NEW CITY COMMISSION, WHERE TO BEGIN?

The reality is the new city commission needs to come to understand their budget and where money can be reallocated.  Decisions have to be made.  There in only so much money.

BUT ONE ITEM NEEDS TO BE PUT ON THE AGENDA IMMEDIATELY

Public works impacts the people daily.  There is currently no director.  We need a national search for a qualified director of public works who knows and understands current technology.

My preference is the city encourage veterans who ran public works at battalion level before retiring from the military.  A base is like a small city. The military always has the best technology.

This one simple hire can make a difference in the daily operations of the city, with a positive impact on the people.

The city is highly mismanaged.  They need to start doing reviews on all directors. It is time to clean the swamp.  A more efficiently run city means better services and more money for public services.

GMS REPUBLIC

The city needs to serve discovery on Republic at the national level demanding all emails from anyone with the city of Brownsville including all past and current commissioners within the last 4 years.  If Republic national discovers it local representatives have engaged in wrongdoing with city commissioners, they will pull out of the bid for commercial pick up.  The suit ends.  It is time we get to the truth.

TEXAS COURT OF CRIMINAL APPEALS SENDS JOHN CHAMBER'S CASE BACK TO 13TH COURT OF APPEALS

"Therefore, Appellant argues, the evidence is insufficient to show an intent to defraud or harm TCOLE. We agree."

"However, if the government has no legal authority to require the record, a person cannot defraud or harm Chambers - 2 the government by tampering with the record. Does this also mean that the falsification of the record in this case had no effect on the government’s purpose for requiring the record? That is unclear. We must remand the case to the court of appeals to consider that question because it was raised below but left unanswered."

Click for full opinion.

The Court never gets to the issue if evidence actually existed.  It simply rules under the assumption if the evidence existed under the Statute was a crime committed.  This case can go on for a long time.

THE DISSENT WOULD JUST ACQUIT JOHN CHAMBERS

"I agree with the Court that the evidence isinsufficient to support the intent-to-defraudor-harm element. I also agree with the Court that the court of appeals failed to address the issue raised on appeal of whether the evidence was sufficient to overcome the statutory defense. I disagree, however, with remanding the case and would instead render a judgment of acquittal for Appellant because I find that the evidence is insufficient on the element of “governmental record.”

THE THIRTEENTH COURT OF APPEALS

It is a disaster.  They make Abel Limas look like an honest John.  Note what the Court of Criminal Appeals said - they are remanding the case for the Court of Appeals to do its job and answer the question they refused to address.  This is classic 13th Court of Appeals.  They are a bastion of corruption.

They openly find judges and lawyers are engaging in ex parte hearings and then find no big deal.  It is a big deal and I will deal with it.

They openly violate people's right of access to the court based on disability.  I have one authorization to sue Mike Hernandez's first judge for violating my disability rights.  She responded by sua sponte recusing herself.

Once I am okay I am going after the entire 13th Court of Appeals on this issue, and two federal judges.  They consider disabled veterans as fools who were dumb enough to serve, unlike them.

MY STATUS

I am sitting here trying to finish two briefs which are overdue.  I found 20 mg of hydrocodone from back in September when I had my back surgery.  I have the antidote on my desk.  I took the 20 mg, and 1000 of Ibuprofen .  The pain is intense but tolerable.  Next Wednesday the surgeon will decide to just open the valve more which takes two weeks to work, drain 40-50 cc of cerebral fluid threw the spine while we wait for the increased valve opening to work.  Or at this time protocol requires certain testing to see if shunt failed.  I did not have these cerebral headaches before  the surgery.

If he does not drain the cerebral fluid through the spine to give me relief, I will go to the VA ER and ask for help.

Yesterday was all day in bed in horrible pain.  Today I am barely functioning on a very dangerous dosage of hydrocodone.  When a federal judge proves he does not give a crap it is time to go after him all the way through the impeachment process.

Veterans do not serve to protect his sorry ass so he can deny them their rights.  Nothing will come of it but extreme embarrassment among his peers.  The sad part is I know this guy and he will not care.

 LESSON FOR BLOGGERS

PHIL COWEN SPEAKS TO HOW LIFE'S LESSONS ARE TRULY A PRIVILEGE

When I read the entire post on his FB page it was weird.  Our fathers died a year apart of cancer. While I was 5 he was 13. Are mothers were born the same year. We both came from large families where the kids went out and worked at a young age to make the money needed for the family.  We both had mothers who instead of complaining about being widowed with so many kids went back to the university for an education and to support her family.

