ULTIMATE BETRAYAL - WEDNESDAY'S PLAY
 


 
HAS DESPERANZA ZENDEJAS SOLD OUT TO JOE ROD FOR TEXAS RETIREMENT?
 
 
UPDATE: In law it is known as pattern and practice.  It began with Dr. Carl Montoya ignoring the Board Directive to not buy insurance from a certain company.  Although the Board gave a clear directive that the Administration was not to buy the insurance, Dr. Carl Montoya working with Lucio Mendoza bought the insurance anyway.  THE FBI IS ALL OVER THIS LITTLE CON - And Cesar Lopez, Carlos Elizondo, and Chirinos are all targets for failing to bring to the Board;s attention the offer for stop gap insurance.  We now know for sure BISD is intentionally hiding this fact.  Rather then answer my open records request that no email exists showing Cesar Lopez asked for a Special Board Meeting to consider the stop gap insurance, BISD had me buy a disc with over a thousand pages of nothing, including ads they took out in the Herald.  That immediately went to the AG for an enforcement of my request [remains pending] and to the FBI agent looking at Cesar Lopez, Carlos Elizondo, Chirinos and others.
 
THE PATTERN CONTINUES
 
The Board gave an express directive that the Administration [meaning Desperanza Zendejas] was to compile a list of Superintendent search firms for the Board to consider in search of the new superintendent.  Dr. Desperanza Zendejas ignored that directive by the Board.  Why?  How did she know this would be acceptable?  Joe Rod assured her she would be protected if she ignored the Board's wishes.
 
You see once certain hopelessly corrupt Board members realized they could go behind the scenes and direct Dr. Carl Montoya and Desperanza Zendejas to ignore Board directives because Joe Rod would protect them, they decided to make it a pattern and practice. 
 
This is so obvious, I am certain the numerous FBI agents now assigned to the BISD corruption are in disbelief.  They know nothing about disbelief. Wait until Thursday night when the entire Board goes along with Desperanza Zendejas' insubordination of ignoring the Board directive.
 
The Board's Directive which Desperanza Zendejas ignored along with Thursday's vote I going to the Texas Auditors office.  They will know if she needs more time to qualify for Texas retirement.

This was brought to my attention today and then I confirmed.  Item 13 agenda [click above] provides for Zendejas 'contract to be extended.  If you remember there was going to be a citizen's committee to recommend 2 or 3 potential candidates for new superintendent.  I have spoken with people who were asked to be on the citizens committee.  To a person after they were asked to be on the committee they heard nothing further from the Board.
 
The Board directed the administration, which means Zendejas, to find superintendent search firms to recommend to the Board for consideration.  Zendejas did not do as the administration was directed to do by the Board.  In any normal world this would be a basis for her immediate discharge.  If she had a half of brain she would inform the Board she is leaving at the end of her current contract.
 
There is no new superintendent search firm.  There is no search.
 
On part of the allegation I am going to go soft because I need to confirm it.  But two BISD sources have told me Joe Rodriguez  offered Zendejas up to 2 years so that she can become vested in the Texas Retirement System.  If this is true it is fraud subject to criminal investigation by the Texas Auditor's office.  There is no question the goal on Thursday is to effectively make her the new superintendent.  The question is, does she need this extra year and a half or so to become vested.  Even if the source is incorrect on the vested issue, she is still getting the job without a national search.  There has been more than adequate time to hire a search firm. 
 
This is key because in exchange for the fraudulent retirement from Texas she has agreed to ignore the Board's directive to find a search firm, and has carried out Joe Rodriguez's corrupt agenda.  This could land her in jail.  Yes jail - just because the Board can hire anyone they want does not mean they can do it as part of a fraud on the taxpayers.
 
The bottom line is - the entire citizen's committee review for a new superintendent was a lie.  The request for a firm to do a national search for a new superintendent was a lie.
 
Desperanza Zendejas was brought on as Joe Rodriguez's Girl Friday.  She knew what she was doing from square one.
 
The only question left is, how many of these stupid Board Members will go along with this on Thursday?
 
They need to allow her contract to expire, bring in a new interim superintendent and keep their promise of a citizen committee and a national search firm.  We will remember the lie and betrayal in 2016.
 
They will not.
 
This Board is so tied together in corruption at this point - no one is going to cross Joe Rodriguez.  Cesar Lopez is in a free all panic.  He knows he never sent that email to Otis Powers asking for a special board meeting for the stop gap insurance and the entire thing was one big lie he told Minerva Peña and others.  Good old Carlos Elizondo - you are delusional if you think Joe Rodriguez can raise the kind of money he has promised you for that special election you are set on running in.  Do you really believe the power brokers in Austin are going to even allow you out of the gate?  Beyond stupid.
 
