COB AND MARK SOSSI TAKE HIT IN ROUND ONE OF REMOVAL OF DEFAMATION LAWSUIT TO FEDERAL COURT

Less than a year from now we will know who is running for reelection for the COB city commission.  How the commission handles Sossi and this lawsuit should be remembered when voting for any incumbent not demanding accountability from Sossi for dragging the city into his personal mess.

Federal Magistrate Judge Ronald Morgan issued an order to the COB that in light of the following court of appeals case law they have until May 12, 2016, to explain exactly how the federal courts have jurisdiction over this case.

"The Fifth Circuit has stated that “[w]hen an action is brought to federal court through the § 1441 mechanism, for both removal and original jurisdiction, the federal question must be presented by plaintiff's complaint as it stands at the time the petition for removal is filed and the case seeks entry into the federal system. It is insufficient that a federal question has 1 United States District Court Southern District of Texas ENTERED May 05, 2016 David J. Sossi rushed to have the case removed to federal court while keeping the matter off of the official agenda for the COB last Tuesday.  Trust me folks, this does not mean they did not discuss it secretly in executive session.

It takes 4 votes to call for an investigation of Sossi's actions - do not hold your breath on 4 city commissioners demanding an answer..
