NEW YEAR NEW BEGINNINGS 

The picture is 1964, about a year or less after daddy died.  It is the first known picture of the entire family with mom after daddy passed.

The picture reflects our family's new beginnings.  Our journey began here.  This journey defined us.  The bigotry which is faced by a Hispanic widow with 7 kids hit us hard.

The lessons of mom having to work in order to get public assistance.  The requirement she go to the university to become a social worker informed us there is no excuse for not moving forward.  It made us all more determined.

Public assistance was hard on mom because she was raised with a silver spoon in her mouth, was well educated, and was able to carry the family for several years on the life insurance.

But reality set in.  With pride she went to work and the university. The older ones had a duty to care for the younger ones.

Pasternak in Dr. Zhivago used trains to transition from one period to another.  I use pictures.

We have come a long way since this picture was taken in 64'.

2019 is upon us, and now we face the passing of the oldest with the prospect of the passing of another.  [to be honest so far Sloan Kettering has been overly alarming for no reason ].  We are transitioning into the period of retirement and passing.  Our parents never reached the age of retirement.  So we are on a journey we never saw through the eyes of our parents.

2019 will be exciting as more of us enter retirement.  Funny how the only one who is officially retired is the youngest.  Air traffic controllers must take retirement at age 55, with the option of one more year.

In November I apply for social security, for a March 2020 start date.  Given the fact our parents died in their later 50's and the eldest died at 70, I decided to take social security early.

I TURNED A CORNER AND BROKE A RULE

My home is my sanctuary, and I am guarded about who gets in.  In part I am guarded because I have zero interior design taste.  A year and I cannot decide what to do about repainting the inside of the house.  I may have finally seen a lobby I like and will use their colors and design.  But I have zero interior design taste. 

Anyway this past year I have invited a host of elected officials and candidates into my home for a more relaxing one on one discussion.  They remain confidential.  I have  turned some people down because I know enough their interest is not a frank and honest discussion, but to just get into my home.

But my home remains open to most elected officials, or candidates.  My post early today on what the people want to hear from the candidates was 100% neutral.  It is beneficial to all candidates equally.

Every candidate is free to submit a safe haven post to the BV about their campaign.  As always a safe haven post means no comments.  Knowing this candidates are more willing to open up.  The only rule I have is, I do not want attack pieces against your opponent.  Just tell my readers what you have to offer, why it is important, and how you intend to accomplish your goals.

The Court cares very little about the individual case.  They look for issues which are broad and impact the entire country.

Eddie Lucio representing a plaintiff against the City of Brownsville won a large jury verdict for his client.  The federal court of appeals reversed.  The Writ has now been filed with the Supreme Court.

TARA'S PODCAST - A NEW FORUM FOR BROWNSVILLE - THE TREY MENDEZ INTERVIEW
[EDITOR'S NOTE]  I am using this as today's post.  I am stuck in San Antonio.  A specialized MRI of the brain was moved up from January.  I had a gut feeling and packed for a week.  It was suppose to be one night.  I went to lunch with a friend.  The call then came.  My brain neurosurgeon based on the initial read ordered me back to the hospital for 3 more in depth pictures.  I am glad I had not left San Antonio yet.  
Naturally the radiologist can tell me nothing more than my doctor had ordered the more advanced deep series after the initial read.  I am on hold until 11 a.m. to see if I will be called back today.  My doctor is out of town so it may be a return trip next week.  It may also be the initial read is bad.  The issue is hypothalamus and hydrocephalus with evidence of micoro-hemorrhaging, scar tissue, atrophy, rapid loss of vision, and excessive white matter for someone of my age.  I personally think he is just trying to meet the protocol to justify the shunting which will resolve most of the problems, but not the long term damage.
This is not about me. I post this to remind people, the LRGV does not have enough people for doctors to get the clinical experience to understand rare conditions.  I did a lot of research on the best hospitals in San Antonio, and their doctors with privileges.  Then you research the specialists for their experience.  This is how I found a competent spine neurosurgeon and now a competent brain neurosurgeon.  
Almost everyone I know with good insurance goes to MD Anderson for specialty care.  For anything complex it is very difficult to find a qualified specialist in the LRGV.  They exist, but then because the VA is a nightmare in terms of cooperation, they will not work with the VA.  
I do not lie, while I was able to force the VA once the rapid vision loss began to agree to this brain neurosurgeon, the actual doctors at the VA are running cover for one another to justify stopping all treatment for the hypothalamic dysfunction.  A new doctor just hired and a licensed doctor for less than a year came up with bizarre reasons for stopping the treatment.  I googled one reason and the only evidence to justify his claims was in a religious publication.  The NIH in May 2018, published finding refuting all of this doctor's claims.  This same new doctor when you meet him asks you your religion, and begins to preach about the importance of faith.  As a federal employee this is illegal. 

