GMS LAWSUIT MOVED TO MAY 30, 2019 AT 8:30

This lawsuit is not about GMS making the city pay a lot of money.  When you read the lawsuit certain players were left out - essential players.  This is about the court finding certain commissioners by-passed the rules.  Once that is done, there is no going back.

MONTOYA FOR PAY FROM HERNANDEZ CONTINUES HIS OBFUSCATION OF THE CLAIMS IN THE LAWSUIT

You will note when the BV challenged his first false post he deleted it.

The BV from day one said no TRO for a contract case.  So Montoya's entire claim related to the contract  in this issue and the facts Mike  Hernandez is having his cabal of puppets feed him is all a distraction.

GMS HAS SOUGHT A TRO FOR MORE THAN JESSICA NOT FILING A CONFLICT OF INTEREST AFFIDAVIT - WHY DOES MONTOYA JUST LEAVE OUT THOSE FACTS WHILE CLAIMING THE TRO IS IN TROUBLE?  THE CHECK CLEARED

 The BV has always said primary sources are the best.  So what does the lawsuit say about the TRO, which Montoya and Hernandez just ask you to ignore.

To see the actual lawsuit, versus what Mike Hernandez is paying for you to know, click here/ Then Scroll down to bottom right and click on download and the entire lawsuit will open in PDF.

On page 30, the you will see the truth.  Whether or not Jessica entered a proper conflict of interest affidavit is only one of many violations of the code which forms the basis of the TRO.

"d) that the Court enter declarations that:

(i) Brownsville violated Chapter 252 of the Texas Local Government Code by failing to execute the 2016 negotiated contract with GMS;

(ii) Commissioner Tetreau violated Chapter 171 of the Texas Local Government Code;

(iii) Brownsville and the City Commissioners violated Chapter 551 of the Texas Government Code in rejecting GMS’ contract based on discussions that violated the Open Meetings Act;

(iv) Brownsville and the City Commissioners violated Chapter 551 of the Texas Government Code in awarding the commercial and industrial trash collection contract to Republic Services based on discussions and conduct that violated the Open Meetings Act; and

(v) the decisions by Brownsville and the City Commissioners to reject GMS’ contract and to award Republic Services the commercial and industrial trash collection contract are void.'

All Montoya did was yell out was Mike Hernandez is nervous.  No one is going to fall for his post.

Guys you can believe the actual lawsuit, or what Mike Hernandez is paying Montoya to have you believe.

Why did Montoya leave out Chapter 551 violations which form a basis for the TRO?

The tape speaks for itself.  Nothing prevented De Leon from cutting a deal for Republic before he left the commission.  The fact Jessica signed an affidavit of conflict of interest means nothing.  Hernandez's puppets were still able to play.

It is quid pro quo.  The tape speaks for itself.  What did De Leon mean when he said he handled GMS?  Did he poison the well?  Did he release documents?

I am 100% certain Baker and Botts will be asking Jessica what she tried to stop the release of the audit?  This will put Charlie Cabler right in the middle of the mess.

I cannot wait for this hearing, assuming I can get out the door.  It will be a week after the next opening of the drainage valve more to increase the drainage of more cerebral fluid.

So, what you are saying is Montoya reported correctly, he just didn't tell the whole story.
I know you hate women as a whole, but when did you start hating Jessica so much. I think it was when you wanted her to intercede in an active police matter for some friend of yours and she did not. As I recollect, you claimed that as your representative, she should have acted on your request. However, she was not foolish enough to do it. Any elected official that interceded in such a matter would never get my vote. What would have been proper would have been to let whatever was happening play out and then make inquiries and ensure that good decisions had been made and if they had not, then make sure it gets corrected. Otherwise it is interference and micro-managing and that is not her role.

You really hate facts. Montoya's story is false to the extent it makes it appears the TRO is on the contract.

He intentionally leaves out the stated reason for the TRO.

On the police matter, Jessica offered to help, and then later texted me she could not find the number to call. She was all too willing to help. She should have simply told me to call the officer on duty.

Oh, please and Jessica not interfering with the police - who do you think you are fooling?
