a jury trial and counsel. This is a quirk in the law which leaves children without a defense or the right to a defense. A volunteer attorney would be nice. I will say we are waiting on two national organizations to decide if they will help.

What kind of city finds this type conduct towards children to be acceptable? Brownsville

Even after the father made it clear to the judge and to the city attorney there would be a trial the city attorney bullied the child into admitting to the crime. This child is mentally ill. The child has no knowledge of her rights or her defense. No one read her her Miranda rights. Her confession goes no where, it cannot be used. Of course because the State Bar of Texas is a criminal enterprise determined to keep unethical conduct by public attorneys covered up found that a city attorney soliciting a confession from a mentally ill child over the wishes of the parent is ethical conduct.

In any normal city the city attorney would have been fired. Charlie Cabler and Marc Sossi are running cover for this attorney.

THE BROWNSVILLE POLICE ALSO FAILED THE STELL CHILD

Several months ago two Pace students were arrested for the alleged murder of another Pace student over a cell phone. The police initially claimed a cartel connection and then retracted their claims. The family was in fear of the cartel coming at them because one of the accused was arrested in their apartment. This Stell child was traumatized by all of this.

Where the police messed up was in the arrest of the suspect. Again this goes to a complete and total lack of training by our police. The blame for this falls on the police chief and Charlie Cabler as the city manager. The police were searching for the accused when they were told the accused was in the apartment of this child. No one at this time knew anything about the accused's alleged connection to the murder of the other child. In the apartment were the children and 2 year old grand daughter of the woman who rents the apartment. The mother was not there. The police knew who was in the apartment - rather than try and trick the person they were trying to arrest to leave the apartment they pulled their guns and rang the door bell. The oldest child looked out the door hole and panicked. All she knows is there are police officers out her door with guns pulled.

I get it - the police believe this young man was a danger and possibly armed. They pulled their guns - but if they believed this then they also had to have known by pulling their guns and not first trying to trick the kid out of the apartment they were potentially creating a hostage situation which would have involved a 2 year old child and other children. The police simply did not care. In any other city with a newspaper this would have been a front page story. Not in Brownsville - not newsworthy.

This girl who goes to Stell is so traumatized. BISD knew what happened with this family and offered no help. The teachers and principal at Stell with full knowledge of what happened to this child with this possible hostage situation and her mental health problems instead chose to treat her like she was just a bad kid who needed to be punished. It is now sad the City of Brownsville has now chosen to pile on and make things worse. I can only hope one of these many organizations I have contacted to help this family will help. I have no hope of any attorney in Brownsville donating a nickel of their time to help this child.

BROWNSVILLE IS A CITY WHERE CHILDREN ARE SHOT TO DEATH BECAUSE OF A LACK OF PROPER TRAINING BY ITS POLICE OFFICERS, AND WHERE CITY ATTORNEYS ARE ALLOWED TO BULLY MENTALLY ILL CHILDREN INTO CONFESSING OVER THE PROTESTATION OF THE PARENT

My advice to any business looking at relocating to Brownsville is, you better check out Brownsville first because no right minded person would move their children to Brownsville where children are of so little value.

BROWNSVILLE'S RUNWAY REMAINS AN ISSUE OUR POLITICOS PREFER TO IGNORE

I decided to do this special post (no regular posts) on the airport because of an article in the Herald which gets an "F" for detail and reality. I wrote on this issue exactly one year ago today. I have been writing on this issue since before I moved to Brownsville, 7 years ago.

Brownsville's airport has the potential of being a major employer, along with being a major money maker in terms of profits and taxes generated. Unfortunately our leaders fail to see the potential.

NOTHING CAN BE DONE WITH THE AIRPORT UNTIL WE EXPAND THE RUNWAY

I detailed the issue about the runway limitations one year ago. I said it should be an issue in the mayor's race. It was not an issue and remains a non-issue.

"According to the City of Brownsville its longest runway, runway 2, is 7399 feet long. What this story documents is, is that at least as far back as 2003 there has been a promise to expand the runway to 10,000 feet, so as to expand commercial and cargo service. I have not been able to learn why there is such a delay or what exactly is the status of the runway expansion."

Larry Brown has refused my emails on the issue.

For at least 9 years Brownsville has debated this issue and nothing has been done. ( years ago a 10,000 foot runway would have been acceptable - but in today's world of modern cargo you need a 12,000 runway.)

I know for a fact my biggest readers are the business community. I spent years developing this part of my readership because I knew the business community has the most influence with our elected officials.

The city commission needs to have a workshop on what it is going to take to build a 12,000 runway and a full service international cargo facility. They then need to take the action to fund the development though airport fees and bonds. Brownsville cannot move forward without strong leadership on the runway and airport issue.

The development of the airport will also bring railway jobs, port jobs, and trucking jobs. It may take creating a combined Port, Airport and County Port Authority such as you see in the NY, NJ combined Port Authority.

IGNORE THE IDIOTS WHO COMPLAIN ABOUT TAXES

There is this woman who loves to speak at the city commission meetings and complain ad nausea about taxes. She is the problem with Brownsville and why it cannot move forward. She has no understanding of business or how to grow it. She is so poorly educated that while complaining to the city and county to not raise taxes she openly supported the union for the sheriffs' deputies. Someone forgot to tell her that a union for sheriff's deputies would mean raising taxes to support their hirer salaries.

In my home there are a lot of things I want - but everything is budgeted based on necessity and utility. Some things cannot wait because it will cost a lot more later - such as a repair. Somethings will bring me greater comfort while increasing the value in the home. On these issues I spend - on everything else I save a penny at a time until I have cash to pay for what I want. Brownsville's priority should be the airport and everything else should wait until the economy recovers. (Side note - more and more airlines are dumping these commuter planes - is Brownsville ready for the larger planes which may replace them?)

There are two ways for government to raise revenues - taxes and profits. No one likes taxes - but you cannot raise money through profits unless you invest money in an enterprise. This may mean raising taxes on a short term so that through investment later on you will not have to raise taxes because revenues from profits are now funding the city instead of taxes. The faux conservatives in the Republican Party fail to understand this simple aspect of capitalism. People like this woman and everyone else who say no, no, no to taxes cannot even begin to understand what I just wrote.

COB MUST SELL BONDS TO DEVELOP THE AIRPORT

Once we have a commitment on the runaway - to be built asap, then Brownsville needs to incorporate an international trade business to run the cargo business at the airport for profit. This will generate profits for the airport and for the city through its international trade business corporation.

PAN AM NEVER HAD A FIGHTING CHANCE

As the Herald, the governor, and every other rational person pointed out, the business model Hedrick brought to Brownsville is viable - it makes sense. It was unfortunately in the hands of the wrong person.

The thing that made Pan Am exciting was the prospect of bringing South American agricultural cargo through Brownsville. The documentation related to the delays in Miami and Los Angeles was real. Our South American trading partners are not happy with how long it takes to clear customs. Agricultural products such as flowers and asparagus cannot sit forever waiting to be cleared. It was proven Brownsville can clear the products faster and cheaper. This is what made Pan Am exciting.

Months ago I called on the COB to abandon Pan Am and go it alone. Nothing can happen in terms of the South American trade until we have a larger runway. 10,000 feet are not going to cut it - it may bring business for a few years - but the major cargo companies are going to want to see a plan on paper to expand to 12,000 feet within a few years after completion of the 10,000 foot runway.

The moment bonds are sold for a new runway the city must have in place a corporation for profit which seeks out South American cargo such as flowers and asparagus. We do not need one airline running this business. What we need is to convince Peru, Ecuador, Chile, Columbia, Argentina and Brazil - the major exporters - to put pressure on the existing cargo companies to bring their product through Brownsville. The corporation owned by the COB then manages the business of receiving and making sure the cargo is cleared, while also insuring shipping out of Brownsville on rail, barge and truck is timely.

This is very doable so long as we have leaders who do not run and hide every time some idiot says no new taxes. We need leaders who understand that by investing now and raising taxes to cover the bonds to develop the airport, we are in fact insuring lower taxes in the long run as the city benefits from the profits generated by its international trade corporation and from the airport. The time to borrow is now, while the money is cheap.

TONY GARZA

I do not know if Tony Garza will help - but he is now recognized as a leader in this field. I would hope that at a minimum he would be willing to help Tony Martinez make connections with the people in our State Department who can introduce a Brownsville delegation to the right people in Peru, Ecuador, Chile, Columbia, Argentina and Brazil - the major exporters - so that we can lobby them to promote Brownsville as a major cargo hub for South American cargo. Once these governments and the major exporters realize Brownsville makes good business sense the governments will be the ones pressuring the cargo companies to use Brownsville as one of the ports of entry.

FEDERAL AND STATE FUNDING

This also is not complex. We need a delegation of no more than two who can lobby the right people in Washington to explain why Brownsville is good for Brownsville and the federal government. Expanded trade with South America is a win for the federal government. It is also a win for Texas. Governor Perry has already recognized this potential for Texas - Brownsville is where it needs to happen. Even in these difficult financial times there are federal and state dollars for projects which promote the US and Texas. We must market this plan as something a lot larger than Brownsville - if we do outsiders will see the value in the investment.