The VA is so bad, the nurse investigator assigned by the regional office in Arlington called me yesterday to tell me she is going on vacation and will not begin any investigation until the week after next.  The conversation began with her book of excuses and endless lies defending the doctors.  I will be calling the White House complaint line again today.  The medications are expensive and I am paying for them.

CHOOSE YOUR BATTLES - THERE IS ONLY SO MUCH MONEY - IT MAY BE BEST TO NOT CHALLENGE JESSICA

One reason we end up with so many bad commissioners is people think because a commission is constantly being taken down they can run and win. They quickly realize they need money and a machine. Neither materialized and they end up splitting the vote to the advantage of the incumbent.

The BV has made no secret of the fact we have two political machines vying for control of the COB.  We have the Mike Hernanez/Carlos Marin machine, versus the Abraham Galonsky/Martine machine.  I know people who will swear up and down one machine or the other is doing good things for Brownsville.  It is for you the voter to review the verifiable facts and decide.

But for those of you who want to stop the Hernandez/Marin machine you need to look at it strategically.  This biggest prize is the mayor's seat.  The establishment are going to back Tony Martinez, Hernandez/Marin are going to help raise as much money as they can for Charlie Cabler.  I believe lawyers and the downtown business establishment are going to donate heavily to Trey Mendez.

There is no official polling done in our elections.  This race is any one's guess as to who will be in the runoff.  It will come down to getting out their respective messages and the vote.  This one election is going to be expensive.  Guys there is only so much money on the table for the municipal elections.

Jessica Tetreau-Kalifa is a frustrating situation.  Based on her antics and incompetence she should be an easy commissioner to defeat.  But she will have money. Hernandez/Marin are going to make sure of that.  The blind female vote gives her the advantage.  A male candidate attacking her will alienate some female voters.  This race requires a highly qualified female who can raise money to effectively challenge Jessica.  If such a candidate does not appear, then it is best to let this election go.

It is better for the money to be used to oppose Rick Longoria and for an independent voice in the at large seat.

These two seats are an easy win against Hernandez/Marin.  But spending money in the Jessica race is a very big long shot and takes away money from these races and the mayor's race. A Cabler or Mendez win still denies Hernandez/Marin a majority.  It also denies Galonsky a majority.  In the end the people then have independent voices insuring their voice is heard.

There is only so much money.  Playing in all races .could end up leaving the people with no real voice


BYSTANDER CITIZEN - BEN NEECE V. RALPH TIPTON

Ben Neece and Ralph Tipton are engaged in an interesting discussion concerning corruption.  To remind you Ralph Tipton's wife was murdered and her killer went free after Saenz and company ran cover for her.  Yea, pretty strong language.  But I will love for them to sue me, because I will put forth the evidence to prove what I just wrote.  We will let a jury decide.

My problem with both is, they are issue centric bystander citizens.  Ben Neece's campaign against Jessica Tetreau-Kalifa [Mike Hernandez and Carlos Marin in drag] is valid.  She point blank lied to an incompetent Derick Garcia of KVEO. 

This discussion is playing out on KVEO FB account for Derick Garcia.

Everything Ben Neece is saying is factual and easily provable.  I can assure you KVEO will not run the truth.  Why?

Ralph Tipton then raises the question where was Ben on the other issues of public corruption?  Basically nowhere to be found.  His battle at city hall is valid and needs to be fought.  Mike Hernandez and Carlos Marin in drag need to be stopped.  But to be frank so too does Abraham Galonsky and on that one Ben Neece will never speak.  Ben's response to Ralph is simple. "I am fighting corruption at city hall."