I know many things about the Cowen family I have never shared.  We do not agree on everything.  But I know generosity is part of their character.  I am a classically trained socialist and have very strong feelings about workers and how you treat them.  So John Jr. an I differ on the issue.  But he knows developing the Port and airport area for industrial development will bring good jobs, so for that I support him 100%,  I will be supporting Ralph in his reelection eventhough we are not always on the same page.

Since Phil took his position on the BISD Board I have always felt bad for him.  He tries so hard to mentor the younger board members.  But so many times he is stuck between choosing between two devils.  It is no easy task.  We definitely need a majority of Phil Cowens on the BISD Board  - not clones, but character.

BUT I HAVE TO REPEAT THESE WORDS FROM JOHN ON PRIVILEGE - THIS IS EXACTLY HOW I SEE LIFE

"If there was any privilege we as a family held, it was the privilege which suffering gives one to better understand human suffering in this world; it was the privilege which hunger gives one to make sure everyone has enough to eat; it was the privilege which being homeless gives one to make certain every child sleeps in a warm, dry bed, with a roof over the child’s head; it was the privilege of being allowed to exercise those skills which God gave us all and to use them to better ourselves individually, as a family and to help improve the community we live in."

I can tell you my head is ready to burst.  I can barely see and will do further pills today. In fact I am now out of hydrocodone anyway.  A weeks supply lasted nearly a month.  Off for a nap in hopes I can get another two hours of briefing done later.  I know now I was born with a slow developing form of hydrocephalus.  I can be angry for nothing being done about it in 86'. when first discovered.  I can be angry my teachers could not understand how one day I could read a 5th grade reader in 1st grade and the next not being able to read.  But when I can, I will write the story with the new medical evidence which good pediatricians should know about.

It is now documented after age 5 bed wetting can be tied to hydrocephalus or other neurological problems.

For me my 61 year journey is about not being mad but feeling blessed I can educate others so they do not have to go through the same journey.  It was a good journey and it was the journey God wanted for me, so no regrets.

MIKE HERNANDEZ WAS THE BIGGEST LOSER ON SATURDAY AND NOW CLAIMS HE IS DONE WITH BROWNSVILLE - I SUBMIT HE IS LYING

I really wanted to post this yesterday, but unlike Montoya turning Brownsville's big win about Brownsville, Mike Hernandez paid him to make the big win about Mike Hernandez, and there my friends is the fundamental problem.

Look guys I am not stupid.  In this country we make money.  It is not a sin.  For me everything is about transparency.

When many elected officials told me to stop promoting OP1033, while every other blogger was trashing Hernandez, I stayed focused on his stated mission.  I was able to get him to pull his support from Trey Mendez's TSC opponent and back Trey.

It was a difficult situation.  I think Mike's intentions were good, but he hooked up with Carlos Marin and that sent people running.  Mike is not one to listen.

Had he listened he would be in a lot better position today, than being the biggest loser on Saturday. Yes corruption took a hit in Brownsville because Mike was sent packing.

His claim about the hospitality deal is false.  It will never happen.  The UT will never get involved so the deal is dead.  The new city commission has enough leeway to end it now.

He tried to buy Tony Martinez's favor by donating to catholic schools.  Tony took the money and made clear he had no use for Mike Hernandez.  The Carlos Marin connection was just too much for anyone to care about Mike Hernandez or trust him.

I stayed with Mike against a lot of criticism until I had the proof that Carlos Marin was playing games thereby making the entire OP1033 entity untrustworthy.

Mike unable to align with anyone reputable added to his cabal of misfits, Jessica Tetreau - even Mike has to know Marin's  recommendation on that one was really stupid.  Carlos brought Rick Longoria into the mix.  Rick lost because he is Rick.  Good how stupid can you be when you add Cesar Deleon to the mix.

Nurith Galonsky such as myself when she left law school went to work for the community.  She learned their problems and injustices.  She then came back to Brownsville.

She did not just throw money at her campaign, she worked it and worked it hard.  She never stopped going door to door and meeting people anywhere she could find them.

She won because Rick such as is the norm for many politicos lost his connection to the people.  Nurith was a fresh face.

Mike claims to have started a needed school for construction.  It is unaccredited, while TSC's is accredited.  The proof he did not care about job training and it was a farce was when Carlos Marin convinced him to oppose the desperately needed new low and medium income housing development.  This would have meant real jobs for Mike's students but he opposed it at Carlos Marin's request.  Carlos had complete control over Jessica Tetreau and and Rick Longoria.

