UPDATE COB AND BISD MEETINGS
 
COB LAND DONATION TO UT

COB Commissioners voted unanimously for the donation of land, save Tetreau abstaining.  The donation would be voided if UT does not locate in downtown area.  So it is not a done deal unless UT stays in the downtown area.  I get the business sense behind the donation - but when billionaires come begging to people who do not even have enough ambulances to serve their community something is profoundly wrong.

I am glad the decision is 100% contingent on UT locating near downtown.

Tony Martinez did silence any public discussion.  He took the position that the time for comment was at the workshop and not now.  He did offer to let the person speak later when the cameras were off.

BISD THOMPSON HORTON DISCHARGE

Bottom line they are staying pending a new RFQ.  First the board voted to fire them, then when Powers could not muster a majority for hiring a new interim lawyer, the majority voted to retain Thompson Horton pending a new RFQ for new counsel.

The discussion went so bad that Escobedo shut Presas-Garcia up as an embarassment to the board.  Pena and Chirinos accused Presas-Garcia of lying about them agreeing in advance as to which law firm would be hired as interim.  Presas-Garcia had no defense.  The woman lies as if lying is a moral commandment from God himself.  She is the essence of evil and a danger to the school district.  Hopefully next time Escobedo will have the courage to have her forcibly removed when she announces the rules will not apply to her.

Saavedra being ignorant argued that Thompson Horton created important precedent in the Antonio Juarez case which will be taught in law schools.  BISD  was not represented by Thompson Horton - this shows you just how easy lying comes to Saavedra or just how ignorant she is of the facts. The case has zero precedential value.  There is nothing in the opinion.  The court found it could not get to the key issue of hearsay because the appeal was interim.  This is basic law - except that under Texas law you can if the court has jurisdiction over any issue. 

The issue was immunity for the trustees.  Thompson Horton if anything failed to protect the trustees on the issue of immunity - how that makes them brilliant is beyond me.  But Saavedra seems to think this is evidence of their brilliance.  Had Thompson Horton had one competent attorney on staff, which they do not, they would have informed the Court of Appeals that they in fact had jurisdiction over the hearsay issue because it was incident to the immunity issue over which they did in fact have jurisdiction.  Had the court resolved the hearsay issue, the entire case would have been dismissed and Juarez would have gotten zero.  But as we all know Thompson Horton was hired for one reason and one reason only - to do Presas-Garcia, Longoria, Saavedra and Escobedo's dirty work. That dirty work cost BISD millions.  One would hope the new majority would sue Thompson Horton for their malpractice.

Longoria is so stupid I seriously doubt she thinks without an electrical shock to stimulate her brain.  She accused Powers of violating the Open Meetings Act for researching on his own which law firm would be best for an interim. 

She then, being an expert on the Open Meetings Act, without an Agenda Item demanded that the Board vote to hire Thompson Horton as permanent counsel - for nearly 2 years they have been interim counsel because the past majority opposed going properly through the process of hiring permanent counsel.

Presas-Garcia and Longoria actually accused Powers of changing district direction based on a new majority - this of course they did not do by dropping the Healthsmart lawsuit and rehiring Hector Gonzales after the TEA upheld his firing.  Of  course all of the sworn to testimony about these two political whores meeting behind closed doors with Healthsmart representatives and Hector Gonzales is to be ignored.

Tonight Powers proved he will play as dirty as Presas-Garcia, Longoria, Saavedra, and Escobedo.  Only Chirinos and Pena stood their ground to do the right thing.  Powers got an ass kicking from Pena and Chirinos  "do not include us in your con jobs."

In the end Brownsville got to see just how unethical Powers, Presas-Garcia, Longoria, and Saavedra really are.

What did you people expect? Cata La Rata is Trash. She dresses like a low life and her make up is that of a street walker at midnight on the streets in downtown Brownsville. Do not believe me? Just look closely at her face. She use to look just as ugly way back at Porter High School. She is as evil and ugly today, as she was back at Porter High School as a classmate. Spooky!

I did not see the comments by De Leon - he is not an elected official - sometimes once older people have lived their lives I tend to just let their comments go - it serves no purpose to allow the BV to be used to trash someone whose views seem very suspect or terribly misinformed - so I did reject several comments attacking Mr. De Leon

If her were an elected official things would be different

I do not know what is on any of the property the city is thinking of donating

As to the University's location - I think keeping it tied to TSC in terms of location is most cost effective and makes the most sense

In these times cost must always be a factor

The satellite campus moving north wouldn't benefit the students. Many students from the Southmost area attend UTB. With limited resources, the closer they are to campus, the better. Some students would also concurrently attend UTB and TSC. Driving back and forth between campuses would be costly to students and a headache. The campus proposal for the north is an area near Rancho Viejo that has no infrastructure. Who do you think will have to pay the hundreds of thousands to put in the water lines? PUB, or technically, the taxpayers. If UTB needs to purchase property in lieu of accepting a donation, the burden will eventually be placed on the students in the form of increased fees, no? The potential donation is the the students and not the University.