But I have to ask,  how involved was Ralph Tipton in all of the corruption that has been ongoing since he came of age?

I am not big on people having a personal valid issue and then demanding everyone take notice when they were silent before that as to everyone else's victimization under the corruption.

ENGAGEMENT

The BV will cover the municipal election from the perspective of Abrahan Galonsky v. Mike Hernandez.  You will note the people are not even a variable.  Why?  They are not engaged.  How do I cover the voice of the people when they are not engaged in the process.

THE APOCALYPSE OF THE BY-STANDER CITIZEN

The sun tries to push through the  morning fog crawling over the bog. The fog and bog have become symbolic of truth.  Somewhere beneath the murky bog lies a bothersome truth.  The inception of the apocalypse was a small virus which we ignored as by-stander citizens. There was no active virus in our house.

An innocuous post gets as response "it is time for revolution."  You cannot revolt against a virus - a hidden virus a by-stander citizenry ignores because they believe it is not in their house.

On this morning of the by-stander apocalypse the sun will be defeated and the bothersome truth will lie undisturbed beneath the bog.  For the by-stander citizenry have no interest in the virus which eats away at their soul and very essence of being human.  They retreat into their world of  convenience to waste away unaware through their chosen ignorance the apocalypse has already seeped up through the murky bog, to be blocked by a fog the sun cannot chase away.

The bothersome truth becomes as by-stander citizens they welcomed the apocalypse, unaware they have already died to never fight the revolution or find the cure to the virus they would have endeavored to do had they simply opened their eyes.

IS SENIOR JUDGE BANALES SUBJECT TO OBJECTION AS A FORMER JUDGE? YES

The rule came as a surprise to Chief Justice Nathen Hecht in my brother's case.  I want to be clear about my view on the appointment of former judges as visiting judges.  I do not object to the option, because I know there are some who are better  than most of the judges we have in Cameron County.  But every former judge should be subject to objection upon assignment.  They are not accountable to the people, and go against the very essence of our democracy.  But again I want my readers to know some are a lot better than most of our elected judges.

The rules can get complex.  One reason is the con created by the Texas Supreme Court in conjunction with the legislature.  A judge voted out of office by the people can gain credits towards senior judge status by acting as a visiting judge.  This becomes a highly unethical way to give unelected judges the right to retirement after they work as a visiting judge long enough.  The rule spits in the face of the electorates' voice on election day.

The state lists Judge Bañales as a senior judge, thereby making most attorneys to believe he cannot be objected to as a visiting judge after the lawyer already objected to another senior judge.  Lawyers you need to learn how the visiting judge obtained their title before you  agree to let them sit in your case.  If you know they are a good judge, keep them.  Unethical conduct can and does lead to great jurists being thrown from office on election day.  This happens because the Commission for Judicial Conduct has no use for judicial ethics.  If they were to do their job, good judges would not lose in contested races because of unethical conduct by their opponent.

The wife of Filamon Vela ran a Willy Horton ad against then Justice Frederico Hinojosa.  The racist ad cost Justice Hinojosa the election.  She should have been sanctioned to include loss of her judicial credentials.  

THE RULE WHICH CONFUSES ATTORNEYS, AND THE CHIEF JUSTICE OF THE TEXAS SURREME COURT

§17.053 D OF THE GOVERNMENT CODE

"(d) An assigned judge or justice who was defeated in the last primary or general election for which the judge or justice was a candidate for the judicial office held by the judge or justice may not sit in a case if either party objects to the judge or justice."

Judge  Bañales lost in the last election in which he was a candidate. Click  Most attorneys believe subsection "b" protects former judges who lost their election, but as "d" clearly states it does not.  In my brother's case Chief Justice Hecht immediately reversed his assignment of a senior judge who lost in her last election, seemingly unaware of the Rule.

"(b) If a party to a civil case files a timely objection to the assignment, the judge shall not hear the case.  Except as provided by Subsection (d), each party to the case is only entitled to one objection under this section for that case."