A side issue is, investors are now selling overpriced remodeled homes to drug dealers under owner finance with a pay off of 2-3 year so each payment will be less than $10,000.  This is making it impossible for the average Joe to buy a home.  Yes the value of my home is going up. Bcause of this I can now borrow enough to resurface the pool, but in a new fense and windstorm windows.  But is it locking hard working families from buying homes.  The price of a home in my neighborhood needing remodeling has gone through the ceiling.  Once the house is paid for the drug dealer can resell it on clean money.  So yes I am benefiting big time, but the average Joe is hurting.

Carlos now has control over no one.

I still believe if Mike Hernandez would just align himself with honorable people, he can still be good for Brownsville.  He needs to admit to his mistakes, and as AA says, he needs to make amends to those he hurt.

If Mike would just change his attitude as to how he does business he could be a good force for Brownsville.  But he has to dump his nonsense.  Promising Mike Rodriguez he would back him for the Port if he backed Rick Longoria was just stupid.  Everyone saw around it and in the process it hurt both Mikes.

WHAT WE REALLY NEED HELP WITH

All over Texas the Texas Workforce Commission provides free job training in forklifts to include OSHA certification.  There is no lack of workers in low paying hotel jobs.  But we have a major shortage of trained OSHA certified forklift operators.

If Mike has the reputation with Governor Abbott he claims to have he needs to push the governor to have the Texas Workforce Commission in Brownsville to provide the same training they provide all over Texas.

We are a major distribution center and there is a high demand for forklift operators.  If Mike can do this then people will see him in a different light. The BV would be the first to back his work on the issue.  I am not locked in against anyone.

But it is sad by aligning with Carlos Marin and the likes of Jessica Tetreau, Rick Longoria, George  Gavito he hung himself.

Mike needs to do one real thing and he can change his image.

In addition to pushing for Forklift training, he needs to denounce Jessica Tetreau for her association with Republic.  Personally I like  the residential services of Republic.  They are very good at replacing my cans when they break. They are very good at the brush pick up. But Jessica and her family making money on the contract with the city requires any honest person to denounce the deal.  Mike Hernandez cannot claim he believes in cleaning up the corruption when he remains silent about the Jessica/Republic deal and having all of his candidates again, lose at the polls.

I NEVER GIVE UP ON ANYONE, AND HOPE MIKE THINKS ABOUT THIS POST - WITH THE RIGHT PEOPLE WORKING WITH HIM HE CAN BE A GOOD FORCE FOR BROWNSVILLE

A SIDE NOTE:

Any real intellectual work is nearly impossible for me.  I am at two hours on 15 mg of hydrocodone and 800 mg of ibuprofen and it is just starting to work.  I can now get to legal briefing.

So you understand after extensive research yesterday on mixing hydrocodone and pot a friend came over and I took a hit.  It was horrible.  I got nothing, no pain relief and no buzz.  It takes more than one hit, and I was just too afraid while on the hydrocodone.  It was scary holding the hydrocondo overdose spray in one hand while taking just one hit of pot.  Then the headache got worse as I caughed up a storm. We really need better medical research on pot as a pain killer, and a way to take it without smoking.

My nephew in Colorado and wife vape a blueberry flavored pot and it relieves their pain.  It is not worth the legal ramifications of even trying.  Yesterday was a one time deal.

It is sad we have to turn to such matters for pain relief.  We need the research so it can be safely administered.

THE COB APPEALS GMS TEMPORARY INJUNCTION

For now all there is, is a notice from the court of appeals an appeal has been filed and notice to the parties as to filing deadlines.  The court of appeals will eventually post the notice of appeal to allow for public viewing.  Such as he has done at the trial court level, District Clerk Eric Garza will not be allowed to block the public from viewing a public record from home.

Of note, Eric Garza's office at the trial level listed former assistant city attorney Alison Haynes as co-counsel for GMS.  The court of appeals at this point only lists the information provided by Eric Garza's office.  So the court of appeals lists Alison Haynes as cocounsel for GMS.

Correction.  The entry is correct.  There were two Allisons - one for each side.
In the court transcript the former city attorney Allison Bastion ID herself for the city.  All I saw was the Allison never paying attention to the last name.

