WAS CARLOS ELIZONDO'S PETITION FOR EXPUNGEMENT GRANTED? 

 In the online data system his Petition has been removed. This is done after an order of expungement is granted, but when you do a criminal search the criminal case remains listed along with the online docket sheet. It may be they have yet to remove the criminal case from the online system. But here is the deal, an order of expungement not apply to private citizens, or the press.  So we are free to publish over and over again his indictment, so long as we note the case was dismissed after payment of restitution.

DPS has the right to seeking overturning the order.  All documents will be forwarded to the correct person for review.  Like I said in my original story the law seemed a bit vague on the issue, so maybe he was entitled to the expungement, but that decision belongs to DPS.

no expungement will remove his guilt when he wakes up every morning to face the mirror!