NOW THE UNINFORMED WILL SAY AN ATTORNEY CAN INDEFINITELY DELAY A CASE THROUGH ENDLESS OBJECTIONS - WRONG

"(e) An active judge assigned under this chapter is not subject to an objection."  

By law, in election contests, a sitting judge cannot hear the case, so my solution does not work.  I actually have a mandamus against a then Dallas sitting judge for issuing an injunction from my client taking office.  One as a sitting Dallas County Judge he could not rule in the case.  Two the law clearly provides no injunction can issue in such a case.  I was nice to the judge and went to him after advising opposing counsel of my intent to ask him to void his order.  He threaten me with contempt.  I told him I was going upstairs with my mandamus in hand and he would removed.  I made it clear to him I was not impressed with his illegal threat of holding me in contempt for exercising my client's rights.  In the press he blamed everyone except himself.  Had he just allowed me to show him where in the lawsuit it said he may not rule in the case he never would have been subject to a mandamus.

My view is simple, the assignment of former judges should be limited to absolute necessity.  I can tell you Judge Euresti just removed himself from a case.  There was no evidence of even an impression of a possible problem.  He did it out of trying to just do the right thing.

Now while I believe the former judge assigned to the case is perfect for the case, under "e" Judge Euresti could have changed cases with another locally elected judge.  In the old days before this con costing the taxpayers a fortune this is how it was done.  In federal court you rarely see a former judge assigned after recusal.  The federal judge just swaps out the case with another judge.  No additional expense to the taxpayers.

 A locally elected judge could have politicized the case, [with no intent to do same] and that is not good for the image of the judiciary.  The reason Judge Euresti removed himself is not important.  And for the record he did it without any motion asking him to do so. But the case does need someone whose decision will not be questioned, and that is important.  He may dismiss the case or he may not, but we can be assured he will follow the law.  And yes, sometimes even the best judges get it wrong, but there is no ill intent.

But in this case especially before answer is when the elected judges should just ask another judge to swap cases so as to avoid the taxpayers picking up the tab for the visiting judge.

I write this piece because the voters need to know our elected judges instead of swapping cases when they self recuse, they are using a system which is needlessly costing the taxpayers a lot of money.  And no swapping cases do not inconvenience the parties.  You typically take a new case where no answer has been filed yet.

INEPT JOURNALIST DERICK GARCIA GETS PLAYED WITH JESSICA TETREAU'S LIES WHILE TAKING THEM ALL AS TRUE WITHOUT FIRST VERIFYING HER CLAIMS

This report is is a perfect example of pure junk journalism where reality and facts were kept from the people. Did you even listen to your own report Deric?. How can the city not know who paid for the audit while you are also reporting the city paid for the audit? Jessica lied to you about how it was paid for while implicating illegal conduct because she knew you would not challenge her lies. FACT: The mayor can authorize payments of $35K or lower without the knowledge or consent of the commission. Hence under the rules of the city the mayor authorizing the payment violated no rules. Questionable? yes but no irrregularities. Two ask your bosses and they will tell you the city does not have to answer any open records requests which the city believes is being made in anticipation of a lawsuit. Jessica knows this. If the city believes Sossi is going to sue under the LAW it has every right to reject the request. The editor should be fired for allowing for this hack piece.For the record the mayor approved the payment to embarass his opponent Charlie Cabler. And I will note, neither Cabler nor Sossi have denied any of the findings. Also why in your report do you not mention Jessica voted to quash the report? How about doing some digging and find out who she really reports to.


THE HERALD's MARK REAGAN IS NO BETTER

Yesterday he did a hack piece against Jessica with David Dale's claims against Jessica. It is a narrative with no proof. There was no independent investigation to get to the facts.

Why has the BV stayed away from the Jessica/Dale matter? Because there is an essential tape which either side can legally release and neither side wants you to hear the tape. It seems to me both sides are not confident the tape really helps their argument. I am not defending Jessica, but I want verification and until I get the tape there is no story.

WHERE IS THE LINE WHEN DEALING WITH EQUALITY

The question is can women who still have a menstrual cycle enter a Hindu Temple which offends the God of the Temple.  The Indian Supreme Court found the policy violated the equal rights of women.