In the courtroom she was clearly cocounsel for the city.  Eric Garza is not running his office.  I know for a fact when you go online [in cases he has not blocked from public viewing] you will find misfiled documents in the wrong case.  This mistake could cost a litigant his case.

Click for entire transcript of the hearing It took a trick, but I was able to find the online file on the case.  Not revealing my trick.  After clicking on link, then click on download.

The BV will not start to cover the primaries any time soon, but the attorneys I speak with know Eric Garza has lost control of his office.  This is a race where a qualified person can easily beat Eric Garza.  For me to restore integrity to the courts the replacement of Eric Garzaa is key.

MAYOR ELECT TREY MENDEZ, BUT ALSO ON THE SAME NIGHT

I intentionally stayed away from the duel celebration because it was Trey's night.  My track record on pro gay spectrum rights nearly dates 40 years so no one can say I did not care.

But now I can say the two great events in one night tells me Brownsville is moving into a modern city.

Now because the BV has no sacred cows, the new commission will get its grace period.  I am hopeful.  We will not always agree, but I know Trey and Rose will lead for what is best for Brownsville.

The three clowns accusing Rose Gowen as being a 4th vote for Galonsky tells you just how little they know about Rose - nothing.  Trey and Rose are the swing votes and you get nothing without their support.  The two as independent minded representatives of the people bodes well for Brownsville.

HATS OFF TO ROSE FOR BEING INDEPENDENT MINDED AND WORKING TO KEEP US HEALTHY

A PERSONAL THANK YOU

All the politios know I never go out to events except on very rare exceptions.  There were a lot of politicos at Trey's celebration and they welcomed me with open arms.  Many have not received good coverage from the BV, but yet they were warm and embracing.  It meant a lot to me.  Every politico knows if they open up to me I will give them a fair shake.  I also go out of my way to be balanced.

In the Sylvia Atkinson/Castro mess Castro has been a complete asshole, while Sylvia has been very professional.  That is a difference character.

CONGRATS TO THE WINNERS AND MOST IMPORTANTLY THE WONDERFUL PEOPLE OF BROWNSVILLE - YOUR NEW BETTER BEGINNING BEGINS IN THE MORNING

I PRESENT MAYOR ELECT TREY MENDEZ

THE BV WILL PUBLISH THE EARLY VOTING BETWEEN 7:05 AND 7:15 P.M.

IF THE EARLY VOTES SHOW A CLEAR WINNER BEFORE I POST THE NUMBERS I WILL SIMPLY HIGHLIGHT THE WINNER IN BLUE AND THEN COME BACK AND POST THE NUMBERS

Because the trolls always have something to say, while Remi Garza has the results, he cannot release them until after 7 and after certain people are in his office.  Campaigns are known to intentionally delay the process and Remi has no control over when the needed people show up at his office.

While you wait for me to post the returns you can click here for the returns.  It will be between 7:05 and 7:15 when they are released.

THE WINNING TEAM BASED ON A STRATEGIC VOTE AS TO WHAT IS BEST TO MOVE BROWNSVILLE FORWARD

I suspect there are probably fewer than 100 people who have not made up their mind yet, so advertising today may not do much.

The numbers for the run off and the original election look like about the same.  I suspect there were very few voters who did not vote in round one who voted in round two.  So the key is where did the loser's votes go?

I think Trey is safe.  I actually have a number which is not 100% based on an analytical model, but based on where people turned out in early voting.  I will release that projection at about 6:55 p.m.

John seems  to be a shoo-in.  He was just too close to an outright win for John to be concerned.  The blind female vote will not hurt him.

Nurith is the one to watch.   The question is did Michael Rodriguez get his supporters to flip for Rick.  The first thing we know about his supporters is they rejected Rick based on his representation of  the district.  As to Nurith it was not so much as a rejection as it was a I prefer and know Michael.  So there is an element of Rodriguez's supporters who will never vote for Rick.

Those voters, especially the women will vote for Nuirth.  I am not big on polluting our neighborhoods with signs, but it was a must for Nurith.  Sorry, but I was raised in NY and know Nurith is a female name.  This fact is lost on many of the voters down here.  So her picture helped ID her as a female.  Second, she needed name recognition.  It worked in round one.

William Garza's voters rejected Rick and Michael.  The female votes may just go for Nurith.  I do not believe they will go for Rick or be influenced by Michael Rodriguez.

Nurith and Rick is the race to watch.

EARLY VOTING HAS BEEN COUNTED

Yesterday from the Elections office.

