Montoya is going to do everything in his power to please Presas-Garcia and attack Minerva Pena without any regard for facts or truth.  He continues the false attacks in hopes one of her opponents will pay him for an ad.  When the opponent does, we all will know how low this candidate will go to win.

When you google what the poster stated in quotes it does not exist.

Lets see what the Texas Constitution says:

Nope - does not apply to people who are currently school board members.

"Sec. 65. TERMS OF OFFICE; AUTOMATIC RESIGNATION. (a) This section applies to the following offices: District Clerks; County Clerks; County Judges; Judges of the County Courts at Law, County Criminal Courts, County Probate Courts and County Domestic Relations Courts; County Treasurers; Criminal District Attorneys; County Surveyors; County Commissioners; Justices of the Peace; Sheriffs; Assessors and Collectors of Taxes; District Attorneys; County Attorneys; Public Weighers; and Constables.

(b) If any of the officers named herein shall announce their candidacy, or shall in fact become a candidate, in any General, Special or Primary Election, for any office of profit or trust under the laws of this State or the United States other than the office then held, at any time when the unexpired term of the office then held shall exceed one year and 30 days, such announcement or such candidacy shall constitute an automatic resignation of the office then held, and the vacancy thereby created shall be filled pursuant to law in the same manner as other vacancies for such office are filled."
Here is Chapter 201 of the Election Code - read it - where is there any support for what the poster is saying.
A job of the moderator is to monitor the lies and keep them out or at least discredit the poster.
Now if this poster finds something on the Internet or in any law book which says Minerva Pena automatically resigned - I will be the first to post it and demand an election or appointment.  But be careful what you ask for Cata - Escobedo will just appoint another shill.

That is correct Bobby. When Enrique (Dr. Pepper) Escobedo ran for county commissioner, he did not have to relinquish his post. This is old news, just a distraction by an idiot.

bob you are correcto mundo amigo but the state law also says that a person elected to serve as a justice of the peace cannot hold another elected office or position.

Second the comment was just posted - I actually have a life and do not have time to immediately research every little thing posted.

I do know from what little I read the rule about holding two elected posts is not clear - in some cases you can and in some you cannot

For example you cannot be a JP and hold an elective office which is part of he legislative or executive branch because of separation of powers.

You cannot hold two positions which pay - the JP pays the trustee does not

Right now I am out the door - I have people coming for dinner and need to get going

The sauce is on - but I need to buy Italian sausage and what I need for meatballs - I also need an Italian bread for fresh garlic bread and everything I need for a nice salad

How can Minerva sit on the school board and make decisions when students and employees of BISD appear infront of her? Will she be fair & just with all or only the ones she likes? Or is this the reason why she is running for JP only to help her own

ON the rare occassions a friend of a JP appears in their court, the court records show the JP's recuse themselves - this happens -

so your issue is nonexistent and a desperate attempt to discredit her

really - she is going to raise all of this money to become a JP so she can help 2=3 friends a year