DOWNTOWN

Stop the madness - this nonsense that our limited dollars should be used to promote downtown is just plain and simple stupidity. The other day based on a story in the Herald I went downtown about 3:30 t try a new pizza place. Look the pizza was not bad and I am sure it serves the community, but it is not NY pizza - not even close. I hate people who try and sell pizza by calling it NY pizza when it is not. For the record not everyone likes NY pizza - if the people who buy it like it then it is the right pizza for them. BUT - I spent 45 minutes in traffic and trying to park. Until there is a parking garage downtown I will never go downtown again.

The only interest the city should have in downtown is the building of a parking garage for profit. Again I would support the selling of bonds for such a project. The profits should be enough to pay down the bonds. Private business should then be responsible for downtown. Beyond a parking garage taxpayer money should not be involved in downtown.

Any politician who thinks develop of downtown is Brownsville's salvation should be not an elected official. The development of downtown will not move Brownsville forward and will not bring about real jobs beyond minimum wage jobs.

Airport jobs will be real jobs with real wages and benefits. 90% of the city's attention should be on the airport. Unfortunately I think our simple minded elected officials will continue to think small and hope for the best with more bars downtown - a place you will never find me.

CARLITO QUINTANILLA FILES FOR BANKRUPTCY TO STOP FORECLOSURE

ANOTHER UPDATE: BK COURT ORDERS DISMISSAL ON JANUARY 13, 2012 FOR NON-COMPLIANCE WITH INCOME DATA

Yesterday I only looked at his actual filing and nothing else. This morning I looked at all of the documents and realized that the court ordered an automatic dismissal of the case because Carlito failed to provide to the court his income information.

There is nothing wrong with a reorganization - the problem is the petition. He will fail on the income issue. He does not just get to tell the court what his income is, he has to produce bank account and bookkeeping information. In the Zayas case he played games on this because he does not want to disclose the information. If he fails to disclose the information by the 13th the court will automatically dismiss the bankruptcy.

He has to prove that based on his income he can make the proposed payments. The creditors are allowed to object. In his petition he fails to include the child support he pays to Margarita Lara Santana. His total child support is $480.00. On Page 41 of his petition item 33 he says it is only $240,00. The last contempt order in the Mireya case shows the support at $280.00. He is also under a court order to pay Margarita Lara Santana $200.00. He failed to disclose the lawsuit with Margarita and the child support.

In the Margarita Lara case he swore under oath he travels to Brownsville on business and rents a condo on SPI (kinda of like I guess Mama Perez's mythical home in Mary Rey's home.)   He did not disclose the income from his Brownsville business.

Too much debt versus income means you do not qualify for a Chapter 13. His current payments do not include payments to the IRS, along with other creditors. Carlito wants you to know he will win his battle with the IRS and the lien will be removed within 3 months.   The BK court automatically sends his bankruptcy to the IRS agent in charge of his case. If the claims he made to them are not the same he made to the court he will be up a creek - big time. The IRS or any other creditor could force it be converted into a Chapter 7.

AN UPDATE WITH MORE INFORMATION

On page 22 found in the second link Carlos Quintanilla claims his house payment is $2,506, including taxes and insurance. This guy is so stupid he cannot even see an idiot can do the math and see he is not being honest. $5,733.00 is what is paid in property taxes annually. He then pays $245 per month in homeowners insurance. This comes out to $722,75.   Principle and interest (6%) on $398,000 (value he claims) is $2,800.00 a month. If you add in taxes and insurance you are at somewhere around $3,573.00 a month - not $2,506.00. Before the modified loan agreement he signed in April his payments were according to court filings somewhere between $3,600 and $3,710 (the numbers are confusing because they change back and forth. After the loan modification when the interest was changed to 6% the payment would be $3,302.06. Either way it is not $2,506.00

THE KICKER I LOVE

NTex now gets to drill Quintanilla under oath in federal court where perjury matters about Ted Parker and Fly Frontera. This bankruptcy could just be what it takes to take down both Ted Parker and Jim Gallagher of Public Charters. Who paid for all of those trips to Brownsville if not Jim Gallagher. Now of course the IRS agent in charge of Quintanilla's case will be reviewing the bankruptcy to compare the financial information he provided the IRS and the financial information he provided the bankruptcy court. They better be 100% the same.

Quintanilla does not disclose any monthly payment to the IRS. When you have an IRS lien you are given three choices. Based on your income you make payments or face garnishment. (Choice 1 or 2) No one believes that with Quintanilla earning over $200,000 a year the IRS would allow him to go without making payments based on a hardship. This is the third. The IRS can grant a hardship uncollectable wherein they suspend collection efforts but continue to add in interest and penalties.

If Quintanilla fails to explain these discrepancies and the judge believes they were intentional, Quintanilla can be charged with criminal bankruptcy fraud.

ORIGINAL POST

This is not what a competent attorney would have done. The last time he tried to put a business into bankruptcy the court dismissed it after he refused to comply with the order of the court.

He may have hung himself. If NTex hires a competent bankruptcy attorney they will have permission within the week to proceed with foreclosure in February. But this is the least of his problems. If his claims in his bankruptcy petition vary significantly with those he gave the IRS he is royally screwed by both the IRS and bankruptcy court.

In the first link if you look at page 9 he claims his house is worth $549,000.00. Zillow values it at about $301,000 , Dallas county has it at about $257,000 - where does he get $549,000? The court will consider this to be a material misrepresentation if he cannot produce a valid appraisal to support his claims.

In the limited documents you can see he verifies he in fact does owe child support on the children he left behind in Illinois. (Page 14)  he says the amount owed is $77,000.00. The lien on file with the county has it closer to $87,000.00. Now it is possible he has paid it down over the last two years. The trustee will ask for proof of the payments.

In terms of income he makes no reference to Fly Frontera. How is this possible? The administrative offices are out of his home?

In other income he claims $10,000.00 a month and then a separate $258,563.00 over two years from Azteca Business Development Group/Accion America. Remember in family law court he and the mother of his children are claiming he does not earn enough to provide his children with insurance. With an average income of over $200,000 a year over the last two years his children do not qualify for medicaid.

If the IRS finds he lied to them or the bankruptcy court finds he lied to them either of them can put him in jail. If he had a half a brain, on Tuesday morning he would file a voluntary dismissal of his bankruptcy. He he forces a hearing on a fraud claim by NTex, he could find himself being hauled off to jail by a federal marshal. Federal bankruptcy judges take making false statements very seriously.

UPDATE ON WHAT TO EXPECT:

I have no way of knowing if his house will really be foreclosed on on Tuesday. A competent attorney would know how to stop it. Further it is possible that someone will give him the money he needs before Tuesday to stop the foreclosure. NTEX has used this technique before. They get Quintanilla to give them what he can and stop the foreclosure for a few months. The house appears to be worth less than the pay off. If Quintanilla can give NTex $30,000.00 I think they will take it. It is $30,000.00 more than they have now. In a few months when he cannot still afford the payments they can foreclose again, but with $30,000.00 already collected.

It is anyone's quess what will happen. Based on court documents it will be sold on Tuesday. Quintanilla has settled twice before to avoid foreclosure - what is to say NTex does not try and accept a third deal which is sure to fail - but in the mean time get a big chunk of change..

Today the Dallas court denied Quintanilla's final plea to stop the foreclosure on his home. The following was provided to me from the docket sheet. I am waiting on the actual order.

If we remember Carlito sued me and Rick Zayas in Dallas accusing us of a host of things including that I accused Luci Goosey Longoria of having an affair with Carlito. The court in Dallas dismissed the lawsuit against me even before I had to file an answer or was served.

I made it known at the time that the second I was served I would notice up Luci Longoria's husband for deposition on the issue of adultery. Of course I never made the accusation. I said they were in bed together politically.

I believe but cannot prove Luci's husband made in known to Carlito that if he got brought into his bogus lawsuit there would be consequences. I believe this is why I was never served with the lawsuit.

LUCI GOOSEY LONGORIA'S EX HUSBAND ACCUSED HER OF ADULTERY

Is this why Luci Goosey is so sensitive to the issue? In the divorce petition her then husband accused her of adultery. Only Luci knows the truth as to whether or not she committed adultery. I have the documents. The ex never names names. There is nothing anywhere to indicate her current husband was involved in the alleged affair.

Luci wants to destroy lives without consequences - well Luci Goosey the lesson of glass houses is coming home to roost.

Assuming her ex husband is telling the truth, Luci thought it acceptable to destroy the security of her 5 year old son. If she cared this little about her own 5 year old son, why should we believe she cares about the children of Brownsville?

After a court ordered social study, the parties agreed that it was best for little Eddie to live with his father. This was unheard of 25 years ago.

It did not end there - by her own admission in subsequent hearings she admitted to never paying her child support. Based on information in the file I am guessing she believed she did not have to pay the child support because on the same day the divorce degree was signed she filed for bankruptcy. Several years later Luci Goosey and her ex signed an agreement to relieve her of the child support if she relieved him of a debt he owed her.

One event in the file tells me both parents were more interested in their faux faith in Jesus than their son. Court proceedings were dragged out over the child attending church and which church. It is sad when a little boy is used as a pawn in such proceedings. I am certain there was significant discord imposed on this child during this period.

BE CAREFUL WHAT YOU ASK FOR - ANTONIO JUAREZ WINS THEN LOSES

Because we all know endless lies will be put out about the latest Fifth Circuit court of appeals ruling concerning Antonio Juarez, I am forced to post the opinion so people can read it for themselves.

