Again I ask you, how does a stalled car end up in a field with a flat tire.  Castro being Castro told the police way too much.  Further some very inexperienced lawyer is telling Montoya that the police do not arrest unless they see you in the front seat.  Well, I would never hire that lawyer.

Beyond that Castro effectively admitted to the police he was driving the car.  

Castro cannot shut up.  He is social media junkie.  His own posts and words will hurt him.  His best defense is if the officer's cam does not match the report.  If that is the case the charges should be dropped and the officer disciplined.  Like I said, I know of one case where the case was dropped because the officer's cam showed he lied in his report.

But people this is not about a simple DWI, it is about his character and his endless need to lie, trash people, bully people and just outright ignore the constitution.

Everyone who knows the system knows Saenz's does not take his job seriously when it comes to DWI's.  If this case goes forward, Castro will get a slap on the hand which will be no different than if it was you or I.

I GUESS MONTOYA IS BEING PRESSURED TO DEFEND CASTRO WITH A LAME CONSPIRACY THEORY

I guess Mike Hernandez is not happy with how Castro is being taken down in the public light.  Now he will survive this in the end, so telling lies to defend him only really hurts him. No one is going to step forward and defend Zach Blevins as a disabled veteran, our elected officials are worthless.  Defending a disabled veteran who gave a leg for this country should not take a second thought, but not in Brownsville or Cameron County.  Sofie Benavides has refused to denounce Erasmo Castro for his attacks on Zach Blevins.  Veteran's organizations have been told of Sofie's cowardliness.

One the issue of being behind the wheel is just false.  I have tried enough of these cases to know better.

But this lame conspiracy theory by Montoya takes the cake, since any fool who saw the tape saw it was taken from a moving car and not the police.

"Who release that tape and why was it sent to a local blogger? Is there a custom and practice of leaks at the PD to go after particular individuals?"

Montoya was nice enough to post my response to this.  Like I have said, if he would just get out of this pay to report business he would be  the best journalist in the area.  I really wish a lot of people would take out legitimate ads with him so he can focus only on journalism and history.  But he has to eat.

A FUNNY NOTE

The Imp went from saying he was going  to redesign his blog so he would be down a few days to today announcing he is closing it down.  Funny how he closes it down after causing a stir with Castro and on the same day Montoya picks up Castro's defense.  I do not fault Montoya.

At a substantive level are we that different? I am consulting on a case wherein there is not doubt in my mind the defendant is guilty of looking a child pornography.  I am not sure about his claims of molesting family members because they all deny it.  But you know what, the police messed up big time.  My skills will help him get a lighter sentence.  He will still die in prison.  It pays the bills.  But at the same time it holds the police accountable.  It is not about letting off the guilty but making sure the innocent are not wrongfully prosecuted.  People do not get this until it is their loved one being wrongfully prosecuted.  I am not defending this man, I am making sure the police follow the rules which in the end protects the innocent.

If Castro's case is thrown out because of mistakes by the police I say "good."  The police cannot be allowed to ignore the law.  It is that simple
