SUPREME COURT RULES IN FAVOR OF BANNING JUDGES FROM SOLICITING MONEY FOR JUDICIAL COMPAIGNS

I have been waiting on this opinion for a variety of reasons.  Click for Opinion.  In a very, very, narrow ruling Chief Justice Roberts writing for the majority held, the state has a compelling state interest in baring judges from soliciting money for their campaigns based on an appearance issue.  Justice must not only be just, it must have the appearance of justice.

The ruling could have far reaching implications in state judicial elections.  I would hope, someone in our legislature would introduce a new law, may be too late, which also bans Texas judges from soliciting donations for their campaign.

In some ways the opinion was unexpected because in the last major decision the Court made a big deal about saying if the states are going to make judges run for office then they are going to have to raise money.  But I guess now the money will have to be raised by PAC's. 

If nothing else read Justice Roberts first paragraph.  It is a good summary.  It is not all legalese.  It is an easy read for the average Joe.

But for those watching the marriage equality case Justice Roberts discussion about being locked into old ways as not serving justice is very interesting.
