REPUBLICANS IN HOUSE USE FILIBUSTER TYPE RULE TO STOP VOTE ON TAX BREAKS FOR 98% OF AMERICAN TAXPAYERS

The United States Supreme Court has never found Senate or House Rules which substantively change the constitution to be constitutional.  It appears the only reason the House is not voting on the Senate Bill freezing taxes for 98% of the American people, is a Republican rule which says the House cannot pass bipartisan laws which do not include a majority of Republicans.  The purpose of the Rule is to keep bipartisan minded Republicans from working with Democrats to move laws  forward.

"But that Senate bill has been stymied by the House GOP leadership's deference to what's known as "the majority of the majority." Under this de facto rule, no bill is brought up for a vote when Republicans control the House unless a majority of their caucus supports it.

So while there may well be enough Republicans willing to break ranks and vote with Democrats to pass that Senate bill, Rep. Tom Cole of Oklahoma, the GOP's deputy whip, said that's just not going to happen: "You're not going to come up here and be able to put together a deal with 170 Democrats and 40 Republicans — that's just not in the cards."

Longtime Congress-watcher Norm Ornstein of the American Enterprise Institute said the majority of the majority rule is a major reason why bills passed on a bipartisan basis in the Senate don't come up in the House."

The constitution provides for a majority to pass legislation.  This Rule is a clear violation of the constitution.  The problem today remains the same as the last 4 years, President Obama lacks the leadership skills to take the matter into court.  Had he done this with the abuse of the filibuster in the Senate, the Dream Act, for example, would not have died in the Senate.

Until we have a president willing to stand up to these de facto coup tactics by the Republicans, nothing will change.
