GUS GARZA THROWS JUDGE NELSON UNDER THE BUS - WHILE DA SAENZ CONTINUES TO IGNORE PROBLEMS WITH THE CRIME VICTIMS UNIT

A victim at my request was called by Gus Garza who explained to the victim that he and another man would not be compensated for damage done to their Harleys by a man charged with a series of crimes.  According to the victim Gus Garza put 100% of the blame on Judge Nelson.

I knew this was a lie because I was in court the day Judge Nelson dismissed the charges after Gus Garza stood up in court and agreed with the defense counsel Luis Sorola the court had no jurisdiction in the case as a felony.  Judge Nelson dismissed the charges at the request of Gus Garza - plain and simple

I had the victim call Gus Garza back because he did not remember the name of the person who called him.  During the second conversation Gus Garza claimed that double jeopardy had attached and the court had no choice but to dismiss the charges.

Now, whether it was jurisdictional because of the amount of damages or double jeopardy, whose fault would that have been?  District Attorney Luis Saenz.  It is his office which files the charges.

In large measure the blame goes back to the Crime Victims Unit.  I have complained repeatedly about their incompetence, but because they are political appointees,   DA Saenz will take no action to correct the abuses and incompetence coming from the CVU.

They initially returned the forms completed by the victims with no explanation.  I took the forms to DA Saenz with the envelope showing they were returned from his office.  He was approaching his truck and he told me to take them to someone very specific in his office.  I did exactly as he told me.

When I first learned about dismissal of the charges I called the person I return the forms to.  She said she would look into it.  I was later told that the CVU was claiming they had no such file.  Both myself and the person I was working with in the DA's office knew that was a lie. 

But here is the deal, it was in the file in the 138th judicial district court.  The CVU was unwilling to get off their worthless butts and go pull the file and return a copy to the victims.  Well I got the copies of the originals on my own and sent them back to this same source within the DA's office.  I asked that someone from the DA's office call the victims and explain what is happening/

All lies and incompetence  from square one.  This is when Gus Garza called the victim and threw Judge Nelson under the bus.

So now both victims are out thousands of dollars in damages with no restitution ordered.  The criminal walked.  Gus Garza actually told the victim that DA Saenz was doing his best to clean up the mess left by Villalobos.  This case had nothing to do with Villalobos.  Gus Garza and Luis Saenz staff messed up - rather than just face up to the fact they messed up Gus Garza lied and threw Judge Nelson under the bus.

From the way I read it it does not cover property damage - but I will check again - I may even give them a call

Oops, you are right, doesn't cover property damage. But you can call them directly just to be sure. They've been responsive to me in the past.

I dealt with the CVU under Villalobos..... they were as incopetent then as they are today.

I do not know about how things worked under Villalobos because I never had a need to get involved in a victims issue - but this one is 100% on Saenz

"Incopetent." Haha. I had one case where I went to the crime victims unit a few months ago and they were very helpful.

On 07.08.2011, my son was a victim of a violent crime… as a result he suffered a "TBI" Traumatic Brain Injury". The CVU was of no help at all. The day my son was interviewed by the ADA, the person assigned to his case from the CVU was not even in town. On the day one of the "defendants" pled guilty, the CVU never approached us to introduce herself, nor did she advocated for my son or ensure that we were heard. We worked on the Victims Impact Statement & we were not allowed to read it. Instead she sat her oversized butt on a chair and proceeded to have a conversation with an attorney that apparently had nothing better to do that day. I strongly believe if she had advocated for my son, this "defendant" would not have received 10yrs. probation, but instead would have spent time in prison for the exteme violence, pain & distress he caused my son and my family. To add insult to injury ADA Julie…. was upset because I had attempted on several occasion to contact Mr. Villalobos regarding my son's case. This D.A. NEEDS to ensure that the VICTIMS of this county are kept informed EVERY step of the way.

Saenz, if his previous term is an example, will protect his staff far beyond what is reasonable. He seems happy to allow them to do the minimum required. He will refuse calls that he knows are complaints regarding staff performance. I am being intentionally vague but we once had to go to the district judges to put pressure on Saenz to force his staff to do their job.
I had hoped he was going to use this term to make amends. Guess not.

In a case which was 100% Saenz I had to bring to his attention the indictment was defective, that the CVU was refusing to work with this victim of domestic abuse (The AG processed the claim for her) that the ADA had failed to notice there was an old warrent out for the victim for being in Dean Porter Parker after it was closed (I learned defense counsel was going to have the victim arrested in open court on the day of trial - I stopped the entire mess - also the warrant was baseless - she never failed to appear in court because as the DA file itself showed she was never asked to appear in court)

With Saenz aware of all of these problems he refused to take action against the ADA- the ADA retaliated by doing a plea bargain on the Wednesday before the trial. The victim was never contacted or told. The victim cried all weekend in fear of having to testify on Monday. We got to court on Monday only to learn - the case plead out the Wednesday before.

DA Saenz domestic abuse office and CVU offices are both jokes - he counts on the Herald to print his lies about his office knowing full well the Herald will never print the truth.

In Saenz's first term he had a dimwit George Gavito that ruined any chance he had to get re- elected, Gus Garza is his new George Gavito.

Luis Saenz is a lameduck DA and a danger to everyone in Cameron county.

The following quote from the paper will be in every ad against him come his relection during the primary in 2016

"he bribed now-Cameron County District Attorney Luis V. Saenz with $1,000 for favorable resolution of criminal cases against him when Saenz was a special prosecutor under then-DA Armando R. Villalobos."