Here is the scoop - the court only made one legal ruling. They ruled that the Trustees do not have to engage in a formal vote to be sued for retaliation in regards to employment decisions. I support this ruling 100%. This ruling means everyone Presas-Garcia, Escobedo, Longoria and Saavedra retaliated against can now sue them and immunity will not apply. Mary Rey's sworn testimony is all that is needed to raise a fact question to allow for the lawsuits against these four to move forward.

It also now allows a woman I know to sue Antonio Juarez, Pat Lehmann and Art Rendon for having her housing voucher suspended in retaliation for her successful TEA complaints against BISD when Art Rendon was in charge of Special Services. Legal aid was hesitant to file the lawsuit because they believed a formal vote was needed. No such vote is needed. I can only hope a Dallas law firm will now take the case.

The court on the greater issued dismissed the appeal for a want of jurisdiction. This was an interim appeal. Interim appeals can be taken on questions of law related to immunity. The court resolved that because a formal vote is not required immunity does not automatically apply. It was very clear in its holding that at this stage of the case the defendants have failed to establish the right to immunity. This means they can establish it at a later date.

The court was also clear it was resolving no fact questions, in that it had no jurisdiction over such matters. Fact questions must wait until after the trial and a formal appeal is taken. The court made no findings of wrongdoing by anyone. All they found was they have no jurisdiction to consider the evidence at this stage of the proceedings.
In the end only two things come of this opinion. the court of appeals made no findings concerning facts as established, and ruled as a matter of law trustees can be sued for informal decisions without there ever having been a formal vote.

On the question of law I am very happy with the court.

The bad news is, the current majority may now see a plethora of suits against them alleging informal decisions of retaliation. In the same way immunity does not apply to the current defendants it will not apply for Presas-Garcia, Longoria, Escobedo or Saavedra.

The other bad news is, every insurance company in the country will oppose the finding on the question of law. This will mean pressure on ACE insurance to seek another rehearing en banc and a possible appeal to the Supreme Court. It would not shock me if ACE manages to get BISD's current insurance company to file a brief in support of their position.

The other bad news is Thompson Horton is now in a mess. All of the other school districts they represent will oppose this opinion. They now have to decide, will they stand with the rest of their clientele or with the BISD majority.

QUINTANILLA'S HOME GOING INTO FORECLOSURE ON JANUARY 3, 2012

I have held this post because I have been waiting on the judge to formally sign the order denying the temporary injunction. The judge seems unwilling to sign an order which verifies her own ruling. So I am now providing an update.

The first document is the notice of foreclosure set for January 3, 2012. Quinintanilla is very confused with the law. NTex is the substitute trustee. Any mortgage company can appoint just about anyone as a substitute trustee. It is standard practice for substitute trustees to be removed after a foreclosure. His failure to understand this could cost him.

He has sought another TRO set for December 28, 2011. I suspect the court will receive it as a rehearing on the Temporary Injunction, which according to Quintanilla was denied after he failed to appear.

Quintanilla has been down this path before. The second document is the dissolving of the Temporary Injunction after the matter came to a full hearing. This occurred during his first case.

In the original case after the TI was dissolved the parties agreed in mediation that Quitanilla would be allowed to seek a mortgage modification. The next document shows that after Quintanilla failed under the terms of the loan modification his original case was reopened and the mortgage company was free to foreclose on the note.

The final document is a document prepared by and signed by Quintanilla. In it he dismisses his original lawsuit based on an agreement he made with NTex. Quintanilla now claims the agreement was based on fraud.

I have no idea what will happen on the 28th. My sources are telling me the judge, Emily Tobolowsky is a judicial activist and cannot be trusted to follow the law. Some of this can be seen in the fact she has refused to sign the order denying the Temporary Injunction. It is not disputed that she denied the Temporary Injunction, so the question becomes - why is she refusing to sign the order as provided by NTex. I am the first to agree the proposed order is over broad and abusive, but the judge nonetheless has a duty to sign an order - even if she herself has to prepared it.

Another Dallas Judge Carl Ginsberg spent quite a bit of time reading the Brownsville Voice. This does not help the process. If he shared with Emily Tobolowsky what he learned Quintanilla could find a bias against him based on outside research. It certainly does not speak well of either Ginsberg or Tobolowsy that Ginsberg or his staff chose to research the Brownsville Voice and Quintanilla. This is not how honorable judges act.

IS DRAMATIC CHANGE AROUND THE CORNER?

I wasn't planning on such a post, but last night I read what follows and thought it so fits the reality I know.   I read newspapers all over the world, and this guy is not far off the mark. The Mayan calender issue is not about end times, it is about a dramatic change. Maybe the Mayans knew what they were talking about. We are facing a major crisis with the melting of the permafrost and release of methane gas.

I personally believe currency as we know it will die sometime in 2012, or very early 2013. The major governments cannot sustain borrowing at their current levels, they cannot also move their economies forward without borrowing. Capitalism has collapsed - its burial is a formality. One of Nixon's great accomplishments was to extend the demise of capitalism. He also won the cold war, the former Soviet Union and Reagan just did not know it.

Within months the euro will collapse. It has no where to go and Europe is too divided to save it.   Europe will be the first to abandon modern currency. The major economies eat up resources based on borrowed money from developing economies. The wealthiest of the wealthy in developing countries loan their money to developed countries instead on investing in their own countries. This made it impossible for developing countries to reach the point of being major importers of high tech items.

The world is broke - there is no where to turn. The US cannot move forward without sucking up the last of the financing being offered by China. China owns the US and our leaders know it.   The only option left is for the major economies to walk away from their debt and issue a new currency which is not based on tax revenues but on printing money as needed. Have you noticed even gold and oil are beginning to collapse?

WHAT FOLLOWS IS FROM A EUROPEAN OBSERVER OF THE U.S.

Anyway see what he says. On 9/11 I had two views - it united us, and then destroyed us. The day Colin Powell went before the UN and lied about the weapons of mass destruction I knew we were done. I thought to myself - how in hell is the news media buying the claim we lost visual contact with tractor trailers which allegedly held weapons of mass destruction? As former military intelligence I knew better. It was the ultimate lie. On that day I planned my move to Brownsville - it was a matter of logistics and funding. Once I worked out the funding I made the move. Why Brownsville? because the distance of the economic collapse in Brownsville would not be as far as in a major city like Dallas. Further, Dallas had become too dangerous to live in. I lived in an old community which was probably 75% retirees.

The area is known as White Rock. My neighbors would do their morning walks with baseball bats. Our shed was emptied by the Russian Mafia after they removed the bars from the shed door. In another incident they knocked down the fence to let the dogs out so they could get into the backyard. My car was in the shop so they did not realize I was working in my home office. This is the only reason we were not robbed.

When John went to France for 6 weeks my first night alone in the house was met with machine gun fire. Several days later at a homeowners meeting this is what a homeowner said to me "you have been in that house for 3 years and you still are not use to the gun fire?" OMG -

Dallas has long ago walked away from sanity. Every professional I knew who lived in Dallas has since left. Most have moved their families to counties with no real cities and lots of open area. Many only travel to Dallas on days they cannot work from home. Most people I know have put all their savings into paying off their homes - while their homes may have lost in value - it is still a home for their family. When currency collapses a home will become the most valuable asset you have. With the exception of my European portfolio I have sold everything and put it into my mortgage. I can pay my mortgage on a very small income. My goal is to pay it off by the end of 2012. Every discretionary penny goes to paying down the principal.

I hate converting my retirement accounts into paying down my mortgage but it makes sense if I believe currency will be worthless by the beginning of 2013. I may have no money in the bank or my retirement accounts, but I will have a home which is mine. If I can get just a short term increase in my European portfolio I will sell off that last retirement account and pay down the mortgage.

While I truly believe with the exception of Jon Huntsman all of the Republican presidential candidates are complete idiots, I also believe Obama will never lead us out of this economic crisis. Oh things may get better for a while, but the US is not preparing for the collapse of the euro.

ORDER ON QUINTANILLA

FORECLOSURE TO BE UPDATED

THIRD UPDATE: Based on documents Quintanilla filed with the court I can now verify that he did in fact miss the hearing and the court denied the temporary injunction. The court docket sheet shows the court has set another TRO hearing for Saturday December 24th. This cannot be right, but who knows with this court. I will tell you the Dallas FBI agreed today to receive via email a document which I discovered last week. I am not going public with the document. You should know the Dallas and Lubbock FBI offices are part of the same region so their agents share everything right away.

As to Quintanilla's claims, he seems confused - in a no evidence Motion for Summary Judgment he must produce evidence that NTex has no legal authority to seek foreclosure. He gets this evidence by serving discovery on NTex demanding any and all documents which shows NTex's legal authority to seek foreclosure and documents which show the deed was transferred to them. So long as he seeks this discovery the court will not grant a No Evidence Motion for Summary Judgment. The kicker is he cannot wait until the eleventh hour to seek the discovery. If they produce the documents pursuant to his discovery and it shows they have legal authority over the deed, then the case is over. If they fail to produce the evidence, then he survives the No Evidence Motion for Summary Judgment

UPDATE: COURT CLERK STATES TEMPORARY INJUNCTION DENIED

At 11:50 a.m. I spoke with the clerk of the court. She initially gave me a hard time. I said fine, I will email a Rule 12 Request for access to the judge's notes on the Temporary Injunction hearing. Only at this point was the clerk willing to read the judge's notes to me. According to Margaret Thomas Quitanilla failed to appear. The court took evidence and the Temporary Injunction was denied.

