TEXAS CRIME VICTIMS COMPENSATION PROGRAM - A NIGHTMARE WHICH NEEDS FEDERAL COURT INTERVENTION

This morning I learned one of our many corrupt judges has authorized Texas Medicaid to stop paying for speech, occupational, and physical therapy for children on medicaid.  Every candidate for BISD should be making this a central issue their campaign.  They will not because they do not care enough to get educated.  I re-emphasis - vote a blank ballot.

In the case of the DWI victim wherein Chief Rodriguez or DA Saenz have refused to arrest Gabriela Salazar for Intoxication Assault, the victim has been provided no rights.

The Texas Crime Victims program between their own incompetence and the incompetence of DA Saenz, BPD Chief Rodriguez, is nearly worthless.  The case I am working on I managed to get the application approved in 3 days for 100% coverage, but then I learned no one accepts the Crime Victims Compensation Insurance because of the incompetence of DA Saenz, BPD Chief Rodriguez and the Crime Victims program.  They have failed to educate medical providers about the program so no one accepts the insurance.

I spent several days working on the special wheel chair this young man will need.  There is no hope of him walking any time soon if ever.  You cannot touch his thighs or carry him for fear of damaging the pelvic area.  Because of Valley Baptist's neglect they are healing on their own.  By the time they got him to University Hospital it was too late to do the surgery so now they wait to allow the fractures to heal on their own.

No matter how hard I worked to get the local medical supply company to work with the Texas Crime Victims office it was hopeless.  The case  manager in Austin has yet to return any phone calls in a week.  Push came to shove and we could wait no longer for the Texas Crime Victims unit to put in writing they would pay for the wheel chair.  The young man has been sent home, but needed a wheel chair.  The doctor with University hospital was clear, he cannot be lifted without damaging the pelvic area.  It was a wheel chair or nothing.

WELL I PAID THE $500 FOR THE WHEEL CHAIR

I verified through medical records and interviewing the victim the brain damage has caused major loss of memory.  The doctors and I have verified he has no memory of the accident or who was driving.  He has no memory from many parts of his life.  VB did nothing to treat the brain injury.

THERE WILL BE NO SPEECH OR PHYSICAL THERAPY

The victim is to start speech and physical therapy this week.  It will not happen.  University Hospital swears up and down they sent the orders with verification of insurance to the rehab center in Brownsville.  The father and I visited several facilities while interviewing the therapist.  University hospital will no longer even accept our phone calls.  They refuse to give a name of the person they spoke with at the physical therapy center in Brownsville.  The center in Brownsville is adamant they have received no phone calls or documents from University hospital.  

HOW DA SAENZ AND POLICE CHIEF RODRIGUEZ HAVE FAILED THE VICTIMS

The patient had 4 prescriptions.  The Texas Crime Victims program is not on line like medicaid, medicare or any regular insurance company wherein the pharmacy can input the policy information and get verification of coverage.  Victims are expected to wait weeks to get approval for their medications.  This is medical malpractice on the part of Texas AG Ken Paxton's office.  The medical equipment company such as with any other insurance should have been able to access the Crime Victims Program on line while entering the approved claim number and then receiving verification of coverage.  Nope you have to wait weeks for anyone to return your phone call and you go without the wheel chair or your medications.  The father had to charge the 4 medications.

The victim cannot wait weeks for the Crime Victims Program to return the phone call to the case manager.  Until the physical therapy facility gets assurance of payment they will not start the physical therapy.  In the month or longer it will take to process the request the young man will be a cripple.

DA SAENZ AND BPD CHIEF HAVE FAILED TO EDUCATE MEDICAL PROVIDERS ABOUT THE PROGRAM

I do not care with who you speak.  No one will accept the insurance because they have no experience with the Texas Crime Victims Program, or if they have experience they are unwilling to work with them again.

Instead of Saenz and Rodriguez running around promoting themselves they need to have meetings with pharmacies, medical supply providers and physical therapy facilities to educate them about the program so they know they will get paid.

So unless I or the family can raise the money for physical therapy, this young man will not get his physical therapy.  He will become a cripple.  

UNTIL THE FEDERAL COURTS INTERVENE TEXAS WILL NEVER PROPERLY IMPLEMENT THE TEXAS CRIME VICTIMS PROGRAM

It is so simple, all they have to do is create an online verification system like any other insurance company and the problem is fixed.  But this is Republican Texas, where technology is considered a homosexual communist conspiracy.

What are you saying? Children that need educational speech, occupational, and physical therapy in the Texas school districts will not get such services. Please explain your comment on services rendered to children with disabilities in the school districts. Furthermore, also provide your readers of available funds (federal, state, and local) that provide for the cost of providing such services in the school districts.

I have no idea about the different programs, but here is the article from back in June.

So sorry that you have no idea about how educational services for the disabled children are funded. The Texas Health and Human Services Commission may cut off funding for speech, physical and occupational therapy but the school districts are still required to provide educational speech, physical and occupational therapy for those disabled children with need for such services. The school district provide such services through federal, state and local educational funds in meeting the needs of the children with disabilities. Not sure of the decision of the court for cutting off the funding, but it seems that such decision may be due to double dipping for such services.

BISd makes claims with medicaid. but the school districts are still under a mandate to provide services. double dipping is not the problem. it is about the state shifting the burden of payment. In the months to come we shall see how it works out, many school districts have therapist on staff so it shouldn't be as problem. we shall see in time.

There as been a lot of fraud especially in South Texas for the services that are being reduced.
