WHY RUBEN PENA PAYS EXTORTION MONEY TO MONTOYA? 

 
THE FBI HAS THE SCOOP ON MONTOYA 

TODAY IS THE PROOF RUBEN PENA IS PAYING MONTOYA  FOR SILENCE - PENA WILL SOON ENOUGH PAY ME FOR BEING PART OF MONTOYA'S JOINT ENTERPRISE- HE WILL THEN CLAIM TO HAVE BEEN A VICTIM OF EXTORTION

The FBI is fully aware of everything but refuse to act because Montoya through Saenz is helping them with their dirty work.  There is no entity more unethical and without a moral compass than the FBI.  In my earlier post I outlined the FBI and DOJ's lies that my claims against Villalobos and Limas were all fanciful and without merit. We all know they were not and that the FBI and DOJ lied to cover their own conduct.

They secured a judge to say each document I produced did not exist even though they were filed with the court.  Has the incompetence of the FBI reached the point they must turn  a blind eye to an extortion scheme by a convicted drunk to get their dirty work done? 

Constable Gomez who pays Montoya to remain silent has been put into the position of being interviewed by the FBI to verify Saenz is lying when he says Erin Garcia never reported the two crimes allegedly perpetrated by her employee.  Saenz has offered this former employee of Erin Garcia a deal if she just lies.  The bullying by Saenz of witnesses will come out in the Motion for New Trial in the Raul Salazar case.  The question which Gomez is hush hush about is, did he verify for the FBI he is a victim of Montoya's extortion scheme.  Cris Valadez has already verified the endless middle of the night calls for money.  Is this why he is paying for an ad for his mother in law? - to keep quiet all of his dirty little secrets.  Cris I have some of your dirty little secrets - time to tell wiffy my boy.

"This raised some salacious comments from a courthouse observer who remembered when Peña was trying to overturn the Precinct 2 commissioner's race after accusing Brownsville businessman Ernie Hernandez of paying politiqueras to harvest mail-in and walk-in votes to steal the election. "I Remember when Ruben was knocking on doors trying to serve the subpoenas on old ladies to go testify in court and now he is the one avoiding being served," they said. RUBEN PENA DELINQUENT ON PROPERTY TAXES

For the length of the campaign, Ruben Pena, Cameron County candidate for Precinct 2 commissioner has been promising he will take a $10,000 salary cut to help out taxpayers with their burden.
Now, evidence has surfaced that the Harlingen native has been too busy running for office to take care of his own tax obligations so that as a result he has become delinquent on 2009 taxes he owes to corresponding entities such as the cities of Harlingen and Brownsville, local school districts, Texas Southmost College, the Brownsville Navigation District, and even Cameron County.

"Why does (Pena) have to be elected before he lightens the burden of the other taxpayers by paying his delinquent taxes and pulling his share of the load?" they asked. "What he owes is more than $9,500, or nearly the $10,000 he wants to donate to the taxpayers."
The tax collector-assessors office lists eight accounts in Brownsville and one in Harlingen and the amount owed. The amounts include late charges as of Friday(March 12)"

WHAT’S THE REAL STORY ABOUT RUBEN PENA?

As the countdown in the runoff race between former Brownsville City Commissioner Ernie Hernandez and former Harlingen attorney Ruben Peña for Cameron County Commissioner heads for the April 13 showdown, followers of both men have started to dig up past peccadilloes trying to paint their opponent as the worse of two evils.

Hernandez (who advertises on this blog) ran an ad in last Sunday’s Brownsville Herald pointing out that Peña was delinquent on nine accounts with the Cameron County Tax Assessor-Collector. Hernandez said Peña owed nearly $10,000 and then smugly declared that he (Ernie) was a good citizen and current on his tax obligations.

There followed a lengthy legal battle between the heirs of McGarr and Peña and Pedraza where his nephews claimed that Peña and Pedraza had used the estate for their own benefit. Additionally, even Pedraza filed a lawsuit against Peña accusing him of “a variety of other misconduct.”
He claimed that he “was the victim of the more sophisticated machinations of a purportedly self-dealing Peña in the administration of the guardianship and the estate.”
In October 1996, the Duthus filed suit against Peña, Pedraza and the bank in federal court alleging that “Peña and Pedraza breached certain fiduciary duties…committed fraud, and engaged in a civil conspiracy which damaged (them)… and that Peña and various law firms and attorneys associated with Peña committed legal malpractice.”