I am suprised by this and will still do a Rule 12 request to verify same. Quintanilla checked my web page at 10:05 a.m. which to me meant he had just left the court room. Until I get a copy of the Judge's notes under the Rule 12 or see the actual order I will take this as an unverified statement by a court clerk.

UPDATE 2

Quintanilla filed a Response to the Motion for No Evidence Summary Judgment and Amended Petition. It has today's date on in terms of the docket sheet, but it could have been filed yesterday. I am not trusting this clerks notes until I see an order or the court responds to my Rule 12 Request for the court's notes as to the hearing. As soon as my source can get access to Quintanilla's filing I will post it. Something smells about NTex. I am about the process and not the result. If NTex is acting illegally then we need to know. Wrong is wrong - with the BV it is not about sides it is about process.

Unless someone comes up with a lot of money for Quintanilla the house should be posted for foreclosure in January. It is possible Quintanilla and NTex had a back door deal - only time will tell.

The court's docket sheet shows the court entered an Amended Order to Enjoin Foreclosure. My source has not been able to get to the actual order. In fact yesterday he could not even get to the file, which is a public file. As soon as my source has the order I will post it.

The Amended Order is nothing more than the court fixing its original order for its defects. My source just got the order.

My view is there was something defective in the original paperwork which is why NTex did not take the original defective TRO on mandamus. The mandamus was an easy win and they could have foreclosed this month. But, they still would have been subject to a wrongful foreclosure suit, assuming the paperwork was defective.

If in fact the court continued the injunction, it is in part because of the attorneys for NTex. As I noted last week or the week before their response and motion for no evidence summary judgment on the issue was so unethical in its argument any reasonable judge could see something is wrong.

As to the December 12th hearing - my source is telling me there is nothing in the public docket sheet concerning the hearing. My source will check again later in the afternoon

AS USELESS AS TITS ON A BOAR HOG

NOTE: The BV will not be regular - I have something coming down the pike and just want to keep the readership around. Many days you may just see Christmas music - but I will keep you informed about what is happening, as it happens, unless my hands are tied.

Not only all over this country, but all over the world, union leaders are organizing their membership into protest. The main teachers' union for BISD has their spoke person begging for mercy from the BISD majority.

The firefighters rather then organize a recall against Rick Longoria, which is what would have happened anywhere but Brownsville, they just go along to get along and hope the courts will save them.

The Cameron county and Brownsville unions are self serving entities with no regard for the people or their communities. They use the people for their agenda and then dismiss them when it comes time to stand with the people.

While the BUC has endorsed some good representatives of the people- Melissa Zamora for one (look she has a major image problem, but her overall voting record has been with the people), their process is as corrupt as Brownsville and Cameron county politics. The BUC has give us more corrupt and inept leaders than any other organization.

I did not vote in November. It pained me to not vote for the collective bargaining rights for sheriff deputies. I have a very profound commitment to unions and collective bargaining. But in Cameron county and Brownsville the unions could not care squat about the people.

In the 30's and early 40's my father stood with the workers of Brownsville and organized unions. He in fact did this all over the US. Every time FDR and his henchmen ordered the arrest of the union organizers people like my father stood their ground and fought. They walked out of jail with their head held high and did what they needed to do to protect the workers.

One only need look to the leadership of the firefighters union and the main BISD teachers union to see unions have no leaders today. No one in their leaderships could even fathom going to jail for defending their rights.

Back in the 30's and early 40's many union organizers were members of the Little Kremlin. They took no shame in standing for workers and their rights. Of course as the truth came out of the Soviet Union, the members of the Little Kremlin left the organization, but nonetheless continued their organizing.

The world is up in arms protesting - but not Brownsville. The unions here are as useless as tits on boar hogs. They will never fight for the people or their community. They will only stand up when it serves their purposes.

Until things change in Brownsville and its unions have real leaders I can see no reason why anyone would lend them a helping hand. They use the people while refusing to give back. They are not giving back by fighting fires. That is their job and they are paid for it.

Our unions sat quiet while $24 million went missing from BND. Our unions sat quiet while $14 million went out the window at BISD. I will never support any pay raise for any union members until they have new leadership willing to fight for the people.

All over the world and the US the unions are organizing protests and fighting back - in Brownsville they are riding around on their motorcycles, having barbecues and drinking - what a pathetic lot they are.

There is a reason why the collective bargaining vote failed. What have the unions done to earn the respect of the people? - nothing - absolutely nothing.

The justices blocked Texas from using state legislative and congressional maps drawn by a lower court as a substitute to a state map. That court had said the state map could undermine the voting rights of Latinos and blacks. Texas Gov. Rick Perry and other state officials said the lower court exceeded its authority and should have deferred to the Texas legislature, which is controlled by Republicans."

NEWSFLASH - FBI MEETING

Today I spent from about 2:35 until 3:15 being interviewed by the FBI. I did ask what I can say about the interview and was told "Free Speech." I do not work that way. With Free Speech comes responsibility. What I will say is, I am happy. But I will also say, I have a greater sense of what is in front of Brownsville. It is a long road. I have told my readers in the past it takes the FBI 3-5 years to do anything. The FBI in all cases have this sense that the wider the net the better. This is not a rule which only applies to Brownsville. So while you an I may want action today, they see it as "if we wait a bit longer we can include more people in the indictment." I tried my best to get specifics out of them and could not. The interview was about me giving information, not getting information.

Finally let me say, while it could take 3-5 years for indictments (I speak generally about any case and not about why I was at the FBI offices), certain events can trigger quicker indictments. This is the nature of the beast with the FBI. Think of it this way - you see a deer with 6 points, but in the distance you also see a deer with 8 points. Do you shoot the 6 point deer and send the 8 point deer running or do you wait and snare the 8 point deer. If you understand this, you understand what is happening at the FBI, generally.

Here is a reality check, the FBI does not fancy to people saying they have been interviewed when they in fact have not been interviewed. The FBI is one agency I take very, very seriously.

The Herald is reporting the Board voted for dismissal of the Healthsmart lawsuit. A non-suit is self executing. This means the judge does not have to sign an order of dismissal. All Judge Euresti can do is use his inherent powers to find the non-suit is fraudulent and order a hearing. Ted Parker had his attorney John Barr file a lawsuit against several city of Lubbock officials. In the end Ted Parker and his companies had to pay a large sanction in the form of attorneys fees. They hired an auditor by the name of Danny Dafenbaum, and still had to pay $850,000 in sanctions to the city of Lubbock.

On June 9, 2011, Brett Springston resigns. On July 14, 2011, Defendant David Hall filed for Summary Judgment.

David Hall is one of the defendants in the Healthsmart lawsuit. Minutes 1:28:30 to 1:29:25 - Mary Rey verifies that on the day Thompson and Horton were hired, (December 9, 2010) they met at Cheddars. Mary was introduced to David Hall, a defendant being sued by BISD. Why was Luci Longoria having lunch with someone being sued by BISD? Hall's lawyer can be disbarred and indicted for this meeting, if it is shown he knew about it and failed to report it to the court.

WHAT CAN BE DONE?

Joe Colunga, Rolando Aguilar, an Minerva Peña can call on the TEA to take immediate control of BISD to save the Healthsmart lawsuit. They will not. These three are more dishonorable than the majority 4. They profess to be better, but yet do nothing. At theIr request the TEA will intervene.

Assuming, Judge Euresti signs an order of dismissal on Thursday, the people have 30 days to reopen the case. If it is true Carlos Quintanilla is to get a payoff, something no has proven to date, Ted Parker could find the payoff to be a big waste of money if the lawsuit is reopened.

The TEA can hire counsel for BISD and charge it to BISD. The hired counsel can put the majority 4 under oath along with Ted Parker and Carlos Quintanilla. The smallest amount of evidence to prove the court was used to commit fraud, and Judge Euresti can reopen the case with BISD's counsel being the attorney hired by the TEA.

A private citizen, as a taxpayer, can file a Petition in Intervention alleging fraud. There will be an issue of whether or not a taxpayer can file an intervention to prevent fraud by the trustees, but the final decision will lie with the Texas Supreme Court. It will take years going through the appellate process before Ted Parker will learn if he is really off of the hook. Time is on the side of the people. But of course this is all academic. No one is going to go to the TEA, and no citizen will file a petition in intervention alleging fraud on the court.

THE DECEPTION AT BISD

I have no idea what happened last night concerning Healthsmart. But this I know - there is a deception with Thompson Horton taking the lead.

A docket sheet is a list of pleadings and orders of the court. Here is the docket sheet in the Healthsmart lawsuit.

You will note Healthsmart filed a No Evidence Motion for Summary Judgment. This means BISD must come forward with some evidence to avoid the court throwing the lawsuit out of court. Thompson Horton on behalf of BISD has had more than adequate time to file a response with the evidence. The audit which resulted in the lawsuit is more than enough to defeat the No evidence Motion for Summary Judgment.

This appears to be the setup. At the hearing set for Thursday the court will be free to throw the lawsuit out based solely on the fact BISD presented no evidence to defeat the No Evidence Motion for Summary Judgment. The corrupt majority then gets to claim the court dismissed the Healthsmart lawsuit. Of course no response was filed at the request of the current majority. This is malpractice on the part of Thompson Horton.