But here is what an Indian Catholic had to say "As a member of India's Christian minority, Joseph believes the court should be especially careful to protect the rights of any religious group to worship as it sees fit.

"For example, in the Catholic Church, only men are allowed to be priests. Will the court say this is against equality? That is ridiculous!" he says."

SWING VOTE CHIEF JUSTICE JOHN ROBERTS VOTES WITH 4 LIBERALS TO BLOCK PRESIDENT TRUMP'S ASYLUM SEEKER RULES

The BV has been reporting for sometime that the Chief Justice would become the swing vote.  Yes there will be votes wherein he will vote with the 4 conservatives.  Hence swing vote.

Since publishing my Master's Thesis on the "Juridical Methodology of the Supreme Court" some 30 years ago I have become a student of the Court. 

An interesting side note:  A reporter spotted Justice Ginsburg on a plane from Washington to New York last night. She reported the Justice got on the plane and off the plane on her own, and ordered coffee while she was working.

But here is the deal, upon arriving in New York she checked into Sloan Kettering for a simple lung cancer surgery while still working and making sure her vote counted.  It was discovered when she fell and fractured her ribs.  It was scheduled for now while the Court slows for the holiday and she can recover. 

She is going nowhere guys.


PRESIDENT TRUMP SIGNED FARM BILL - HEMP IS NOW LEGAL AND WHY BROWNSVILLE NEEDS TO HELP CREATE A CAMERON COUNTY MPO WHICH UNITES WITH HIDALGO COUNTY MPO - THE FACTS 

Nothing irritates me than people pushing a real bad agenda by publishing outright lies. To oppose the idea of unifying the cities and counties to work as one so that the land and real estate speculators like Abraham Galonsky, Mike Hernandez, Carlos Marin, Eddie Treviño, and Gilbert Hinojosa can keep control and avoid the interests of the people, Jim Barton published this outright lie. I am not suggesting Barton supports any of these people, but when he takes as truth the false narratives they put out, he ends up doing their dirty business.

"McAllen and or/Hidalgo County are used interchangeably. McAllen, as the largest city in Hidalgo County holds the veto power over any decision. "

It is fact the Hidalgo County MPO as a united entity of the county, cities and other entities were able to secure the loop around the major cities, thereby relieving traffic for everyone.  It will also create commerce along the route of the loop.

McAllen is not the Hidalgo County MPO.  The idea McAllen is the center of everything is a complete myth.  The best hospital in the LRGV, Dr. Renaissance is in Edinburg, the only UT university system is based in Edinburg. Pharr is a thriving hightly developed city.  Finally the county seat is in Edinburg.

So who in fact is the Hidalgo County MPO - click for list of cities, the county and other public entities.  How does this verifiable fact give McAllen veto power over everyone else.  How given this fact is Hidalgo County MPO just another name for McAllen.

Brownsville is hopeless.  Fact checking and critical thinking is a crime in Brownsville.  We lost another four years when Cascos lost to Treviño.  We have no hope of any united MPO at this time.

Yesterday on the news the talking heads were asking themselves all day long, "did Trump really believe no one would notice Gen. Mattis resigned in a very strong letter critical of the president, versus the president's outright lie Mattis retired?"

Did Barton really think we are all so stupid no one would research the truth as to who the Hidalgo County MPO really is?  Yep.

BOTTOM LINE IS CAMERON COUNTY AND BROWNSVILLE WILL NOT BENEFIT FROM THE BILLION DOLLAR HEMP INDUSTRY ABOUT TO EXPLODE



THE MATTIS EFFECT - THE 25TH AMENDMENT

Secretary Mattis' letter of resignation was the closest thing I have ever read by an administration official without actually saying it, that Trump is not only a threat to US National Security, but also world security.

Sec. Mattis remains in office until February.  Trump is a fool after the letter to not fire him now.  But key Republican Senators are standing with Mattis in his claims.  Here in lies the danger. [Editor's note: verify.  It seems odd to me Trump did not outright fire Mattis yesterday.  So I held here until I just read a story just minutes old confirming for now Mattis will remain in his position until the end of February - key facts or claims must be verified.]


