ARMANDO VILLALOBOS GUILTY ON 7 OF 9 COUNTS

I spoke with AUSA Surovic and he told me sentencing will be less than 20 years for sure, but that they will push for the max

COUNT ONE:  GUILTY

Count One: Alleged to have used his office to illegally generate income for himself and others - basic charge - it must have affect interstate commerce - this is the Rico Charge - Judge Hanen is explaining a lot more - accepting $80,000 in the Livingston by negotiating the plea and civil case - all to permit the cash bond to satisfy the civil judgment.

COUNT TWO: GUILTY

Count 2: Conspired with people employed with the DA's office to commit a crime. This is a separate account from the RICO charge. 2 or more people agreed to commit the RICO offense and the Defendant knew about the conspiracyCOUNT THREE: GUILTY

 Count Three: Deals with Eddie LucioCOUNT FOUR: GUILTY

Count 4: Charges - did affect interstate commerce - enabled Judge Limas to obtain property not due to him or his office in exchange of performance or non performance of official discretion. - this is based on the Livingston case.

Count 4 is different because Villalobos is accusing of helping Limas


COUNT FIVE: GUILTY

 Count Five: Deals with Tractor Trailer Case involving Eddie Lucio and Oscar de la FuenteCOUNT

SIX: GUILTY

Count Six. Deals with House Money case involving Oscar de la Fuente

COUNT SEVEN: NOT GUILTY 

Count Seven: Deals with multiple payments from ODLF in a series of criminal cases involving DA's office and favorable decisions

COUNT EIGHT: NOT GUILTY

 Count Eight: Deals with extortion - Villalobos obtained property not due to his office - obtained multiple amounts - favorable decisions through Abel Limas

COUNT NINE:  GUILTY

Count Nine: Deals with criminal cases with favorable decisions for clients of Joe Valle

UPDATE

Presentence due in July ?? 2013 -  I believe but I could be wrong sentencing is in August

AUSA Soruvic asked that Villalobs be taken into  custody.  But because he has complied with all his terms of pretrial release Hanen denied the moton - Villalobos is free to go until sentencing unless he violates the terms of release.

I would think that after the Livingston fiasco the judge might be a little more careful. Here is a guy looking at a likely 20 years and no possibility of a job when he gets out, old and broke. I would think that Puente Nuevo might look pretty wide.

Additionally, how is he paying for his legal fees? From the looks of his life style, putting aside for a rainy day was not high on his list. And, appellate expenses, good luck.

The only way to stop this bullshit is that if the convicted flees while on unsecured bail, the judge must serve the sentence of fugitive.

Eddie Lucio - he should have taken what ever plea they offered him to flip - that ship has now sailed.

AV got what he deserved! AV wanted to get on the stand and his defense attroneys allowed it only because he pushed it. AV is so arrogant that he wanted his two minutes on the stand like those two bitches in Jodi Arias and Stacy Anthony.

.....well, I was at least partially thinking, b4 he got on the stand that he had a chance. Then he get's up there and blows my mind.
I can't understand a DA taking the stand in his own defense knowing the system either

I think was was convicted before he testified, but his attorney opened the door, as we say, to the fact he was fired in Dallas, and that yolanda de LEon demoted him to juvenile court. This made him look bad, and it also meant he lied to the jury

Yeah Booby, but he also admitted to 2 bad seizures on the stand. He also stated that probable cause and warrants were bad but that his office needed the money. That's a lot of money and no arrests and the owners got there property back. This smells to high hell and I think the jury really felt that. This part of his testimony showed he's willing to bend the law to his advantage if it behooves him.

Insulting me and then claiming that I did not fully cover Villalobos admission of the improper seizures is not going to get your comment through

I did a special breaking news headline on this very issue. In fact I have been told the county will be meeting with me to deal with how the DA's budget problems lead to this problem.

I covered it - I gave it a headline note - so insulting me is not how you get through - specially when you are implying I did not consider it serious when my readers know I have it a headline

Not sure if that was directed at my comment. I didn't think I insulted you....My point was to the reader that thought he did a good job on the stand. I think his admitting to the bad searches hurt his credibility. My point was directed to the 6:25 a.m. comment

I don't believe Villalobos had a choice. He had to take the stand. Limas is a cocky dude with a lot of attitude! Oscar is a slime bag! Villalobos thought he could wooo the jury. Although I did not see him testify, I know in past trials that he is a smart fellow with a calm demenaor. Apparently, that was not enough for the jury. I guess the two divas in the jury just needed some food!

On Limas if he were standing in front of me naked, and telling me he is a male - I would still demand genetic testing - the man is pure scum - Same for Oscar de la Fuente - I hope DA Saenz's brings an indictment and takes him down - the State Bar under certain procedures can move for an emergency interim suspencion of his license and then there are still the IRS issues

Your really think saenz will bring charges, he would have to bring charges for his buddies as well.... buddies that were brought up at the marchant trial and gave lots of money to limas... and never got charged..
do you think more names are going to get charged in the same limas corruption case? or that is it, the 12 and they are done................
there is a lot to chew out there....

I agree i think he was convicted way before he testified, there were a few people with a lot of hate for him in his trial... and all they seem to think was they wanted him in the can...... I have a pretty good guy feeling that someone from the audience lied and was a family member of one of the people on the jury. so be it.
He was just too interested in what was going on. and kept saying naaaa the jury will find him guilty you watch. I think he is writing in your blog. the guy that said that villalobos testimony was pretty good. He kept telling everyone that.. but then saying he is going in. who knows, maybe I am wrong.