The trustees are not the client. The school district is the client. Thompson Horton does not represent the majority. The reason the trustees have some form of immunity is because they are considered the government. The government is one entity. Thompson Horton is to place itself in the position of being fired if need be to protect BISD. Their malpractice insurance carrier better start looking at their defense now, because a new BISD majority would have no problem securing a judgment against Thompson Horton

This is a deception which will not work. If a new majority if created in November 2012, it will have no problem refiling the lawsuit which includes the current BISD majority as defendants and Thompson Horton. This is the same game they played in Rendon which is why they continue to refuse to release any documents which show exactly how much Rendon was paid and by whom.

The true criminals here are Joe Colunga, Rolando Aguilar, and Minerva Peña. They know the truth, but remain silent. Why?

According to the docket sheet part of the lawsuit against Montoya and Robert Sanchez filed by Joe Colunga remains pending and is in fact set for trial. The claims made by other parties are simply incorrect, according to the docket sheet.

THE TRUTH

The BV is back for one or two days - that is it. I am so enjoying reading books. Since moving into my house I have not had the time to really organize things. This week I will make a box which holds the cable and DVD box with the TV on top of the box.

Below was originally a wet bar in the family room. I took out the sink and am using it for an entertainment center. The box will match the cabinet, and then allow me to put the TV on top of the box.

My point is, I am enjoying my free time. If I believed for one second the BV could change anything, I would have kept it going. The reason for today's post is to demonstrate how the system is so broken, it would be an exercise in futility to continue the BV.

JUAN MONTOYA - SERVING TIME

UPDATE: Montoyas has an appeal hearing on the 7th. The file did not show who filed the notice of appeal. The docket sheet also does not show any information along these lines. But the file did have Alex Dominquez's name in it with his phone number. This does not mean Dominquez is representing Montoya. But if he wants to keep the propaganda machine going againt Oliveira he better get Montoya out of jail. I sent to his campaign the Turner v. Rodgers case from the Supreme Court. If you want to help Juan you better make sure Juan or his attorney have a copy of this opinion before the hearing. Regardless of what I think of Juan Montoya the law still applies and I believe under Turner v. Rodgers he should not be in jail.

As of this morning the inmate list shows he remains in jail. Over the weekend his name dropped of the list. If I am nothing else I am about the law. I am the perfect juror because I can dislike someone, but still demand the law apply.

Unfortunately for Montoya, Sorola has been his lawyer. I do not know if Sorola attended the hearing last week or if he had another lawyer. But here is the scoop, the use of contempt to force payment of child support took a hard hit last year when the US Supreme Court found that based on a financial sheet which reviews the Respondent's ability to pay a court cannot incarcerate a person for failure to pay unless a review of the data on the financial sheet affirmatively shows the respondent can pay the sum owing, but chose not to.

There is no way the financial sheet showed Montoya had the ability to pay the sum owed. See Turner v. Rodgers (US Supreme Court 06/20/2011) Had the law been applied, Montoya would not be in jail. The real bad news is, I am certain error was not preserved, and even if it was - good luck finding someone who knows how to get him out of jail. I know some people are celebrating Montoya being in jail, but if you are, you are celebrating a contempt for the law.

This woman is everything wrong with Cameron County and Brownsville. She has no moral compass and could not save her own soul if she tried. Integrity would mean not hiding the fact she has asked people to raise money to get Montoya out of jail. Why? She cannot afford to have his propaganda machine for her down for 3 months. Yolanda Begum has so much contempt for Brownsville and its children that she has no problem funding the propaganda machine which will see the corruption at BISD continue, and $14 million dollars go out the window.

I have no idea what her motivation is in running for JP. All I can think of is, she wants a place among the social elite and believes being able to call herself a judge will provide her a seat at the table. I have a news flash for you Yolanda - the social elite consider you a cyst on Brownsville. You will never be welcome at their table. These are educated people. You told them everything they needed to know about you the day you placed an ad with Montoya.

People Jim Barton is running cover for every corrupt and unethical politician or candidate he considers a sacred cow. No one can dispute he is running cover for Ben Neece. He has no problem asking why school trustees would associate with a convicted felon. But Jim Barton is dead silent when it comes time to question why a sitting judge is working with a convicted felon.

On Yolanda Begum I know she is trying to raise money for Montoya because she emailed Jim and asked that he try and get people to donate money for Montoya's back child support. He has asked I not discuss this because when he told me about it in an email he was drunk. When a 63 year old man still does not his limits with alcohol we have a problem. Why does it not shock me Ben Neece has another drunk running cover for him.

Left to right you have Carlos Quintanilla, Craig M. Crockett (the unethical attorney for the company seeking the foreclosure), and Emily Tobolowsky (the judge of the 298th Judicial District Court - who never met a law worth enforcing).

UPDATE: Based on a threat I got from NTex's lawyer they are very unhappy with my actions in exposing the truth. I do not know what it is, but the nature of the threat informs me there is a problem with the foreclosure or their authority to seek foreclosure.

I am going to take this methodically, but at the end I will be throwing Quintanilla a life preserver. NTex's lawyer is engaged in unethical conduct and the court documents prove it. What you will see here is a convicted felon using the courts to avoid his financial obligations on his mortgage, lawyers for Ntex, who has so little knowledge of the law it shocks the mind, and a judge who sees the law as something not even worth consideration.

But in the end I am about the law. These people need to win fair and square and what is clear in their last filing with the court is, Craig Crockett is an unethical lawyer misrepresenting the law for the sole purpose of taking advantage of a pro se. This is a black and white violation of the rules of professional conduct. Again, just because I find Quintanilla to be a cyst on society, does not mean it is okay for lawyers to make unethical arguments before a judge so that they can foreclose on his home. First and foremost I stand for the law, regardless of who the players may be.

And for the record I provided Jim Barton all of the documents related to Quintanilla's foreclosure, IRS lien etc. Quintanilla cannot speak without lying. My hope is he is a sociopath. At least if he is a sociopath he then may have the defense of mental illness. This would mean he is not pure evil - he is just mentally ill. But this is a matter for a psychiatrist and not me, in that I am not qualified to make such a diagnosis.

And for the record Carlito - I have an endless number of people in the court house and in Dallas who on demand will provide me any documents I want. All court records are public records. In terms of this TRO I believe it was 10:15 a.m. when the clerk told my source that it would be ready within 30 minutes or so. It was in the process of being recorded into the official minutes of the court. The second it was ready, my source was given the order and it was provided to me within minutes.

The more I read the order of the court the more bizarre the order becomes. It is clear Craig Crockett who represents NTex, and Judge Tobolowsky have zero knowledge of the law. how can justice be an option when this level of incompetence exists.

If you read the order she ordered a permanent injunction. This is a final order, by its plain language. But even though she issued a final order granting a permanent injunction she then sets it for a hearing on a temporary injunction. You get the impression this incompetent judge did not even read the order before signing it.

HEY CARLITO - HERE IS A LIFE LINE: Once she signed an order granting a permanent injunction it is a final order. She has no jurisdiction to now go back and have a temporary injunction hearing.

Second, where in Texas Property Code 51.002 does it provide for injunctions against foreclosure as found by the quack judge Emily Tobolowsky? It does not. Again, did she even read the TRO order prepared by Quintanilla before she signed it.

Third, where in the order does it state Quintanilla will suffer an irreparable injury if the TRO does not issue? It does not. Where does the order provide "define injury they were designed to prevent" and "explain why such injury would be irreparable" ? It does not

In re Office of Attorney Gen., 257 S.W.3d 695, 697 (Tex., 2008) (orig. proceeding) (per curiam) (temporary restraining orders that did not meet requirements of Texas Rule of Civil Procedure 680 that such orders "define injury they were designed to prevent" and "explain why such injury would be irreparable" were void.

A competent attorney would have taken Judge Tobolowsky on mandamus. See, Office of Attorney General. The court of appeals would have voided the TRO and the foreclosure would have gone forward.

NTEX ATTORNEY CRAIG CROCKETT MAKES QUINTANILLA LOOK HONORABLE

I do not doubt that NTex has the right to foreclose on Quintanilla's home. But between Crockett's unethical conduct and incompetence Quintanilla can win the hearing on December 12, assuming his house is not foreclosed on Tuesday. Do not worry Carlito - Crockett could never understand the legal issue herein - he simply does not have the intellect - your house is safe.

Mr. Crockett for NTex filed a No Evidence Motion for Summary Judgment. If Quintanilla had an attorney this motion would be met with a motion for sanctions.

"After adequate time for discovery, a party without the burden of proof at trial may move for summary judgment on the ground that there is no evidence of one or more essential elements of a claim or defense. See Tex. R. Civ. P. 166a(i)"

The rule of thumb is at least six months for discovery is allowed before a party can move for a no evidence motion for summary judgment. Quintanilla has been provided no time for discovery. This motion on its face is unethical. Like I said, I do not care who you are - I will always come to your defense when I see corrupt lawyers and judges taking away your rights.

FURTHER - NTEX'S ARGUMENT IS ALMOST TOO BIZARRE TO BELIEVE

They are actually arguing that Quintanilla is not entitled to the documents which show their legal authority to seek foreclosure because he signed an agreement with them, which according to them has breached.