If you watch Vice President Pence, he is always stone faced when he is with Trump.  Senate Republicans are standing with Sec. Mattis that Trump's moves on Syria and Afghanistan are a threat to our and in fact the world's national security.  This is a game changer.

For the 25th Amendment to work it can take a total of 48-72 hours to remove the president for good.  This is because the President can deny the first request.  It is the second request for his removal which would make it permanent.

I personally have mixed feelings about the 25th Amendment.  With this president at this time, I believe the nation would back his removal, and our key allies will be relieved.  The Trumpites could become very dangerous.

Simple incompetence is not a basis to invoke the 25th Amendment.  But if Sec. Mattis is correct in claiming Trump is a national security threat, then the 25th Amendment may be the solution.  If national security threat is the only claim made, the people will understand.  It certainly opens the door to Impeachment by the House come January.

THE SEC. MATTIS MISTAKE

If anyone can convince the cabinet and VP it is time it is Mattis.  This is why not firing him immediately was a big mistake by Trump.  But the other side of Mattis is, he is a retired general.  As such he may view use of the 25th Amendment as a coup, and as a retired military officer he would never consider same.

FORMER CAMERON COUNTY DISTRICT JUDGE ROBERTO GARZA ARRESTED ON DWI

The Monitor article is poorly written but it appears he was also arrested for evading arrest with motor vehicle, and unauthorized possession of weapon   Garza currently works as a visiting judge in Cameron, Hidalgo, and Starr counties.

As of press time the Monitor is reporting Garza remains in jail on a $25,000 bond.

The state legislature needs to address the issue of visiting judges.  It is a huge financial con on the people. There is no reason why sitting judges cannot change cases when one recuse themselves.  But this is a con run by the judiciary to insure retired judges or judges voted out of office continue to receive another paycheck at the expense of the taxpayer.  There is no real need for visiting judges other than to con the taxpayers. Visiting judges have zero accountability to the people.  Whereas elected judges are accountable to the people.
















DUMB AND DUMBER TONY MARTINEZ AND RICK LONGORIA LEAD BROWNSVILLE DOWN THE PATH OF ISOLATION - WHILE FAILING ECONOMICS 101

Tony Martinez comparing the three RGV Metropolitan Planning Organizations, Harlingen,  Hidalgo County, and Brownsville to how Brownsville got the scraps after UTB merged into UTRGV, tells me he is conning the people.  He is smart enough to understand it was comparing oranges to apples.

In the UTRGV development Brownsville had no say and in fact was not at the table with an ounce of authority - fact.

If Brownsville were to join a RGV MPO, it would have a voice at the table in creating the organization, which in turn provides Brownsville protections.

I would be the first to say vote no, if a fair deal cannot be cut with the other entities.  But the fact remains as a member we can impose conditions, an option we did not have in the development of UTRGV.

When Rick Longoria speaks he cannot help but prove he is a fool and is just acting as he is told.

It is very true the Hidalgo County MPO has gotten a lot more than Brownsville.  But why not?  The are a county wide MPO wherein the cities came together as a unit to fight as a unit for more funding.  All Rick did with his comment was prove uniting works.

Brownsville is hell bent at going it alone and being in a constant state of war with its neighbors.

Many moons ago Brownsville, had it had any leadership could have joined Harlingen to build a regional airport.  Brownsville decided to go it alone.  The consequence is Brownsville's airport is a shack going nowhere.  The BV has proven time and time again that at least since 2003. the COB has announced a new runway and new airport.  In the end - nothing.  

I personally will fly United for the last  time in March when I go to Nicaragua for two weeks for my birthday.  I am going on miles.  The ticket is free.

I joined Frontier Air's mileage program and got their credit card.  I charged $500, and got two free tickets.  In the summer I am going to Colorado to spend time with some family, free, and am holding the other free ticket for what is for sure to be another family funeral within a couple of months if not sooner.

This morning, I paid off the $580, I charged.  Why would I fly Brownsville when flying out of Harlingen so a lot cheaper.