Kendall, on the stand during a misconduct hearing for the justice of the peace who issued the arrest warrants against Peña, told the court “that Peña escaped indictment on misapplication of trust and other charges brought against him by the Duthus…because the statute of limitations had run out on the allegations against Peña.”

The federal case against Peña (No. 99-40041) was heard by the U.S. Court of Appeals for the Fifth Circuit and originated in Brownsville as case (B-96-CV-191).
So there you have it.

STORIES BITE PENA, RUSHES TO TAX OFFICE

A day after Ernie Hernandez, his opponent in the runoff election for Cameron County commissioner for Precinct 2, ran an ad in the local daily accusing him of being delinquent on his property taxes, Ruben Peña dutifully marched to the county tax man and paid his dues.

Foiled in his attempt to place his yard signs before his seven challengers to the Cameron County Pct. 2 commissioner position placed theirs, Ruben Peña had his workers cover the offending sign after supporters of his opponents flooded the city with complaints.

Rather than remove the offending sign and then come back to put it up again 10 days later, Peña's workers instead draped the sign with a thick black square of heavy plastic and secured it with tie-downs. About the only thing that can be seen is the lettering saying "Precinct 2" when the wind blows the plastic away.
Meanwhile, the candidates for the position have all been trying to make their mark that will set them apart from the pack.

What does Montoya have on the short tempered McDonald - btw - the other day while I was waiting outside Judge Linda Salazar office waiting for Judge Ochoa to sign an order, McDonald ordered his bailiff to order me to leave the area. McDonald needs a full psychiatric exam with projective testing.  I told the bailiff to tell Heil McDonald I was going nowhere - I was their on official business.  The bailiff returned to the courtroom and I stayed.  Asking me to lower my voice is one thing, but ordering me to leave the area is another.  The hypothalamic disorder along with another problem keeps me from knowing how loud I am speaking.

"Art is in a difficult position given Peña's political connections," said an attorney acquainted with the case. "If he decides to grant the summary motion based on the expiration of the statute of limitations, he runs the danger of going counter to the Court of Appeals precedent in the case. If he doesn't, he could incur the wrath of the Peña and Vela clans."
Peña is the brother-in-law of former City of Brownsville Mayor Blanca Vela, who is the widow of the late federal judge Filemon Vela Sr. During the recent race for Precinct 2 commissioner, his handling (or mishandling ) of the McGarr estate was a major part of the his opponent Ernie Hernandez's campaign.

POETIC JUSTICE IN PENA'S ELECTION APPEAL DENIAL?

Was the dismissal of Ruben R. Peña’s election contest against Ernie L. Hernandez Jr. for the Democratic Party’s nomination for Cameron County Pct. 2 commissioner by the 13th Court of Appeals a case of poetic justice?
Peña, who has had his own personal experience with time running out on legal proceedings in the past, apparently fell victim to the sands of time.
In the decision dismissing the appeal , the court stated that since the applications for mail-in ballots had begun Sept. 3, it would be too late for elections officials to stop the process and disrupt the elections in November.
Peña has contended in the past that he was robbed.
Although Peña came up 49 only votes behind Hernandez with 2,110 votes 2,159 votes, his main contention was that the mail-in ballots had been illegally acquired by Hernandez and his supporters.
Hernandez received 240 mail-in votes versus 34 for Peña in the runoff.
Peña had requested that the court order a new election.
Just as Peña was not favored by Father Time in this case, in the past he has been its beneficiary.
In 1997, a brouhaha ensued when a county justice of the peace issued arrest warrants against Peña that were served on him by a county constable.
Peña was placed under arrest at his office and placed in the county jail on allegations brought against him by the heirs of Rex McGarr, a wealthy farmer who had Peña prepare his will and made him its co-executor. They claimed that Peña and Robert Pedraza, their ancestor's foreman, had schemed to deplete their relative's estate though a variety of unscrupulous moves.