Let's put this in context. A person who is a professional con artist goes to some senior citizen who is facing foreclosure and tells her - sign here - we will lower your interest rate if you just pay us so much today. This senior citizen now defaults. The con artist seeks foreclosures. The entire thing was a scam. Under NTex's argument this senior citizen would now be estopped from arguing fraud, because once you are the object of a fraud you cannot challenge the fraud.

I hate court, lawyers and judges. What you see in Quintanilla's foreclosure case is a con artist using the courts to avoid paying his mortgage, an attorney for NTex who is unethical and appears to have no knowledge of the law, and a judge who seems oblivious to the law and possibly her own existence. This is reality in almost all cases in Texas courts.

I also asked for copies of the Rendon settlement checks. The date on the response to me is November 16, 2011. BISD responded with no checks made out to Rendon or Ace insurance exist as related to the Rendon settlement. Why is BISD hiding the truth about how much Rendon was paid?

Remember according to court documents filed by Rendon - he was paid by the 10th.

TOMORROW'S FACES OF CONTEMPT

FOR JUSTICE AND THE PEOPLE

Well technically Sofia Benavides is already at it. I'm dealing with a real bad cold and am kind of tired. A friend called me and asked why I had not posted this before the good bye as planned. I just forgot - I think I was relieved to finally be able to post the good-bye - the final screen will be the same good bye. The BV is gone - all that is left to post is the Congressional maps if the court releases them - and the document I am being told is being posted to the internet today. If either of these materialize before midnight I will post them, unless I am asleep then the deadline is when I go to bed.

While it is true that after the Mary Rey video Carlos Masso had the good sense to pull his ads from Montoya's rag sheet, it does not change the fact he knew and financially supported Montoya's role as the mouth piece for the conduct by the BISD majority. If the State does it job there will be indictments over the bogus PAC created as a front to run a dirty campaign and corrupt the process. If this be the case then it can be said Carlos Masso knowingly financially backed a criminal enterprise for a handful of votes .

At this point Alez Domingues, Yolanda Begum, and Sofia Benavides know full well they are backing a criminal enterprise to defraud the voters and taxpayers. Mary Rey's testimony has enough verifiable facts to prove this. She clearly did not place the ads - her name was misspelled. Montoya consistently misspelled her name. Also NBC 23 staff are going to verify for the Texas Ethics Commission that Montoya represented himself as the public relations guy for the PAC and in fact brought them the commercial NBC 23 rejected as defamatory. This is all verifiable and more than enough to being criminal charges if Texas is so inclined to do its job.

What all four of these candidates have in common is a desperation to win at any cost. If this is how they are entering the race, why would we expect anything different once elected.

People cannot forget that Carlos Masso was a key player in Dannebaum getting away with the heist of $21.4 million dollars of taxpayer money. By his own admission the bonds on this $21.4 million dollars is the only reason we even pay property taxes to the BND.

My readers say they want change and change can come about if people fight. Well then fight - let my readers start an email campaign to everyone they know and inform them how these 4 knowingly financed the propaganda machine for BISD's corruption. If any of these 4 win election Brownsville will only be indicting itself as incapable of change.

SOFIA BENAVIDES AND YOLANDA BEGUM DISHONER ALL WOMEN WHO HAVE BEEN VICTIMS OF DOMESTIC VIOLENCE

I will never forget the vile and horrendous attacks Montoya encouraged against Commission Jessica Tetreau in regards to the domestic violence problems in her marriage. Every year women and children die because of domestic abuse. Every year children become permanently emotionally damaged by domestic violence. Montoya's response was to encourage a vile attack on Jessica for no better reason than she helped to stop the $2.5 million heist by Fly Frontera. Domestic violence is not a political game - it is a matter of life or death - you would not know this by Sofia Benavides and Yolanda Begum's conduct.

Any woman who could vote for women like Sofia Benavides or Yolanda Begum must have serious issues of low self esteemed. No emotionally stable woman could ever defend these women for their silence when Jessica Tetreau was so viciously attacked by Montoya and his readers.

Domestic violence is not a joke - it is an issue which because of women like Yolanda Begum and Sofia Benavides is discounted in our society - there response is - "hey this is politics - we need votes and Ben Neece told us if we advertise here we can get votes - screw morality and domestic abuse - we demand votes."

This is why nothing ever changes.

Asking my readers to keep reading in hopes of change would be a lie. It would be the equivalent of me asking a town which has seen its entire town burned to the ground to turn on their hoses in hopes of saving the town.

If Brownsville wants to take a stand it needs to take a stand against these 4. I know Brownsville - "yea but she puts on really good campaign events" hence why the BV is shutting down. I will not be party to asking people to take hoses to a town which has already burned to the ground. It would make me a liar and a fraud.

The court has given Ben Neece and company until Friday to refute the claims being made by BISD in the Motion for Rehearing. To remind my readers the Trustees are arguing that the court made a mistake about the factual allegations being made by Juarez. They are arguing that since the court's ruling was based on a misstatement of allegations being made by Juarez the court should void its order/opinion.

The court ruled that if a jury finds the allegations to be true the trustees can be held liable. The fact of the matter is, no factual allegation to date has been found to be true.

PROCEDURE ON REHEARING

The court only sends out these letters if they see a basis to grant the rehearing. The purpose of providing Antonio Juarez a chance to respond is to insure he has no basis to save the original opinion.

The mouth pieces for Presas-Garcia have already made it known they will immediately start a compaign of lies and deception. It is sad that with all the people claiming to care not one will take up the battle. If someone informs the BV by Friday that they are taking up the fight and the BV can verifiy they are in fact taking up the fight and they start a blog or web page the BV will post it for its readers.

I hate to say it, but Jim Barton has proven he will publish Ben Neece's lies so in the end Jim Barton will not be a reliable source.

When I learned the above I reported it to the United States Attorney and Rosenthal's lawyers. It blew my mind that a source actually believed that they could tell me a grand jury person told them about the subpoenas and I would not report it. What part of no sacred cows do people not get. It is the evil in this town which makes this source think he and his friends are not accountable under the law. It sickens me.

MARY REY THREATENS

Jesus, do people not get it - I do not play the con game - with anyone.

Mary Rey could not give a rats ass about BISD or its children. So long as she thought she was going to get something from Quintanilla she was willing to turn a blind eye and play the game. She is as much of a con artist as Quintanilla.

But that does not change key parts of her testimony - Quintanilla clearly lied about the lease. Her testimony is enough for the DA to call the witnesses before a grand jury and force their testimony. At this level her deposition remains important.

But guys there will be no part two. Get it - con job - this evil woman will hold all of the BISD children hostage until she gets what she wants - I do not play Mary. Honorable people do not cut deals, they just do the right thing - you my dear know nothing about honor which is why Quintanilla was able to reel you in with so little effort.

The DA and Texas Ethics Commission clearly have enough to convene an investigation. I will bet the farm that 20 years from now Rick Zayas will be telling people he is going to send the deposition to the Texas Ethics Commission any day now.

Nothing but a lack of a moral compass prevents Rick Zayas from walking into the grand jury and demand they indict Quintanilla on two counts of felony perjury, and to open a full criminal investigation against these people under the election code. It is called a grand jury referral. If he calls a press conference before he does it, I defy Villalobos to stop him. Villalobos is already before a federal grand jury - let's add obstruction of justice on this issue to whatever they are already looking at.

But reality check - 20 years from no Rick Zayas will be telling people - any day now. And they will make Joe Colunga their spokesman so he can mumble his way through the press release.

IT IS TIME FOR THE BV TO SHUT DOWN

In the Spring I shut down for a few hours. Carlos Quintanilla did what he does bests - opens his mouth- he attacked Melissa Zamora on the Fly Frontera deal. Until that moment I had no knowledge of who was behind Fly Frontera and simply thought it was a good idea. For years the BV has done articles calling for flights between Mexico and Brownsville. Cheezmeh was simply wrong about the load factors and whether the service was needed. But I knew if Quintanilla was attacking there was a con job at hand.

Had he simply not attacked Melissa the BV would have shut down and the BV never would have exposed the truth which eventually was used by many groups in Brownsville to kill the deal.

A couple of weeks ago I penned another post closing down the BV. I then got a phone call telling me Mary Rey wanted to talk. I never published the post. Apparently she gave someone a recorded statement in April and that person sat on it. Then the person who called me found out about it and tried to act on it. I reached my limits with the BS and threatened to go with what little I knew. I knew had I done nothing 20 years from now her handlers would be saying - tomorrow.

The handling of Mary Rey's deposition was as reckless and incompetent as the Zayas/Cortez reelection campaign. I hate to tell you Mary but you put your life in the hands or people who will never win. They have no skills on the issue or understand how you educate people.

A dead person could have done a better job than Joe Colunga did at the BISD board meeting. Had I been on the other side I would have been on the floor laughing hysterically at his pathetic performance. It has reached the point that Luci Longoria leaves Colunga in the dust in terms of speaking coherently. Now that is truly pathetic. Did the man actually say anything or was it all mindless mumbling.

BISD is in a free fall of incompetence and corruption. My time is better spent helping families with special needs children. The BV takes me away from that task. Some days it may be as simple as referring them to the right doctor to get their child help. Other days it may be sitting parents down and teaching them how to defend their child in ARD meetings.

