CESAR DE LEON'S OBJECTION TO JUDGE PATE BACKFIRES

UPDATE:  See below for why I cannot leave the house.  But I just looked at the online docket sheet and yesterday Jessica was assessed $2.00 for a filing.  I e-file all over the state and only Cameron County assesses a fee to file documents which carry no fee.  There is nothing on the docket sheet to show Jessica has appeared.  It does say Cesar has appeared individually, but there is no assessment fee for the Objection to Judge Pate under his name - so maybe the millionaire Jessica filed a pro se objection to Judge Pate- without getting out of the house I have no way of knowing for sure and right now all I want is to go to the ER.

The rule - (g) In this section, “party” includes multiple parties aligned in a case as determined by the presiding judge."

This can be interpreted to mean Jessica and Cesar as sued city commissioner who were represented by Navarro on the 15th, and specifically as to Motion to Quash their deposition which included in their individual capacity, qualified as an appearance thereby waiving any right to object after the hearing.

I would not begrudge them a mandamus on this issue, but I know the Texas Supreme Court, they are doing everything possible to destroy 74.053 of the Texas Government Code, so the city will not have a friendly ear, especially with Baker and Botts arguing on the other side.

The city just increased big time how much in attorneys' fees they will be paying GMS.


SO WHY DID I TELL CESAR AND JESSICA IN MY POSTS ABOUT THE OBJECTION ISSUE? - SIMPLE TO PLAY THEM INTO DISASTER



Knowing how much I dislike them, why would they consider any legal advice I give them? I know the rules and everyone knows I know the rules on this issue.  So they believed me.  I knew there would be one of two outcomes to an objection, an accusation of intentional delay, especially in this case since Cesar waited until after the city did not get what they wanted, or two once there was a hearing the objection would be waived.  Either way Cesar and Jessica come across as to be hiding something.

Now to be fair I would not begrudge Cesar a mandamus.  He can argue Navarro never had permission to speak for him as to his individual capacity.  That will really turn the city's defense upside down.  I do believe to the extent only one joined party can file an objection, the rule is over broad and it is possible the Texas Supreme Court will agree because the joined parties do have conflicts of interest..  But there was a hearing on a motion to quash Cesar's and Jessica's deposition - so there you are.

THERE ARE NO CLEAN HANDS ON THE CITY COMMISSION EXCEPT DR. ROSE GOWEN

No one goes to Dr. Gowen and asks "if you do this for me I will do this for you."  Her agenda is the only real clean agenda among the Commissioners.  She wants to make the city healthier and more people friendly.  Good luck having Michael Rodriguez attack her for that in 2 years.

The sad part in all of this is Republic may have been the best choice for the people - but this is our city commission where nothing is done by the book.

A SIDE NOTE
A source close to Jessica and Art has now told me twice Art objected to Jessica running for reelection and now he is livid.  This could get very interesting.  In the end guys, Baker and Botts could be all wrong and Jessica and Cesar can be played as the victims.  Until judge Pate rules we will not know.

WAITING ON DOCTOR

I went to sit at my desk chair and lost my perception.  I missed the chair it rolled back I hit my tail bone hard and my head on a wooden table.  In fact I turned over a smaller wooden table holding documents and a fold out table holding documents I am sorting for a federal lawsuit.

Good and bad about an hour earlier I had no choice but to take two painkillers, so I am not real sure of my true level of pain.  My head is killing me and my tail bone is at a pain level of 20 on a scale of 1-10.  I have too much to do to be in bed.

Well doctor just text to go to ER.  I have no ride.  I will wait an hour to see if the pain subsides.  Sometimes it is just pain.  No reason to over react.