Minerva Peña refuses to believe she is damaged goods and Joe Rodriguez is already looking for a candidate to run against her.  She is in for a shocker. And poor Jose Chirinos - he is so lost in the mess he does not know if he is coming or going. 


PRESAS-GARCIA

If she is really the one Board Member looking out for the voters and students then on the record she will ask Desperanza Zendejas why she has not carried out the Board directive to bring them a list of search firms for a new superintendent.  You will be able to hear a pin drop as Joe Rodriguez's heart stops.

Nothing said in Executive Session is privileged.  If Joe Rodriguez tries to shut down the conversation in Executive Session Presas-Garcia is free to continue it during the public meeting.  The law is clear on this point.  So the question is, will Presas-Garcia force the truth out, or remain silent and become part of the Joe Rodriguez problem.

If she does the right thing and uses this moment to bring down Joe Rodriguez she will have the support of the people.

This board of trustees is taking the school district downhill.
Some of us who did not sympathize in the past Presas- Garcia now agree she's the only one looking out in the best interest.
Having Luci Longoria gone is probably the best thing to happen to Presas- Garcia.
We are now able to see what she’s all about.
Let’s hope it doesn’t get any worse

Presas-garcia has one chance to show she actually cares - if she fails to ask Zendejas during the open session why she failed to bring to the Board a list of firms to do a superintendent search as directed by the board, she will be done with. She will not be allowed to claim to be looking out for the people.

The Board issued the directive - Zendejas in a very self serving way ignored that Directive because she knew Joe Rodriguez would make her the new superintendent.

This was a fraud from square one - either Presas-Garcia calls her out on camera or goes down with the Rodriguez ship

Ah how desperate you are. I have been going after Rodriguez since before the election. I went after Powers - you have not heard a positive word on the BV for Powers since he tried to settle Healthsmart for chump change before the election and aligned with Presas-Garcia.

I personally met Sylvia Atkinson one in my life - and that was apparently her last day at Los Fresnos.

So according to you that letter to the editor by Judy Rodriguez calling on the Board to call off the non-existent search and to just hire Zendejas is 100% coincidental with Zendejas being on the agenda for a contract extension.

Explain to my readers why Zendejas has filed to bring to the Board as directed a list of search firms?

Yea you cannot - so you go with distractions.

Where is the list of the Search Firms? Does not exist. Why did Zendejas ignore the Directive of the Board?

You cannot answer that one either.

These people are stupid - the Judy Rodriguez letter only gave further force to this post. The letter was a stupid preemptive move on their part.

I don't get it. I have a friend who worked for the state but left before earning full retirement benefits. Some years later he returned to state employment specifically to enable full state retirement benefits. Is this, in your mind, fraud? Z comes back to Texas, works here long enough to get benefits and retires. So what if she did it for the benefits. A job hunter would be a fool not to consider benefits. I don't see where the alleged fraud is. Is it that the Board never intended her hiring to be temporary and just "backdoored" her into the position? Is that what you are saying? Is that even fraud if they went through the appropriate motions? Is there not enough underhanded dealing going on that you have to make some up? What am I missing?

The retirement by itself is not the issue. And for the record I am still trying to verify that which is why I said I was going light on it.

The issue is the Board according to the Open Meetings Act gave her a directive to compile a list of companies which would help in the search of the new superintendent.

She ignored the Directive - there was no subsequent open meeting changing that directive.

Why did she ignore the directive?

Now by having ignored the directive she gains financially.

That is fraud.

She knew she could ignore the directive of the board. She chose to ignore the directive. Now she will gain financially.

She new the people were told there would be a process. That process never happened. She ignored the clear directive of the board, and now she benefits financially.

If you think that is honest - then nothing I say will change your mind.

She has to answer the question on the record, why did she ignore the Board Directive to compile a list of companies which could do the national search.

She had no authority to ignore the directive. It is insubordination. In the real world it is a basis for discharge and not a contract extension.

Oh, it will come out when she is deposed in the Atkinson suit.

Look the Board is going to do what it is going to do. No one will ask questions. It is a done deal.

We shall see what the State Auditors office finds as to why she ignored a clear directive from the board to her financial benefit.

You need to call the TEA and ask to speak with someone about filing a complaint. They will guide you to the forms.

Right now starting tomorrow for at least 6 weeks I have doctors appointments, multiple surgeries, and more doctors appointments and recovery periods. I am talking to no one about anything.

My plate is beyond full. The major surgery is a big unknown factor as to how long recovery will take.

The TEA is very good, they will guide you - they guided me. It is not very difficult.