Brownsville does not have social workers who work for the poor to help them navigate city, county, state, and federal services. There is a strong need for this in Brownsville. There is not a week which goes by that someone does not call me to help them navigate the system.

I will put the hours I have to volunteer into these efforts.

It is clear to me Brownsville is incapable of change. It is a hell hole - the people opposing the current BISD majority are incompetent in addition to being clueless. Mary Rey has been hung out to dry - given this real fact why would anyone else ever come forward.

On Thursday and Friday I will post something - everything I have in drafts will be trashed. They may be more social studies oriented. Friday will be the BV's last post. I will bet the farm no one will replace the BV - people will decry my decision while refusing to take action themselves - hence the real problem.

BISD MEETING - A CROCK

They are talking about removing Presas-Garcia - Presas-Garcia, Longoria are basically threatening Colunga to talk about what he has done wrong - Presas-Garcia did not deny the charges.

Arturo Michel is playing the sap. He is attacking Mary Rey's deposition saying it is not proper. Apparently she said Springston was fired. He uses this one example to put her entire deposition into question. All Presas-Garcia had to do was deny the claims. She denied nothing. The fact remains it was a court order deposition and Arturo Michel's statements are reckless. He knows it was a proper deposition under the rules. His comments were a clear act of conspiracy to cover-up corruption. Only Judge McDonald can order the deposition stricken. The fact Michel never even mentioned it was under court order verifies he acted to conspire to protect Presas-Garcia.

It is for the court to declare the deposition improper and have it voided. Nothing has prevented Arg Miller from appearing in the case and seeking the deposition of Mary Rey. Their refusal to use the process to refute the testimony is clear evidence they cannot refute the claims of Mary Rey.

Michel stated it was a two hour deposition. It was not - this is a lie. It was actually a mistatement - but under Michel's standard of reasoning, which is unethical and bogus, we should ignore everything he said because of such a claring mistake on his part. Michel proves he was hired because the majority needed a con-artist to do their bidding

Also law has a thing known as constructive discharge. If a person is forced to resign from a job under pressure they can still receive unemployment benefits under the legal concept known as constructive discharge. Michel being the unethical lawyer he is, chose to play games in order to keep fleecing BISD in the form of attorneys fees.

Luci Longoria actually stated the depo had nothing to do with BISD.

Joe Colunga's presentation for removal of Presas-Garcia was pathetic. The use of Mary Rey's deposition has been so misused it boggles my mind. Like I said earlier today - if all they had was part one it would be a bust - it was.

It is probably time for everyone to move on - Mary Rey had her shot and her handlers bundled this with the same incompetency as the last BISD election.

CARL MONTOYA TO BE LONE FINALIST FOR SUPERINTENDENT

Again they had Michel defend their conduct - Colunga then changed his vote thereby leaving Aguilar and Peña hanging. He will be confirmed in 21 days. No teachers or parent groups will oppose what has happened.

HEALTHSMART

Escobedo was pushing something but it never came out. They voted down hiring counsel based on a contingency - this would have allowed the lawsuit to continue without costing BISD a penny. Healthsmart will be dismissed in short order - maybe the next hearing. The deal is done. The Mary Rey deposition will stop nothing. It is time people let it go - Colunga, Aguilar and Peña are guiltier of their breach of fiduciary duties than the other four. The sell out was from Colunga, Aguilar and Peña - the people need to remember this come November 2013 - and in fact in terms of their legacy.

Rick Zayas 20 years from now will be telling people he is about to do something - really people - time to fold - nothing will be done - let the board hang itself.

CARTER WILL FILE LEGISLATION TO PREVENT FRAUD IN SUMMER FOOD PROGRAMS

(AUSTIN, TX) - Representative Stefani Carter (Dallas) will file legislation next session to ensure the integrity of entities seeking funds from the government to operate summer food programs.

Yesterday, Dallas-Fort Worth's FOX News outlet ran a story detailing the fraudulent activities of a local man claiming to operate a summer food program. The man, a former ex-convict, reportedly received more than a million dollars since 2009 from the State of Texas to run two separate programs. However, after a short period, the programs began to deteriorate. The lunches served to the children were inadequate, and the programs appeared to be cut short, even though the man took state money. Now, authorities including the Texas Department of Agriculture (TDA) have launched an investigation to determine where the money went.

"Legislation is clearly needed to prevent an instance such as this from recurring," said Carter. "It is unacceptable for the State to distribute taxpayer dollars to anyone without knowing the criminal background of the recipient. At minimum, if an applicant has a conviction in theft or fraud from the past seven years, the application should be denied, and if an applicant steals our taxpayer dollars, he or she should also be forced to pay every single dollar back."

During the 82nd legislative session, Senator Jane Nelson (Flower Mound) passed legislation to allow TDA to conduct a criminal background history record check on entities seeking to obtain low-cost meals for child-care centers and child-care homes. If background investigations reveal specific criminal convictions, applications can be denied. While this was a positive move, the new law covers only child-care centers and child-care homes. It does not require criminal background checks for those operating summer food programs like the one currently being investigated.

"I intend to close this gap and ensure that those receiving funds for summer food programs have a background which demonstrates a high degree of ethics and superior business integrity,” said Carter. “These programs can play a vital role in our communities, and I will not allow the State of Texas to be taken advantage of and our resources squandered, especially in this economic downturn."

What is clear is after a walking quorum by the board majority they decided on someone and then had personnel post it as a job opening just long enough for the loan candidate (their puppet to apply). They panicked after Carl Montoya's mess-up over the social security numbers.

The real sad part is not the actions of the majority - but the actions of the minority. If all Joe Colunga has as a weapon tonight is part one of Mary Rey's deposition he has a bust. The depo by itself is out of context with a previous understanding of the story. It is like trying to understand a book which you started to read after someone stole first 200 pages.

The walking quorum which was used to bring about the selection of whomever is the new superintendent is illegal. But no one will file a lawsuit to stop it. No one will file a lawsuit to enjoin the selection as an usurping of the power of the board. This is what is very, very sad.

Unless they have something concrete and not a he said she said type thing in part two of Mary Rey's depo, tonight's school board meeting will be a bust for the minority. And rightfully so - you cannot role over and play dead and then complain when you get hauled off to the compost heap of life.

Tonight's meeting is a defining moment for BISD - Mary Rey put herself out there - will the people respond by showing in large numbers? If the teachers and parents fail to show in very, very large numbers then they will get what they deserve - nothing. It will be sad if Mary Rey's depo ends up being for naught.

Apparently these two have learned there are federal and state grants to buy food to feed children. E-S Foods help people such as Quintanilla and Carter to get approved for the grants. The food is then bought from E-S foods. Carter has two organizations he uses for his feed the children - MAG and OSP. Carlos Quintanilla has worked with Bruce Carter in both his organizations at MAG and OSP. I do not know if he was involved with the problems in Brownsville.

Bruce Carter is suing Fox News for its story which I reported yesterday. The document I am about to disclose comes from that lawsuit. The lawsuit will be dismissed on December 9, 2011. It is clear his attorney had zero knowledge of defamation law when it comes to the press.

The Texas Department of Agriculture in a letter dated September 30, 2011 references numerous attempts by Bruce Carter's organization to seek reimbursement for meals not previously approved by the Texas Department of Agriculture, or for non-eligible children. Without the taxpayers having to pay the salaries of the auditors at TDA, Bruce Carter would have been paid for meals never approved.

How is it that the city of Brownsville got itself involved with a convicted felon as its only way to feed children in need. The programs are funded through grants. Brownsville can certainly set up its own real non-profit for such a program while getting church youth to donate their time as a community service to make this happen. Why does money have to go to convicted felons to run these programs - the money needs to go to the children.

This program by the State of Texas Department of Agriculture is a joke in the context it has no real oversight. We need to demand the law is changed to prevent convicted felons from accessing the funds. We need to demand that the grants are only given to true non-profits.

Nothing but a lack of interest prevents Brownsville's best from organizing a non-profit to access these funds for next summer so our children do not go hungry. All of the money needs to go to the children, and not individuals using the system as a way to make money.

UPDATE: Apparently they have lost control of Quintanilla again. His latest post is simply bizarre. As is almost always the case with Quintanilla, he makes a post and as part of his out of control response he makes anonymous posts. The timer on his blog is set 2 hours back - his post was at 7:37 with anony posts at 7:42, 7:44, 7:45.

Here is a reality check on his lies. A court reporter is not a notary. Her identification will appear on the official transcript and official video. She does not have to appear on tape.

Now if someone like Quintanilla wants a non-judicial video tape of his sworn testimony he can have a notary - not court reporter - swear him in. The notary would have to identify himself on tape to make it credible.

Carlito complains that the PAC was not notified of the lawsuit. Wrong - only the president is sued. If the president chooses to not notify the other PAC members that is her decision. Hey Carlito remember when Accion America got sued and you lied under oath about the other owners who were never informed about the suit?

What I know for sure is they are desperate. Someone has finally told Quintanilla to shut up- he has taken down posts - edited posts - removed comments. Quintanilla never would have done this unless he was read the riot act. He now posts approved propaganda which when checked with the Dallas Morning News archives cannot be verified.

