THE VERDICT IS
We are waiting on the judge - we have a juror note - "do we have to have a verdict today."

There is a juror problem - cannot work tomorrow morning or Tuesday.

This means they are really studying the issues.

5:37 P.M. WE ARE WAITING ON THE JUDGE  - NO INDICATION AS TO WHAT IS HAPPENING

The jurors cannot agree when to come back.  They all have different commitments.  The court will ask the jury if they want to stay and the court will order dinner for the jury, and maybe come back tomorrow at noon.  5:42 p.m

5:47 p.m. Another note - waiting on the judge.   Two jurors will not open to the other side or change their mind - the two are holding fast to their position.

Both sides agree for the court to order the jury to deliberate - the judge is trying to get the defense to agree to allow the jury to consider other counts and then come back to count one.  The defense will not agree.

5:56 p.m. We do not know if they are stuck on one count or all counts

6:21 p.m. We are back in court, but do not know why

6:26 p.m.  The jury has ordered dinner - this will go late - they are getting Whataburger for dinner

Guys insult me all you want - no comments on guilt until there is a verdict.

HEADLINE - I DID NOT NOTICE UNTIL THE LAST SESSION, BUT VILLALOBOS WIFE HAS BEEN IN COURT ALL DAY 6:45

Update:  Nothing is happening - Judge Hanen put myself, Emma and Daisey (ValleyCentral) in the work room for the AUSA since they are not using it - the chairs are nice - we are bored to death - Emma is typing away for her story.  All we can do is wait 8:24 a.m.

UPDATE 9:05 IN COURT WAITING ON JURY AND JUDGE

we have a verdict

COUNT ONE:  guilty

COUNT TWO: guilty

COUNT THREE: guilty

COUNT FOUR: guilty

COUNT FIVE: guilty

COUNT SIX:   guilty

COUNT SEVEN: not guilty Oscar de la Fuente cases

COUNT EIGHT: not guilty

COUNT NINE:  guilty

the judge is with the jury  -

guys you now may have at it

The most sickening part of the trial was the IG's testimony of his "investigation" into the local federal prosecutors. A least with local authorities, the FBI and Feds can investigate them and hopefully keep the corruption in check.

But who checks the Feds? They have the power to ruin someone's life whether they are guilty or not. And it looks like their power snd ability to abuse that power is completely unchecked. It's terrifying.

Your comment is solid - I will approve it after the verdit - you do not need to repost - once the entire verdict is in I will hit publish for your comment

After the verdict is in will you explain what this all means for Lucio ?.How it effects his case,What he should do? Possible scenarios like Villalobos cooperating with Govt on Lucio and others not yet charged?

As a former lawyer, do you think this is a better indication for a guilty verdict (at least on one issue) or an acquittal?

The first count is very complex - they could still be getting through it - at this point I know enough it means nothing - other than they are doing their job

Doing an awesome job Bobby. Much appreciated!

There is little doubt but that Mr. Villalobos will be convicted on each of the ODLF counts. The other counts are also solid and most likely convictions as well. I doubt Mr. Villalobos will be aquitted of anything. Aquittals are extremely rare. And with this much persuasive and credible evidence aganist Mr. Villalobos, its hard to imagine anything but a straight guilty verdict.

Sir you did great are we going to get same for Eddie Lucio trial

I suspect the note means the jury is somewhat close, which is not good news for Villalobos.

I agree with @5:03 and Please do.This will also provide you with an opportunity to teach and us with an opportunity to be educated and informed.Hope you got it in ya

Hung jury? What are the rules? Majority? I know different jurisdictions have different rules please explain

When is lucio set for trial? If this is a mistrial, do Feds offer Lucia immunity to flip?

Anonymous said...

Maybe they couldn't agree on dinner. Two wanted chik-fil-a while the others wanted McDonald's. They reached a compromise and got Whataburger! Everyone loves Whataburger!

Assuming a hung jury. He still has the indictment on tax evasion and a possible retrial on these charges

I don't really like you but I'll give you credit. You did a good job reporting this trial.

Bobby, base on your expertise, as a 13th juror what is your verdict? You have vase knowledge of law and studying jurors. Your opinion would be significant! Thank you for keeping us posted with the trail of the year.

On perez garzoria - because she is not part of this and obviously lost the election I cannot allow for the comment - but I spoke to someone here who also spoke with her and the comment was the same - so I believe you

I understand... but I am very sadden that people are allow to use their power to insult others just cause we are not citizen, I am a legal us resident and I am very up set, I fell discriminated, and insulted by this lady. I kept quiet only out of respect for the family of villalobos. As they are in grief guilty or not, and I was not going to be the one to open a can of warms. thank you for you posted comments. just to let you know she keep telling me to leave this country cause its better with out us. that is really mean.

10-2 to convict right now, that they've agreed to continue only be good sign for government.

BobbyWC said...

I approved the comment so I can clarify - it could be 10/2 favoring Villalobos which would be good for him - they have stayed to avoide tomorrow and Monday - which is a Holiday btw

Disagree. Passion with government, thus 10 jurors "fighting" with 2 outliers. Defense urged reasonable doubt NOT innocence.

I will allow for this discussion - I know people are waiting - we are here with no food - we cannot leave the building- if we leave we do not get back in - so help keep me awake - send pizza maybe sercurity downstairs will send it up [lol] I did accept a water and cookie from Norton Colvin's wife - no bribe - she has been wonderful with everyone - The AUSA have also been wonderful but they are not up here offering water and a cookie -

Might be a good time to discuss your issues and concerns about BISD with Emma and Daisey, as you would have their undivided attention considering your accommodations.

Wow! This guy screwed me and yet I'm not happy by anyone having to go away. I must say he deserved every bit of it and is lucky these were the only charges brought forth. He made a mockery of the judicial system. I still hope DOJ goes after all the bail bondsmen that were exploiting his office. These bondsmen were stealing money from hard working lawyers too.

GOOD JOB BWC, I'VE BUTTED HEADS WITH YOU ABOUT SOME OF MY COMMENTS. HOWEVER, YOU DID AN INCREDIBLE JOB COVERING THIS! MANY THANKS

Anonymous said...

What does this mean as far as sentencing goes? How much time will he be getting Bobby?

Anonymous said...

I must say, I am not happy it saddens my heart to see this man go away, but the people has spoken and the fbi will now go and put someone else out of the way, I guess god knows what he does, and all shall be fine in due time. Happy I am not, but for those who wish this for him, congratulations I guess.

I so agree with the comment regarding the feds... they can ruin your life, your childrens and your whole family if they want to..... they want to put the fear of god into you. but who ever calls that justice shall see them in the same shoes....... its somewhere in the bible... in a different form... but that is the meaning. So to all the so called christians that pray for justice by harming others. I pray for your unkind soul. May the good god forgive you for judging others.
