WALLS OF BISD ARE COMING DOWN
TO THE TRUMPETS OF JUSTICE - PART 2

The battle between Troy Whittemore and Jimmy Haynes is heating up. I have confirmed BISD suspended both Troy Whittemore and his wife. I have no confirmation of Jimmy Haynes' status.  Some say he has been suspended, while others are saying people in his office state he is unavailable for appointments at this time.

I was thinking about dropping this story until I got a phone call advocating for Jimmy Haynes.  I was happy to take the call.  Before I get into what this person wants people to know, I want to talk about something else this person said.   This person told me that in  April 2009,  Presas-Garcia called Troy Whittemore as a member of the Planing and Zoning Board and threatened him as a BISD trustee if he did not approve a project she had an interest in as a realtor.  Yeah, that would be a crime.  I do not know if it is a  felony or a misdemeanor.  But if I were Troy Whittemore I would certainly take any contemporaneous evidence I have and demand a  full investigation by the Office of the City Attorney and the BPD.  Let them sort it out.

It seems to me Presas-Garcia used the assault incident to justify punishing Troy Whittemore for what happened in 2009.  In the end she got what she wanted because the City Commission overruled the Planing and Zoning Commission. 

Here is the thing - all of these administrators lose their cases because they hire local attorneys who have  close to zero knowledge of the law.  Troy Whittemore can literally sue BISD today for retaliation and harassment.  Both claims form a basis for Troy to avoid the Administrative Procedure Act.  The exceptions to abstention are well documented.  It is 100% illegal to to suspend someone from their job as a public employee for filing a police report, or for refusing to give into the demands of a corrupt BISD trustee.  I am so certain of this, BISD's insurance company would most certainly give BISD an ultimatum - reinstate Troy Whittemore and his wife or they will refuse a defense for BISD.

But this is why BISD gets away with this - the local attorneys have zero knowledge of the law.  Through their incompetence they allow this corrupt school board and their trained monkey Carl Montoya, to use the administrative process to build a bogus case.  It is absolutely futile for any of these administrators win under the administrative process.  Competent counsel, meaning not in Cameron County, know that the exceptions to the APA allow them to get into federal court now - not 6 months from now - as they languish in limbo pay their attorneys to accomplish nothing.
On to Jimmy Haynes - some of what his advocate told me was just too bizarre and is in fact the type of advice an attorney gives their client which gets their client indicted.  I will not get into those claims because they are not coming directly from Jimmy Haynes.  A part of this story, I have withheld because I wanted to see the witness's name in the police report first.  This advocate for Jimmy Haynes told me that Julie Salinas, another administrator at Hudson Elementary school, was at Carinos with Jimmy Haynes.  This advocate for Jimmy Haynes is confirming she was their.  But this person is also saying Jimmy Haynes' police report will confirm Julie Salinas' husband was also there.

I have seen the log in sheet verifying this, Jimmy Haynes is seen on a regular basis visiting Hudson.  This has caused a lot of stress among the Hudson staff as an atmosphere of Peyton Place seems to be in place.  I have spoken to no one who is claiming an affair.  The only person who knows the truth is Julie Salinas' husband - he knows whether or not he was at Carinos.  I am told that after the incident she walked to the car by herself and that her husband was no where to be seen.  I was told this the first night when the story broke.  In my view he could have already been in the car, or maybe still at  the bar paying for the tab, or using the bathroom.  But it is Jimmy Haynes' advocate who wants everyone to know that he was not alone with Julie Salinas but in fact with both Julie and her husband.  I am publishing this only because it is Jimmy Haynes who is asking that people know this so as to stop the rumors.

If Jimmy Haynes was also suspended his attorney would be nuts to not immediately sue BISD for retaliation for Jimmy Haynes going to the FBI.  BISD has no business interfering with criminal complaints.  If public employees are made to believe they can be suspended for filing assault charges, or going to the FBI with criminal complaints against Trustees then no public employees will ever file criminal charges.  I am 100% certain Judge Hanen will take BISD to task for this.  I am also  certain BISD's attorney as hired by the insurance company will make known to BISD they will not defend BISD under these facts.

Bobby, are you saying that Mrs. Whittemore was suspended also? How in the world can this action be justified? This whole fiasco is just so incredibly wrong in its entireity!!
I can so understand BISD suspending both of the males involved in the altercation, pending an investigation but.. why
her? Furthermore..I truly hope that Troy does not succumb to any pressure to drop this issue. I know for a fact that if someone pushed me around and up against a wall he would not be in a position to run to his car and get away before law enforement arrived. My husband would have made sure of that. That was just wrong..wrong..wrong!!!
Troy, hang in there. DO NOT ALLOW BISD TO USE YOU AS AN EXAMPLE. Is Jimmy Haynes untouchable or is he a sacred cow? Oh.. excuse me he has been visitin with the F.B.I.