Rick Longoria will never admit that all of the lies on the airport since 2003 are the result of a lack of leadership on the city commission.  

I agree with Rick that the failure of TXDot to help fund the loop is a concern.  But will someone tell me please how continuing to go it alone, which is why we are not getting the funding is going to help us get the funding?

I am not saying we should be part of a Regional MPO.  I am saying the excuses are pathetic.  Instead of showing at a meeting and looking like idiots, how about sitting down and try and find a solution which gets Brownsville its fair share.  Intelligent negotiations are not the forte of Rick Longoria or Tony Martinez.

Both must go come May.  This election is going to be tricky.  We need to make sure Mike Hernandez and Abraham Galonsky each have no more than two votes.  Their control of the city commission must end.

We are waiting Cabler for an explanation refuting the claims of you turning a blind eye to alleged wrongdoing by Carlos Elizondo, for not acting to have Abraham Galonsky removed from executive session during the negotiations on the Casa Del Nylon, and who did the work on your Mustang and how was it paid for.

What is most remarkable is Charlie Atkinson attacks Martinez for the Casa Del Nylon debacle, while giving Charlie Cabler a pass for not doing is job and ordering Galonsky out of executive session during the negotiations.

THE LICENSING OF HEMP IS NOW IN GOVERNOR ABBOTT'S AND AG PAXTON'S HANDS

Technically the signing ceremony for the Farm Bill is not until this coming week. It then moves to the states.  There are only two restrictions in the Bill.  One, the hemp cannot contain more than 0.3 % THC.  No big deal there.  Part two is up to the governor and AG.

"Second, there will be significant, shared state-federal regulatory power over hemp cultivation and production. Under section 10113 of the Farm Bill, state departments of agriculture must consult with the state’s governor and chief law enforcement officer to devise a plan that must be submitted to the Secretary of USDA. A state’s plan to license and regulate hemp can only commence once the Secretary of USDA approves that state’s plan."

If Abbott and Paxton refuse to act, which will anger the farmers, then the farmers can apply for a license directly with the federal government.

This is not the time to sit back and wait.  Governor Abbott and AG Paxton need to start work on the regulations now so that they can go on to be approved by the Secretary of the USDA.  Some states are ready to submit their regulations to the USDA.  Texas has done nothing.

While the licensing process is moving forward we need to create a local government sponsored or a business sponsored Hemp Coalition or Collective.

We are sitting on a multi billion dollar economic boom and our locally elected politicos have no interest in it.

For the record a retired couple at Walmart a few minutes ago offered to take me  tonight, their treat, for my work.  I said no - you are retirees and should go and have an extra glass of wine.  I hope they go.

A LITTLE SIDE NOTE ON HOW REALITY WORKS

My late brother in law was good friends of Juliet Garcia and Tony Martinez, and in fact had done work for Trey and some of his partners.  He was known as a master mason.  He did a lot of restoration work for the city and UTB.  He died at 94, still working until about two months before.  

His friendship with Juliet and Tony got them no favors from me and he respected our differences of opinion.  As asked I welcomed them to his funeral and introduced them to his kids - although Tony Martinez was very rude about the entire thing.  They both gave eulogies and left.  I showed them complete respect.  

People can agree to disagree and remain respectful if one wants to.  But people who know me know money will never garner you favor, and just because you like someone does not mean I have to give them as pass especially as public figures.  It is called respecting one another.

MONTOYA IMPLICATES THE BV IN A FALSE STORY AND THE BV WILL  NOT HAVE IT

I do appreciate Montoya making the correction of throw from through.  It happens.  I do have real problems with my brain and vision.  The VA is setting up an emergency specialized brain MRI in San San Antonio which is not  done in the LRGV.  It was ordered by the brain neurosurgeon upon reviewing 4 MRI reads, and the eye doctor report verifying I am losing my vision fast.

The below pic by Montoya is an out right lie.  Trey Mendez is distancing himself from it.  I have no idea who gave it to Montoya, but we all know Adela Garza pays Montoya to run cover for her.