I have about $20,000 or more of dental work because appearance means a lot in a professional setting - today I had to go to court with someone on the domestic abuse case - her 3 1/2 daughter said - "Bobby has pants and shoes on" I live in shorts - flip flops and t-shirts - but in court I makee sure I appear in a professional manner - I clipped my hair - my eyebrows - a professional appearance is important

I allowed the comments on Presas-garcia because this is completely lost on her when she appears at the meetings

Otherwise I am on board with you about the childish comments - they can be used but only in a very specific way which is important to the message and not to just be mean to be mean

On the satelite compus comment -I appreaciate your comment and it is the type comment which makes the BV better - like I said I prefer it stay near TSC - but if they have to buy the land it will not impact tuition - your thoughts are valid and need to be explored - but that is not how tuition is set

Dr. Saavedra was referring to the state school funding lawsuit. Thompson Horton was the lead attorney for the Fort Bend group of schools.

Nope she was not - she was very clear she was referring to the lawsuits involving BISD - she made no reference to that case - further - a trial court ruling in Texas has no value for binding other courts - there are no published opinions at that level so it would not even be taught in law schools

It wasn't Thompson & Horton's job to protect the immunity on your guys, it was the insurance atty picked by Johnny Cavazos, Vittitoe. Get your facts before you shoot your mouth off, Minerva abstained after Longoria pointed out they were having illegal meetings, how else did they know this guy would work for a flat fee of 15,000.
Lastly, Savaadra was talking about the School Finance lawsuit, you weren't at meeting, and like you said you were going back & forth with meetings. Stop printing lies.
Furthermore, Longoria is right Otis and his gang are all political. Firing Thomp SF on & Horton because they fired Mike Saldana? What a sorry as reason. It's political alright.

This is how Otis knew how much they wanted - he asked - that is not illegal - but like I said when I broke the story a few weeks ago I said - Otis and Escobedo were looking for a law firm to do their dirty work - so you are full of shit. Also Arturo Michel has refused to change his position on Healthsmart - the new law firm will recomment refiling the lawsuit on Healthsmart - that was the goal - something we all know Longoria, Presas-garcia and Saavedra all oppose

As to Saavedra I heard everything - she was very clear that she was referring to the lawsuits wherein BISD was sued - Johnny Cavasos had nothing to do with the lawyers hired by ACE - BISD chose ACE Insurance - ACE insurance effectively dropped BISD by raising the deductable so high BISD chose to go elsewhere - how pathetic are you that you now seek to blame a dead man.

In house counsel has the responsibility to insure hired counsel are doing their job - Arturo Michel gets an F for failure on this issue - any competent attorney would have been able to tell the attorneys hired by ACE insurance they did not have the law right on the issue of whether or not the court had jurisdiction over the hearsay question as incident to the immunity question - Arturo Michel either did not know the law or he chose to hang BISD so Cata an Luci's boy toys could get their money

For years I was in house counsel for a group of doctors - when they would get sued for malpractice part of my job was to educate the incompetent lawyers hired by the insurance companies - we got many a summary judgment against the plaintiff's - the insurance company lawyers loved to bill - I controlled them and stopped that nonsense - it blew my mind how many did not even know how to get a summary judgment so the lawsuit would be thrown out - this was my job as in house counsel - something Arturo Michel gets an F for

But that is fine - my sources are telling me to just be patient and to not sue Eric Holder and FBI Director Mueller to force the indictments because they are coming - these women ran their mouths so much the case I am told will be slam duck

But if the indictments do not come soon just like I got on a plane and sued to force the indictments of Villalobos and Limas - I will to force the indictments of Presas-Garcia, Longoria, Saavedra, Escobedo, Hector Gonzalez, Pat Lehmann, Antonio Juarez, Art Rendon, Ben Neece and several more - dropping another 10k to do what is right for Brownsville means nothing to me

I thought they were paid some before Thanksgiving and are getting part 2 in the Spring - I really do not know for sure

Seems like Cata is always quoted in the Herald. She qulifies her negative vote for Montoya's raise by saying the money is not in this years budget, nor in next year's2013-14. As budget chair she should know that the budget for next year has not been developed and adopted. She is always grandstanding, wrong, or lying. The irony here is that she did not complain when her buds Gonzales, Juarez, and the weasel Rendon were paid off and rehired with unbudgeted funds. In fact she led the charge to settle and pay them off. Rumors abound about her involvement and payback. Makes one wonder.

Do you know why Luci accused Otis of having meetings with attornies? Well it is because Luci and Caty flew to Houston to meet with Thompson & Horton attornies when they were seeking to get them to come to Brownsville and apply for the position of BISD Board Attornies. Thompson & Horton know they are in deep with the 3 ladies; who fought like hell to keep them as BISD Board Attornies. You know how this is known? Because several people saw them on the flight and they were running their mouths. Bobby you are right. These women love to run their mouths. We all see them at restuarants around town meeting and planning their next attack on BISD and their employees. Come Brownsville you know you have seen Luci, Caty and Christy having lunch/dinner together. All they do is plot and plot, to line their pockets and attack BISD, when they are out together. Listen next time you see them and you will hear!