In response to both comments - if I were Whittemore and Haynes in addition to suing immediately I would file civil rights criminal charges against Carl Montoya - this guy is so far gone into the corruption and meddlings by the corrupt 4 it blows my mind

Yahoo!!! Keep throwing it at them Bobby. They are going to crack and hopefully crumble under the pressure and seeing Howdy Doody Montoya and the Wicked Witch Atinson go down would make alot of people happy and would definitely be "in the best interest of the district." Sylvia's bound to loose her cool soon. She lowered herself to respond to a Facebook Cheezmeh post so you know she is monitoring social media and the blogs. Without their puppet and their hit woman the $4 will be scrambling. Thanks for getting all this excellent information out there!

At the Planning and Zoning Committee Meeting in 2009, Cata tried to influence the Committee's decision for rezoning of a property through her Board of Trustee's position due to the fact that the property in question was located next to a public school. However, the Committee knowing that Cata was attending as a realtor asked her if she was representing the school district. She of course had to indicate that she was not representing the school district. However, the school principal of the public school who happened to be Cata’s sister-in-law attended the meeting and presented her opinion of the impact of an apartment complex on the enrollment and other services of the school. The Planning and Zoning Committee rejected the request for rezoning. The decision of the Planning and Zoning Committee was appealed to the City Commissioners. The school district sent an Area Administrator to represent the school district and the Commissioners were strongly influenced by City Commissioner C. Atkinson who strongly supported rezoning of the property. The residents of the neighborhood living next to the property disapproved of the rezoning of the property but a bogus neighborhood association was presented to the Commissioners supporting approval of the rezoning. The City Commissioners overruled the decision of the Planning and Zoning Committee and granted the request for rezoning of the property.

AOBE is the biggest weapon the corrupt 4 have against the employees. AOBE will do nothing - evidence of this - the corrupt 4 have completely and totally destroyed BISD and its rep remains silent.

Everyone knows Patrick Hammes was threatend with an investigation - to keep his job he caved and became the silent boy insuring no real opposition develops against the corrupt 4.

I strongly recommend every BISD employee pulls out of AOBE

There are many suspended with pay each year but most people don't call BWC to tell the story. Usually this type of situation is only a suspension for a few days unless something serious is uncovered.

No Hurricane preparedness package is going to help BISD be ready for what is yet to unfold. Unfortunately...for us taxpayers it will be at our expense and they say its all about the children. TSK...TSK..

It will depend on 5 variables - [1] once the new owners take over the Herald the standards related to ads will change - the new owners are all too aware that the Texas Supreme Court may issue an order against the Herald which makes it a lot easier to sue the Herald over how it accepts false and misleading ads - this could change the ads [2] who Maria Urbina de Ford endorses - if anyone, [3] how the investigation of the mail ballots plays out - remember Masso's numbers are problematic, [4] how the public comes to understand Masso's role in the $21.4 million Dannenbaum mess - remember Villalobos was indicted for using forefeiture proceedings to drop criminal actions; and [5] I forgot 5- I will let you know later when I remember

The actions of the $4 FORCED good people to retire. Don't for one minute assume all of the retirements were for "big bucks." Some were just fed up with being jerked around by BISD, having their careers ruined, etc., and decided there is more to life than running scared 24-7 as a BISD employee. Best of luck in the future to all of those retirees.

at 1:25 I totally agree - I am so happy you took the time to post - I meant to comment the same - but I am very busy and sometimes do not get to it - but thanks for pointing out the obvious - also TRS is earned based on years of service - BISD has nothing to do with how much someone gets from TRS unless BISD pads their last three years

Thanks Bobby, as always for everything. It angers me when some commentors place employees who have been put through the ringer into a class of "lazy, do nothing, overpaid administrators." Granted there are those at BISD, however, many of the unjustly wronged and accused, put in alot of years of dedicated service to students of BISD. For many of them, it was honestly "all about the kids." Thanks again for all your great reporting and keep it coming!

Don't read into a comment something that is not there. I am well aware that TRS is not a gift but it does pay well for what an employee must contribute. I made no comments about being lazy. Sometimes it is just time to decide to retire. The things that are required by BISD are no longer worth it when you can retire comfortabley. I hope they enjoy retirement and have a long and happy retirement. They have all earned that right.

There is a big difference between a professional educator and a good teacher. A good teacher is someone who will stay after school or give up lunch for a student that is doing poorly. A professional educator will be there only when the money is right.

There are many Good Teachers that are deciding to just retire, what we will be left with is a bunch of professional educators.

I retired some time ago and I am so glad that I did so when I was still proud to be a part of BISD. I was proud of the job I did - the job I was hired to do. I must have had over 25,000 students in my classes and I would be so hurt if I would ever find ONE who would say that I did not work for them and that I was never there for them. My retirement innunity is peanuts, but I chose to be a teacher knowing that my rewards would come when I confronted my ex-students in jobs that contribute to society and to their families. I am glad I decided to retire when I did, because I would now be hiding my face with shame instead of showing my pride. BISD is now the laughing stock of all the educators in the Valley and maybe even the state and nation and it hurts very much! Board members, what has happened to you and to your promises? BISD has never been perfect in the 26 years that I have been gainfully employed here. Although it is my opinion that that what used to be a proud place to work has turned into a back stabbing, money grubbing, agenda driven hell hole of a bottom feeding pit of criminals that are running (ruining) things now.

It's just my opinion, but in 26 years I've seen alot and this group takes the cake.