Both Guadalupe and Jose Alberto Cisneros voted through the mail in the runoff race for Cameron County Precinct 2. Now, as a result of the challenge to those ballots by losing candidate Ruben Pena, they were visited by the process server hired by Pena's lawyers.

"The lawyers who sent Herrera to my home were hired by Pena," she said. "I want to know what gives them the right to come into my house without our permission. How can someone just go into someone's house and walk in without permission? My brother was scared and went into seizure because that man with a badge and a gun (Herrera) just walked in after him and threw the papers in front of his door. I want to know who's responsible for this."
Pena, who is attempting to gather enough witnesses to overturn the election results that resulted in his loss to Ernie Hernandez by 49 votes, apparently is resorting in trying to get enough voters to say they did not know who they voted for when politiqueras mailed in their ballots.

Apparently, Peña is hoping that he can cower enough elderly and homebound people who voted through the mail to recant their votes to persuade a visiting judge from Hidalgo to overturn the results where he lost by 49 votes to Hernandez or get the judge to order another election.
"He is asking them who they voted for and if they knew who they were voting for," said a source. "He's trying to scare some of them by telling them that they were videotaped when their ballot was filled out. Many of them have called us to tell us that he's trying to scare them and sign an affidavit saying that a politiquera filled the form and that they didn't know who they voted for."

She was referring to Ruben Peña, a former Harlingen attorney since moved to Brownsville and of his bid to overturn the election for county commissioner of precinct 2 which he lost by 49 votes in a runoff against former Brownsville city commissioner Ernie Hernandez

Bobby, you have turned exactly into what you are accusing Montoya of..an extortionist. You want them to bring down the ads they have with him or else you will bring out dirty little secrets on them. Ruben Pena advertises and you bring back the stories that Montoya used to bury him. You and Chris were close, and he advertises with Montoya, and now you want to ruin his marriage. While I can see your argument, you are missing a key point - I never said that any of the allegations Montoya made against Pena are true - I am showing evidence which explains why the ads exist.

Do people not have the right to know candidates out of fear are buying ads? Is not the goal to clean up the mess which is Cameron county? If fear is what is driving the ads how will that make Cameron county a better place?

You have not seen me take any sides in this election.

In fact on the issue of the Pepe Villarreal case wherein Ruben Pena dropped the criminal charges at Villalobos request - I went out of my way to explain Pena understood it as a mechanism to get Villarreal to cross back into the US and he could then be reindicted.

Do you think Montoya would have explained that?

I can assure you - I am not working on my own - people being forced to pay want it stopped and they do not have a problem with my posts.

On Cris, not Chris - Cris runs his mouth like a sewer concerning his private life away from his wife. I need not publish anything - that is between he and his wife. But you might want to talk to Cris about running his mouth as if what he does is okay.

He runs his mouth with a pride of honor - if you think I have to speak to the issue you are wrong - he has run his mouth to too many people. Also do not assume anything - wiffy's whose mothers are being trashed because of Cris tend to not like it. It could be that simple

But again, I see your argument and can understand why you might think what you are thinking - so no direct argument with you - it is a reasonable argument and post.

I guess we will have to agree to disagree - but it will not surprise me if a lot of people agree with you. Your argument is noted and is being given consideration in how I approach this in the future - I need to better explain I am not agreeing with Montoya and why people need to know what is happening.

For the record, I have never been close to Cris Valadez. He called me. He tried to work the BV to do his and Cascos dirty work. I've never met anyone in his family. Well maybe a brother one time. I'm not sure if the person was his brother - I just do not rememeber

Did not need to go out of my way to explain why Pena dismissing the murder charges is of no consequences - hence I an not trying to discredit Pena - I am trying to show people why he feels like he has no choice

So again tell me who am I demanding money from - because without that there is no extortion

I am actually in part defending Pena by telling the entire story about the Pepe Villarreal case which Montoya never did, and by letting people know what Montoay would print against him if he did not pay.

Since I have called Montoya pathological liar over and over again - how do you get from this post I am remotely saying any of it is true?