"Please be advised that the Early Vote Central Count convened at 5:00 pm this evening and completed its work at approximately 7:05 pm.  There were not any issues encountered during the process."

VOTE TREY, JOHN AND NURITH

If you have not voted, please get out and vote for Trey, John and Nurith.  It will guarantee no one has a four person majority. Plus they are our best option to push Brownsville forward

TREY MENDEZ IN FINAL MAILER PUSHES SMALL BUSINESS

Well by about 7:15 p.m. tomorrow we will know the winners unless the races are close. There are not many voters left to vote.  All I can say is make a strategic decision.

THE GED HAS BECOME OBSOLETE AND IS HOLDING BACK MANY HIGHLY QUALIFIED JOB CANDIDATES

The program goes back to WWII to allow veterans who dropped out of high school a way to have a high school diploma.  It took until the 70's but eventually all 50 states adopted the test. Click for history

The other day I went after a store manager after two customers walked out over a lack of customer service (it was a big box store specializing in home repair), and I was at 10 minutes waiting for assistance.  I went to a competitor.

Why did I give the manager a one over.  I know for a fact the store has many job openings.  I help several people with on line job applications.  In multiple cases after HR would clear their applications and send them an email telling them they have been cleared for an interview, I would send them with the email and their resume in hand.  To a person the store manager refused to interview them.  The work experience had zero value to the store manager.  The lack of a GED was a job killer.

Believe it our not we have several former managers at several of the big box stores without a GED who based on hard work, and being self starters worked their way into management.  But many of these stores because of closings or a need to save money are laying off people with 20+ years of experience.

For this store manager, two semesters each of remedial reading, writing and math at TSC had no value.  At the corporate level it is an alternative to a GED.

So I told the store manager because of their ignorance customers are leaving for a lack of customer service while good employees cannot even get an interview.

I could not walk in cold and pass the GED.  Although I have helped many people in getting two A's in the TSC Algebra course I just do not remember the rules well enough to pass the math part of the GED.  Plus I do not have the visual capacity for word problems.

When I worked on the B1-Bomber I knew nothing about inventory control.  I started by stocking parts to be pulled later for assembly, and left as the foreman over machine shop production control.  I was smart enough to learn Basic and Fortran, the basic computer languages while in college, in 77.  I changed how inventory control was done at LTV.  The programmers knew nothing about inventory control, but I knew Basic and Fortran and was able to tell  them how to write the programs we needed to better manage inventory control.  It made a big difference in moving parts.

Before leaving for law school my unit was the only one on schedule  and I was offered a $25,000 raise and bonus to stay.  My wages were lower than others in the same position because I entered the company after a union contract reduced wages.  Boy was I tempted because I loved the job.

My point is, without any formal training as an Industrial Engineer, I out performed my peers.

ALEX DOMINGUEZ

I trust Alex as a true Democrat who cares about these issues.  Change at the federal level would be more of a challenge.  The great thing about our system of government is each state can experiment with policies which then lead other states to adopt those policies.

I cannot explain why, but I can get older adults through the remedial courses at TSC, but not through the GED.

There are other programs like the GED not recognized by employers, but the problem remains the same.

Texas needs to adopt an alternative to the GED.

We need a point system which gives people credits for time on a job.  20 years with endless promotions must have value.  We need to give points for each remedial course students pass at TSC or any other community college.  You get my point.  There should be other ways to earn points.  Then the State should issue a GED based on experience and the remedial courses.

I am sending someone to Houston for forklift training and OSHA certification.  I know someone who is going to bring him in as a temporary summer hire and give him the training.  He will return to Brownsville, but will still face the problem of no GED.  The good paying jobs are there.

In one case I was able to place someone with a good wage with a national corporation which values work experience over a piece of paper.  He is doing real well in his job.  He is a self taught inventory control specialist and has taken to the job real fast.  Now in the end, is not that which matters.

Alex Dominguez needs to work with employers, educators and those in the community caught up in this mess over a GED and try and find an alternative to the GED.  It will mean jobs for so many people.  Brownsville has the jobs. What it does not have is job training in the high demand areas, other than the medical field, or workers who cannot get the job because of the GED issue.

It is time we start to educate employers there is more to a worker than a piece of paper.  Their value is in their work ethic and history of success on the job.

Alex it is time to think outside the box and try and find an alternative to a GED.