I want to make clear I have nothing to do with the above deception.  Also I am not a regular contributor to Montoya on legal matters.  I have answered questions for him on occasion and in fact I believe I sent him a document once to enhance a story he posted.  That is it.

What this post does is prove the Imp [Duardo] just lies because in his world of journalism the truth does not work.  He created a fake google account to imply through a post I take free food from Trey Mendez.  Then Duardo posts I am not speaking to the issue.  False, days early I offered to post my MC bill showing the $38.00 I paid Dodici's last weekend.  He lies because that is what failed journalists like Duardo, Montoya and McHale do.  For the record McHale lies when he says he inspired me to blog.  First, I was blogging through a self written web page known as Balancing the Issues with over 10,000 readers nationally before blogs even existed.  I dropped it when I moved here and chose to use the new google platform.  Many politicos were familiar with my many letters t o the Editor and sought me out to encourage I counter McHale's  lies.   I chose to focus on Brownsville because it was clear to me McHale was a pathological liar and Brownsville needed someone to call him out.

THE TRUTH ABOUT THE TERCERO VERDICT, WHICH DOES NOT HELP TREY MENDEZ, WHICH PROVES I PRINT THE GOOD, THE BAD, AND  THE UGLY

You see Montoya cropped off the key words.  It made no sense to me because if it were true the judge would have declared a mistrial at the moment he read the verdict.  So I went to PACER, and found the truth, without deceptive cropping.



I do  stand by legal analysis.  The trial judge will either grant a new trial, or the court of appeals will reverse.  The uncontroverted evidence shows just cause for discharging Lily Tercero.  That is all the Court of Appeals will look at.  They will not even consider any mal-intent machinations by any Trustees.


IS THIS CITY COMMISSION READY FOR 2019? NO

This city commission has decided it is better to be at war and litigation with adjoining cities than working regionally for the betterment of all. No city has the individual resources to do what needs to get done, but combined along with the county miracles can happen.

We are not even discussing how to make millions on Hemp.  The county and cities are not even planning for what is coming next week and how to make money on it.  There is zero cooperation.

SUNRISE MALL

The COB is in the dark.  Sears is in bankruptcy with its stock 52 week low being 12 cents.  JCP third quarter report was dismissal.  It stock has a 52 week low of a $1.04.  Both have recovered slightly.  The second JCP  drops under a dollar, the bankruptcy attorneys are called.  A major retailer cannot recover from penny stock status.

By the second week of January we will know the reality of both stores.  Sears is already begging  the bankruptcy court for more leeway over the objections of the creditors.

JCP is inventory heavy.

If both stores, but more imparticular Sears fails in its holiday numbers, it is over with.

What plan does the city have in place if it loses Sears and possibly JCP at Sunrise Mall?  Harlingen already lost Sears.  McAllen lost one of its two JC Pennys.

The COB is just ignoring the problem.

The current city commission is a feckless train with toxic cargo waiting to derail.

Every sitting commissioner and mayor on the May ballot has to go.

I will also note when asked on camera to defend his decision to fire Lily Tercero he defended his position with the why and firmly stated he would do it again.

Trey Mendez Not sure where my friend Charlie asked me this, but will answer off the top of my head: (1) Lowered tuition by 37 % in our first semester of being operationally independent from UT (2013), and HAVE NOT raised tuitions since (2) We currently have ALL TIME HIGH enrollment for TSC (7,000+) (3) We have not burdened taxpayers with increased taxes since I've been on the board (4) substantial increase in Texas Workforce dollars (in the millions) for equipment and workforce initiatives. (5) We have given our faculty and staff raises almost every year since 2013 without impacting a balanced budget. (6) increased fund balance to almost a years worth of operations. These are just a few. Thanks

Can someone name any other politico so willing to answer challenging questions so openly?

Cabler under safe haven, meaning no comments, is free to list his accomplishments on the BV at any time.  The BV is giving equal access to everyone - safe haven included.

I want Cabler to answer one question. when Galonsky was in executive session negotiating the price for the Casa del Nylon, why did you not stop it.  When the City of Dallas did this with Mark Cuban over the new arena the federal judge voided the vote.

We want to know Mr. Cabler as the city manager why did you allow this violation of the law to happen?
