TEXAS SUPREME COURT CONTINUES TO REVIEW PETITION FOR REVIEW AND MOTION FOR SANCTIONS

When the orders came out at 9 a.m. I was shocked my Petition for Review and Motion for Sanctions were not denied.  There were cases by corporations which pay upwards of a $1000 an hour to their attorneys who filed their Petition for Review after mine, and had them denied today.

Mine is a key case which impacts the entire state and not just two parties.  This is a major consideration by the Court when it decides to take a case.  Mine has multiple conflicting opinions on the key question of law.  It is so bad the Fort Worth Justice who dismissed mine for lack of jurisdiction in an identical case found jurisdiction.  

WHAT IS NEXT? 

Mike Hernandez through his attorneys unable to defend the conflicting opinions chose to tell the Texas Supreme Court they did not intend to file a brief defending the Court of Appeals decision. It is called a waiver of no intent to file a Response.

So now, if the Court decides the case has merit, they must first order Mike Hernandez's attorney to file a response.  At that time I get to file a Reply.  Mike will only dig his hole deeper for the federal lawsuit in his response.

Maybe next Friday they will deny my Petition.  It went to the Court on the 1st for review. So they reviewed it with other cases which were denied today.

Mike is so stupid.  If I get a hearing on the Sanctions he will not be able to stop McHale or Jose Angel Gutierrez from producing their settlement agreements under a subpoena.  In the Bill O'Reilly case the federal courts have found these agreements to be unenforceable.  McHale will be allowed to go on the attack, and Jose Angel will be allowed to disclose more dirty secrets.