JUDGE PATE, PLEASE SEND CASTRO FOR A CLASS IN TOMA

While avoiding a simple question about what happened in Executive Session last night concerning Castro's claims on the false claims against him Castro said: "
Erasmo Castro unfortunately no... and because it was executive session I can’t share info..

Castro is lying or simply does not know the law.  This issue has been to federal court and the BV has extensively laid out the law on discussing what is said in Executive Session.  So Castro either does not know the law, or he did not want to discuss what did not go his way.

FROM AN OLD BV POST

First where on the agenda was there an item to discuss in executive session Castro's complaint?  We need a lawsuit to bring BISD in compliance with TOMA.

Castro needs to make the claim and then disclose everything said about his issue.  It is a crime and every other Trustee not to disclose the violation.

COMMISSIONERS ARE NOT BARRED FROM PUBLICLY DISCUSSING WHAT HAPPENS IN EXECUTIVE SESSION

"Section 551.146 does not prohibit members of the governmental body or other persons who attend an

executive session from making public statements about the subject matter of the executive session.415
Other statutes or duties, however, may limit what a member of the governmental body may say
publicly."

See 2014 AG Handbook - page 63 What cannot be disclose is the Certified Agenda. See Also AG Opinion

This issue gets complex and commissioners should proceed with caution.  You do not want to discuss personnel matters, litigation strategy, or on going negotiations because you could compromise the city.  But if you see or hear something which clearly violates the Open Meetings Act, without getting into any of the former you can discuss it.  You can discuss the city is going forward on a real estate deal which violates the City Charter.

So if a commissioner hears something illegal or is threatened in Executive Session they are free to go to the press with it.  They just cannot disclose the Certified Agenda.  Anyone threatening a commissioner to not disclose illegal conduct is obstructing justice and thereby engaged in criminal conduct.

A CITY COMMISSIONER CAN BE PROSECUTED FOR PARTICIPATING IN AN ILLEGAL CLOSED MEETING

See, Tovar v. State, 978 S.W.2d 584 (Tex. Crim. App. 1998).  Thereafter the Texas Legislature Amended the law to provide for good faith exception such as - being lied to by Mark Sossi.  great right?, unless you never asked him to justify his decision to place an item in Executive Session - then you have no defense.

Guys I am working my ass off on other important matters, but a temporary medication I was given to control my headaches has my mind going in a million directions and causing distractions.

Once the headaches are gone within months I am going to be so so healthy.  It will be like I am 30 instead of 61.  I do not like this medication, but it is allowing me to be productive, except the easy distractions.  I have enough for 5 days and then back to being in bed.

CASTRO REPORT PART TWO AND THE BISD MESS

In this mess BISD is the big loser.  As Jim Barton in his coverage of last night's meeting notes he left to be with ANA [who seems to really care about her health - the pic was nice] because there was really just perfunctory things left on the agenda.  That is about the time I woke up from the massive headache.so I missed the fire works.

Yesterday I said the report said a lot in what it did not say, and Castro made a big mistake in posting it.  The lack of signature issue is real, but that is not the real problem with the report.  Montoya this morning on no proof seems to try and get into what the report  did not say.  I will say now that the case is closed anyone willing to pay for the video the police claim they have can get the video.

I have no personal knowledge on what is on  the tape, and certainly would not accept the claims of a source when the tape is the best evidence.  I simply have no interest in it.

THERE IS NO ISSUE IN MY MIND MONTOYA'S ORIGINAL POST WAS TO PUT CASTRO IN HIS PLACE - WE ALL KNOW MONTOYA IS BEING PAID FOR HIS WORK, AND FOR THAT THE  BISD WAS THE BIG LOSER

As to special services, BISD is still a mess.  BISD is in such chronic chaos the things it is doing right do not get profiled.  When it comes to chess, BISD is a miracle.  But we have a board and one endless administration after another interfering with the good work of the teachers.  I have no idea what Shergold's comment about communism was about, but beyond that I agree with what he said according to Jim's reporting.  The BISD in its competition with the Charter schools is leaving too many students behind who are not getting the training they need.

God we have so many job opening for forlift operators which pays good money and no one is offering training.  I would be the first to praise anyone who would back such a program, even Mike Hernandez.  We are not getting ready for the expansion of the port.  At this time the city showed extreme stupidity in supporting job training in hospitality.  They are clearly clueless about where the job demand is.  It is in logistics and inventory control/distribution - meaning forklift operators who are OSHA certified.  Hopefully John Cowen will bring his expertise in this field to the board once he is sworn in as a Commissioner.