Juanito is beyond desperate - he knows every attorney he asked about a discovery lawsuit told him nothing was done wrong with how Mary Rey's deposition was done. These discovery lawsuits were created for exactly this type case. You have witnesses who want the protection of the court before they speak. This is exactly what happened in this case. It tells you something about the legal knowledge of whomever is advising them - it took them nearly a week to figure out what happened. A first year law student could have told them in a few minutes.

You do not need a court proceeding to give sworn testimony. They can simply put one person after another before a camera and have a notary swear them in. It is not a legal deposition, but it is sworn testimony. They cannot seem to do this. Of course the notary would have to identify themselves on tape for it to be valid.

Here is the bottom line - they fear what Mary Rey has in her recordings - this is why Quintanilla, Montoya, Neece, Lehmann, Longoria, Escobedo, Presas-Garcia and Saavedra will not sign an affidavit refuting any of Mary Rey's testimony. Their sole response is to attack her as a mother, and claim she is lying over money. In a court room their claims would never make it to a jury. The only thing which will make it to the jury is sworn testimony.

The fact they have presented no sworn testimony is some evidence Mary is telling the truth. They fear the legal consequences of even more perjury. It is not complex - Quintanilla stated he has a signed lease with Mary Rey's name on it - post it to the internet - plain and simple.

Plain and simple - go statement by statement made by Mary Rey and in an affidavit deny it. In terms of the conversations Quintanilla had with Luci Longoria - if they both sign affidavits denying Mary Rey's statements people will believe them. They have not presented these affidavits because they cannot. They are in absolute fear of what is in her recordings.

Carlito wants Judge McDonald to know that he attended a better law school than Judge McDonald. He wants Judge McDonald to know the law school of a federal prison library surpasses any law school Judge McDowell attended. Carlos Quintanilla wants Judge McDonald to know it is illegal for parties to waive the rules or agree to depositions.

Could any individual be more ignorant than Carlos Quintanilla?

Quintanilla handed out food to children and had people take pictures of same for his propaganda machine. But his organization is not a non-profit. No corporation is going to donate the money for food for such a project without the benefit of a tax write off. BROWNSVILLE SPECIAL NEEDS

Twice I have forced BISD to change its policies towards special needs children via TEA orders. Just this past week I got BISD to fix its problems related to mentally ill special needs children through an informal mediation. In the weeks to come the TEA will be issuing major findings against BISD for no better reason that Carl Montoya refuses to mediate the problem in good faith. Each of these acts for special needs children had a positive impact on all BISD special needs children, and not just the families I helped. The TEA orders were directed towards district wide training and rewriting of manuals.

Carlos Quintanilla used the special needs children of Brownsville as cover for his enterprise of public corruption. He delivered nothing for any the children. He did not so much as make arrangements for one child to get a proper diagnoses after declaring hundreds of children were misdiagnosed.

It is always the same with Carlos Quintanilla - he uses children as a front for his real agenda of public corruption and self promotion. He defends Rendon family who runs a beer shop which forces its female employees to wear hot pants so as to be able to sell more beer to perverted men looking to get off on these victimized young ladies. Quintanilla's propaganda war is at its end. He really believes the people will ignore sworn testimony and his lies under oath. He really believes that people will believe his propaganda in face of the uncontroverted fact that at least twice he lied under oath. If he will lie under oath knowing he can go to prison for his lies, why would anyone expect him to tell the truth when he is not under oath?

I do know the PAC has yet to refute one allegation by Mary Rey while the person is under oath. If it is true that the part two of the depo will take Presas-Garcia down, no amount of propaganda by Quintanilla will save him. His need to run to propaganda is proof positive he cannot refute Mary Rey's testimony. His propaganda is proof positive Mary Rey's testimony is trustworthy.

But, if what ever is in part two of her depo fails to produce an end to the BISD majority come Tuesday night Mary Rey's depo will have been for naught. Other than weighting for law enforcement to issue indictment[s] there is no reason to withhold part two. In fact publishing part two now could be what finally gets parents to show up in large numbers and demand resignations. If the parents do fail to show on Tuesday night, again Mary Rey's deposition will have been for naught.

What Zayas failed to understand during the campaign and continues to fail to understand is the Herald has a news black out on the issue. Think about it even a news black out on the release of the social security numbers. Daniel Cavasos decided it would cause damage to Carl Montoya and declared it not newsworthy. The Mary Rey depo should have included a major push in mailers or flyers to educate the public of its existence. For all practical purposes only a couple of thousand people know what is happening. It was like a tree falling in the woods with no one around to hear it.

The holidays are coming - time to bake. For Halloween we had pumpkin bread. Last night I made a fresh apple pie. They are easy to make - the only thing a lot of people do not know is - pies tend to boil over. I always put the pie on the top rack and then something on the bottom rack to catch the juice as it boils over.

WHAT'S FOR DINNER TONIGHT?

I will simmer a 2 pound pork roast in a homemade dried red pepper sauce. It will tear apart like butter. I will serve it with corn tortillas and pico de gallo sauce. Rice will be on the side. If I can find some ripe platano machos they will make a nice side dish with Oaxacan cheese.

ELIZABETH ANN JOHNSON CONTINUES CAMPAIGN OF LIES AND DECEPTION

It is almost guaranteed that this woman will lie and deceive. She is no better than Carlos Quintanilla. She has given me so many unverifiable lies she is simply not credible. She is as stupid as Quintanilla - she thinks she call tell me things and I will not check them out.

I have made it clear to this dimwit Elizabeth Ann Johnson I will not play her games. She is another outsider trying to play the process to the advantage of her side. This does not serve the children. ESCOBEDO PANICS TO SAVE CASH COW

With two TEA complaints certified for abuse of mentally ill children and the failure to timely notify BISD employees their social security numbers were released to the internet, the demise of Carl Montoya was inevitable.

The shock is in Escobedo's panic with an illegal attempt to hire a superintendent without consultation with the rest of the board. Of course it was not Escobedo who posted the opening it was Carl Montoya.

Here is the problem in simple terms - Carl Montoya or Sylvia Atkinson usurped the power of the Board by posting the job for superintendent and then limiting the application time to a few hours. This is a matter for the Board. The Board must direct the superintendent on the hiring of a new superintendent, not the other way around.

Superintendents

§ 11.201 (D) (2) assuming administrative authority and responsibility for the assignment and evaluation of all personnel of the district other than the superintendent;

(3) making recommendations regarding the selection of personnel of the district other than the superintendent, as provided by Section 11.163;

§ 11.163. EMPLOYMENT POLICY.

(a) The board of trustees of each independent school district shall adopt a policy providing for the employment and duties of district personnel. The employment policy must provide that:

(1) the superintendent has sole authority to make recommendations to the board regarding the selection of all personnel other than the superintendent, except that the board may delegate final authority for those decisions to the superintendent; and

(d) The employment policy must provide that not later than the 10th school day before the date on which a district fills a vacant position for which a certificate or license is required as provided by Section 21.003, other than a position that affects the safety and security of students as determined by the board of trustees, the district must provide to each current district employee: (1) notice of the position by posting the position on: (A) a bulletin board at: (i) a place convenient to the public in the district's central administrative office; and (ii) the central administrative office of each campus in the district during any time the office is open; and (B) the district's Internet website, if the district has a website; and (2) a reasonable opportunity

J. EDGAR HOOVER -

A STUDY IN POWER AND POLITICS

I was not going to see this film because I assumed it was just going to be a director taking excessive license with the known facts. Had the director been Oliver Stone I definitely would have stayed away. But the director was Clint Eastwood so I decided to see what he could do with this type film

Clint clearly took some license with the facts. While there is substantial evidence J. Edgar was gay and had a long term lover, it has never been proven. The film played on this a lot more than I would have liked.

But then I thought maybe it was necessary to show why he was the way he was. There is no official diagnosis of "Closet Syndrome." I have worked with a lot of married men who were gay and in the closet - mostly in divorces. Over time I noticed a clear pattern - closeted gay men and women tend to have problems with right from wrong. I think this contributes to child molestation, for one - priests.

But even if they are not child molesters they lose the ability to discern right from wrong. Their mind cannot deal with years of denial - in time they simply snap and lose any moral compass they may have had.

You clearly see this in J. Edgar's character. J Edgar was known for seeing the need for greater law enforcement. He did push the issue and bring about better law enforcement. He quickly learned to get what he wanted he had to learn to blackmail elected officials. The blackmail came easy to him because he clearly had no moral compass.

I like the contrast to his possible lover because he was more open about being gay. He also was bothered by some of J. Edgar's actions. He did not suffer from the "closet syndrome."

If you go watch the film get beyond the gay side show - focus in on how he learned to play the system to get what he wanted.

It is Cameron county politics. Nothing in this town gets done because everyone is dirty and every other politician knows that their peers are corrupt. They know if they stand up and denounce the BISD Board for example, some of the Board members my decide it is time to reveal the secrets of the elected official who denounced them.

J. Edgar's conduct was innovative for its time - but today is is business - it is the art of survival.

The good news is the FBI has now assigned an entire team to deal with nothing but corruption in Cameron county. The good news is Villalobos and de la Garza have both hired criminal defense attorneys after getting hit with subpoenas. (Lawyers in Cameron county are worse than Peyton Place - they cannot hold their tongues.)

If you can handle two hours of a film which is really a lesson in modern politics you will enjoy this film. If critical thinking bores you - go see Jack and Jill. I am not mocking Jack and Jill - Adam Sandler always delivers.