Again I went out of my way to explain why the Pepe Villarreal thing changed nothing in terms of the man being prosecuted for murder

Montoya never printed the truth and never will

Rogue law enforcement officials would have to be acting on their own. When you have as much action from DA investigators as you had with Villalobos and now Saenz, it stinks from the top down. DA investigators are claiming to have recorded cell phone conversations in regards to landlords that are leasing properties for game rooms. This is an old trick from Villalobos play book. They are then threatening the landlord with being hauled off to jail unless they give up all contact information for the tenant. where is due process in all of this. It is LE's duty to perform investigations and not threaten citizens with jail time under false pretenses.
Old tricks, new dog, same results. Abuse of power should be looked into by the feds. This is like hauling off the manager, CEO, COO, etc of Wal-Mart if a drug transaction took place in their parking lot.
Cascos is doing the same thing with Humberto Barrera an ex cop acting like a cop.

If the DA investigators really recorded those conversations it will only take them down two roads .One road leads to some middle eastern criminals from Houston who until recently were represented by a member of Congress .The other road leads to a local narco who likes to hold high stake poker games . He was represented by Saenz's opponent in the race for DA. The FBI raided game rooms of a few permanent residents whose marriages were proven to be bogus and used that as leverage against Lucio and his former partner the now ex DA. Wicked Web they all weave.

I don't think that district judges would consent to wire tapping at the local level in order to prosecute a misdemeanor. My point is ANY LE officer that lies and threatens to toss you in the slammer if you don't cooperate are the same LE officers that say "tell me it's so and so and I'll let you walk". This shit has to stop in Cameron County. If not then they are just like the Zetas. We all know who both players you mention are, however, due process is due process. One is a middle eastern guy that the feds have probably fully vetted by now the other is an old thug doper that is out of business because he was Masso's man

There is more than one middle easterner. I am quite sure they were not "vetted"Just look at who was trying to get the Blue Buildings. Masso's man was his nephew who was the middle man for the Narco . Who is not out of business.I believe it was stated in court there was a tape recording of the ex Willacy county DA demanding rent from the tenants n that that tape was in possession of the Cameron County's DA's office.I do agree with you that these public officials have been operating Zeta style though and that it needs to stop.

In order to make a Narco connection you should have high knowledge of the incident...Ex Hidalgo DA definitely involved

Criminal enterprises take time to bring down.The CC DA is on record stating there was money laundering in upwards of 350 million a year going on with the game rooms .You still need to find out where that money is going ;and is it being used for weapons against our soldiers over seas ,and who is the source of the drugs and what crooked officials are involved and to what degree. Not as easy as it sounds.

ICE was on this for 18 months before Saenz took office. I do not believe they spent 18 months investigating because all of the 8 Liners were being run by small time operators.

I think a lot more can be expected to come out of this - time will only tell

I think both sides can make good arguments - but you raise a point - we are actually at 30 months with no federal arrests - so your point may be well founded.

I am just unwilling to close the door on the issue - logically it makes sense the drug cartels would have an interest - but maybe they never reached that point before the raids started

Who is to say that federal arrests have not been made?and/or that there is no ongoing cooperation and/ or open investigations going on? For example ,Mission's Panama Unit was crossing county lines and extorting cash and drugs and leads and phone numbers from a few of the game room operator/owners there in La Feria and at their homes which happened to be in their county's jurisdiction and/or close to the line.They didn't count on their actions being caught on video.,and we didn't hear about it because they plead guilty.Not like the victims were in a big hurry to go to the Feds and say my dope was stolen.I believe there is a lot more going on and that we shouldn't expect to hear everything.I also believe we should not believe everything we read Feds plant stories and hold them up on a daily basis.In addition ,can we really say that any of the recent drug busts made did not come about by leads that came about because of Operation Bishop? Would we really expect the Feds to tell us this? I too am unwilling to close the door on this issue because I believe there's more than meets the eye going on.

I wonder what R Pena has up his sleeve....he gives a sworn statement/deposition of theft, embezzlement, and agrees that he failed to do his fudiciary duties and he still walks the streets. He even prosecutes others for their wrong doings. Gee what a man!!! Steals from the blind and poor women, then wants to steal from the county. Outstanding Citizen??????