A MORAL QUESTION

This entire thing is odd for me because I believe what consenting adults do is no ones business.  But I do draw a line when the acts involve an affair, or a public figure is clearly involved in an inappropriate act even if it is legal.

I am not speaking of Castro generally.  I am just speaking of my view.   I believe having an affair with a married person is unforgivable.  Jessica Tetreau Kalifa had an affair with Art who was married, got pregnant and then destroyed a family.  Brownsville has been forgiving on the issue.  I am not.  I have been the victim of an affair and it hurts big time.

But conversely if a married couple want to bring third parties into their bedroom, that is their business because it is a joint decision among consenting adults.

I can never imagine myself with anyone under 50.  That is me, but you never know.  It is perfectly legal for me to date an 18 year old, but what would I get out of it.  I have no desire to be any one's daddy.  For me as a public figure any older man or women making out with a teenager of legal age raises serious concerning their public image.

My life right now is someone who wants to travel around the country and go camping.  If things go well in July with my neurosurgeon I hope by late July to organize a camping trip to the Pedernales River.   Once a year trip to NYC for a Broadway show or ballet is me.  My older friends with successful marriages know when it is joint time and when it is separate time.  This is just me.

Consenting adults can do as they please  - I draw the line on affairs and elected officials in relationships with much much younger people.  It is an image thing for the city.  Also a consenting adult is not an alcoholic or drug addict being used by the men at the downtown dives.  Hey bar owners, work with the city to create a red light district around a failed industrial park.  In other cities the police prefer this and the patrons seem to have more freedom.

CASTRO HAS NO LAWSUIT.

Barton reported this from the BISD meeting last night and it is very telling in light of what the police report does not say. In addressing Castro BISD counsel stated "BISD Attorney Baltazar Salazar, loudly talking over Castro, waving his finger, shouted:  "You are stating only half-truths!"

"Don't wave your finger at me!" answered Castro."

The entire exchange was childish, and only invited more scrutiny of Castro. Now remember Salazar is beholden to Sylvia Atkinson.  She has the evidence on his role in her wrongful indictment.  Sylvia should have taken my advice and pushed for a full criminal investigation against those who conspired against her.  But no she chose to hold the evidence to manipulate the process.

Any citizen who believes anyone is having an inappropriate relationship with a minor has a duty to report it.  The concerned BISD member who according to the police who reported the incident could have done a better job investigating before having a blog hacker known for publishing based on pay to publish the claim.

If Castro has any email's or texts which clearly show he was being threatened with exposure of the story because of how he votes, then the feds need to investigate. This endless internet coverage needs to end.  Had Minerva Peña, who allegedly filed the complain simply allowed law enforcement to do its job, this mess would not have humiliated the BISD.

Castro lives for drama and playing the victim.  I am certain he will dig the hole deeper leaving himself without support on the BISD Board.  I feel real sorry for Phil Cowen.  He works so hard to bring good governance, but is always forced to choose between the drama.  I love his probing questions.  But he is in the middle of a mess.  He cannot seem to get a break on his votes.  It is always the lessor two evils.

Castro lost last night on the reorganization.  If Minerva can be proven as the person who released the claim to Montoya then that should be a basis for her removal as Board President.  If the proof does not exist, Castro will never get the 4 votes to change anything.  And last he has no legal lawsuit against anyone.  Montoya will claim he does not remember who sent him the story.  He will have no records of his income.

QUALIFYING ADDENDUM

I have someone in their early 30's sort of pursing me.  I'm flattered.  But they would not like how I live my life.  But I have to admit I have no real problem with men or women in their 60's or 70's dating someone in their early 30's.  If you connect you connect it is weird but be happy.  I' m way too old to change my ways.  But if I were to meet someone who understands me and could trust them to go out on their own with their younger friends - who knows.

Really weird is the women in her 70's I have the hots for.  We just connect.  She is such a sweet heart who gets me.

FINAL EARLY VOTING NUMBERS - SLIGHTLY MORE PEOPLE VOTED IN MAY

REPORT CLEARS CASTRO

But I would submit as a trained lawyer, Castro posting this report was a mistake. What a report says and does not say, says a lot. But to be clear the officer looked at a video, and found no illegal activity.

TREY MENDEZ FOR MAYOR

THE HEADACHES ARE NOT GETTING BETTER AND MY COGNITIVE SKILLS ARE GETTING A LOT WORSE

The below post I made the few grammatical mistakes I could see.  Last night I nearly left Bingo.  I could not connect the letter with the number.  I just kept on getting behind.

