RENE OLIVEIRA FILES ANSWER FOR PRESAS-GARCIA IN RICK ZAYAS LAWSUIT

My question is, has Rene Oliveira now been promised the job as BISD's counsel. Let's watch and see. On the other side, Rick Zayas told me "If the truth be told" meaning he did not put all of the truth in the lawsuit, Presas-Garcia on the day of closing caused the closing to fail because she convinced the wife/owner of the property to demand more money. Remember how Presas-Garcia has been claiming the deal fell through because the wife/owner did not agree to the sale price.

If Rene asks for an affidavit from me on the truth be told statement, I will sign it. Now, it really does not help Presas-Garcia because the claim is she did not deposit the earnest money with the title company. That is true. The receipts verified it. The problem is Rick is not smart enough to understand that the reason why Presas-Garcia got the wife/owner to stop the deal is because she (Presas-Garcia) knew the earnest money had never been deposited with the title company. Without that money the deal could never have closed even had the woman agreed to the sale.

Presas Garcia spent the earnest money without relizing that it was more than she would gain on commission on a $50,000 deal. That is why she had the woman demanding more money. If she would have had the earnest money in hand, why didn't she reimburse in one check rather than three on different days and only when the purchaser threatened to go to the authorities? She used the money and was scrambling for loans.

While it is a logical presumption she spent the money, there is no proof of this. The documents tend to support the rest of your claims. I am not saying she did not spent the money. My regular readers know on issues like this I just prefer to be careful. But again, any reasonable person would assume she spent the money.

Though I agree with you that there is no smoking gun on her spending the money; I strongly believe that the preponderance of the evidence (multiple reimbursement paymts.)would be sufficient to convince a jury or judge to come to that conclussion.

Payback for getting Linebarger with whom Rene is closely associated the tax collection contract? Rene has really sunk to an all time low.

While your observation is a good one, it may be too remote in terms of time frame to be true - but maybe it is - thanks for thinking outside the box and extending the discussion
