DID CHIEF JUSTICE ROBERT'S OPINION IN OBAMACARE OPEN THE DOOR TO A LEGAL CHALLENGE TO COMPEL THE PEOPLE OF BROWNSVILLE TO USE BPUB?


"The Framers knew the difference between doing something and doing nothing. They gave Congress the power to regulate commerce, not to compel it. Ignoring that distinction would undermine the principle that the Federal Government is a government of limited and enumerated powers. The individual mandate thus cannot be sustained under Congress’s power to “regulate Commerce.”

"NOT TO  COMPEL IT" One of  the few things capitalism gets right is competition.  Monopoly power never serves the people.  I agree a PUB cannot exist without monopoly power. 

On the issue of the new plant I am on the fence.  People who think short term are not thinkers.  A natural gas electric generating plant is in the best interest of the community.  Texas has more natural gas than it knows what to do with.  This means Brownsville's utility rates will never be held hostage to an oil embargo or the high cost of regulations related to coal burning plants. So we pay a lot now to build the plant, but in the long run our rates will be a lot more stable.

But people can only afford to pay so much.  The proposed rate increases may be beyond what the people can pay, even if the project in the long run serves the community.

BUT HERE IS MY DEAL

The interpretation of the Commerce Clause changed significantly under the ObamaCare opinion.  Now to be upfront no lawyer in Cameron county would take on he BPUB in the name of the people so this is all kind of moot.  But the question is, under the ObamaCare opinion can BPUB compel us to buy our electricity through them?

I see it as an interesting question and nothing more.  I do no know the answer.

Yes the people of Brownsville will pay alot through their butts for this gas generating electric plant. And I assure you that the prices will not go down after it is built. The plant does not belong to PUB. It belongs to a shark who will sell the electricity to the highest bidder. Yes PUB will get some electricity from them a at a good price but I assure you the last highest price you will pay before the plant is built will remain. Just like when gas prices went up prices went up. Gas prices went down and all prices stayed the same or higher. PUB has a monopoly on most of Brownsville and they aren't going to care in lowering their price once they see the benefit of the savings they will have. Greed my friend is the underlying factor to all evil. First ask why are they forcing the people of Brownsville to help this industrial company develop this plant and do they have a deal where PUB will get it free. What is in the contract between this company and PUB? How and when did PUB become co-owners of this electric generating plant. The plant once done and will only need to hire 3 to 4 people to run their computers when sending out electricity. Nothing ever changes in Brownsville. The consumer always get f....

Mi amigo, if the teachers and kids at BISD are lacking supplies and materials, wait until they start paying their electric bill. No money will be left for anyone to try to bamboozle it from them because PUB just did and no one cared not even when PUB was brought before the board to explain why utility rates were going up so high. They were so involved in their own greed and fighting that PUB slipped away quietly and laughing at them. Now there won't be much money left to fight over. BISD is PUB's biggest customer. The wild west at its best.

One more thing, PUB can compel you at this time because there are only certain areas in Brownsville that can go with other utility companies. It depends where you reside in Brownsville . I wonder if the commissioners, members and Mayor have their homes in the areas where PUB has monopolized. Check it out Bobby WC.

One more thing Bobby Brown. Once the utility rates go sky rocket bussiness profits are out the window and the bussiness owners will either turn off the HVAC units and lights or decide to get the hell out of dodge. If I had a bussiness and this was happening I would move and relocate. By the way. I've posted many comments on your blog but it seems you don't approve them. I guess you don't like what I say. But at list you did pick up the warning on the PUB utility hike and you are looking at it.

What other certain areas of Brownsville have the option to choose an alternate utility company?

I know some of the retirement trailer parks have the of CPL and Magic Valley