My hormone levels are all off.  My vision is very iffy.  Light just makes everything a lot worse.  The medicine I use to allow me to sleep is not working any more.  I see that doctor today, by chance.

So other than a simple post of this is the last day for early voting, I am done for the day.  I cannot wait for July 3rd when I see the surgeon again.

THE UNINFORMED VOTER DUARDO ALLOWED TO POST WITHOUT CHALLENGE AS TO THE MISTAKES AND MYTHS -

hOW MANY MISTAKES ARE IN THIS POST?  TO BE FAIR THIS IS THE PROBLEM WITH OUR SYSTEM.  I WOULD SUBMIT THE MAJORITY OF VOTERS IN PART VOTE BASED ON DISINFORMATION AND MYTHS

MARY S. CONTRERAS-REY

Good morning, Mr. Editor:
I supported Trey two terms!! However, after careful consideration, I came to the conclusion that I could not longer support a person who wears too many hats ie. full-time attorney, full-time pizzeria owner, full-time Texas Southmost College Board Member, and if elected, full-time mayor? How would he do it? That’s not all…the fact that he said he “would fire her all over again” referring to the firing of TSC President Dr. Lily Tercero was flabbergasting to me, imho this was stupid, and an eye opener for many people. Obviously he didn’t do it alone, but he was the deciding vote and he chose to follow a wrong order. Following wrong orders has consequences!! The consequences in this case are 13.1 million dollars which our small college/all of us taxpayers, have to pay.
Thank you for allowing my humble opinion.
Respectfully,
Mary S. Contreras-Rey
At the heart of Mary's theme is a full time mayor.  Charlie Cabler making this claim is like a high school student claiming to be a full time brain surgeon.  Brownsville by law is run by a city manager who cannot be by law micromanaged by the mayor or anyone else.
The role of the mayor just like all the city commissioners is oversight of the city management and voting on policies and contracts.  So the position Charlie Cabler is running for does not exist.
Contrary to Mary's claim, Trey Mendez will no longer be on the TSC Board.  Further her deception on being a full owner of his pizza company means nothing.  Through my 401k I own a lot of shares in several corporations.  It means nothing.  Dodici is basically on the day to day full time part is run by the two other partners and not Trey.
Trey on the other hand has lead in many regards developing downtown without being mayor.  His work on the issue will continue which is what a mayor should do.
In part Mary reminds me of the toothless guy on Mississippi failing to understand universal health care is good for him.  Because of Trey and so many others the property value of her home is going up.  She is in the heart of redevelopment on St. Charles.  Her age locks in her taxes.
MARY IS FLABBERGASTED OVER TREY REFUSING TO ADMIT FIRING TERCERO WAS A MISTAKE EVEN THOUGH SHE ADMITTED SHE USED THE SIGNATURE STAMPS OF FORMER TRUSTEES TO SIGN A MILLION DOLLAR CONTRACT
Translation of the above is, Mary will have no problem with the City Manager illegally signing contracts for the city.  She simply has failed to think it out.
Facts matter and TSC has proven to the court it never had jurisdiction over the breach of contract case.  The verdict is going to collapse.  The jury bought into a conspiracy to fire Tercero while ignoring her admission she used the signature stamps of former trustees.  Independent of the fact not even Tercero's lawyers are arguing the federal court has jurisdiction in a breach of contract case, or  the fact Tercero did not illegally use the signature stamps of  two former trustees to approve a million dollar contract what makes her think Trey was wrong for firing Tercero.
WHAT MARY NEEDS TO ANSWER IS
Does she actually believe Tercero did not deserve to be fired?  Why does she state Trey will be a full time TSC trustee while being mayor when the law prohibits same?  If you believe Mary Trey has at least 4 full time jobs.
Why does she pretend Brownsville is not run by a city manager and that Cabler will be running the city when by law he cannot.
I cannot remember the last time I even say Trey at Dodici's.
SO WHY DID DUARDO ALLOW ALL OF THIS DISINFORMATION TO GO UNCHALLENGED?
He had no interest in fact.  He just wanted to stir trouble and no competent blogger or journalist would have allowed Mary's comment to go unchallenged.
DID MARY ACT IN BAD FAITH?
No, she is just an uninformed voter who should have been guided with challenging questions. But alas she was not, she was used as a tool.
