ELECTION NEWS AND BISD

BISD UPDATE:

I am bored with all these nasty comments that I am biased against Jimmy Haynes - reality check - the only reason he has not been fired for refusing of late to cooperate with Enrique Escobedo is the BV verifying and then posting that Jimmy has reported these matters to the FBI.  Even Escobedo is not dumb enough to have Jimmy fired at this point.

The other issue is, I am waiting on these two police reports. Today I was told at least one will be ready tomorrow.   I have not reported something because it is such that lifes could be ruined.  I have demanded that Troy Whittemore verify this person's name or that I see it in the police report.   Troy has lawyered up and is speaking with no one.  Now I have a credible source telling me there will be at least 2 interesting names in the police report.   If this claim is correct, Troy Whittemore's credibility will be in question.

There is no doubt in my mind something happened.  Hopefully Carinos' has a video of what happened because that will be the best evidence.  Unfortunately Hudson Elementary School is the Peyton Place of BISD.  It seems cross accusations exploded outside Carinos.  At this point my advice to both sides is, withdraw your criminal complaints before careers come to an end.  I do not doubt  that some form of assault happened.  But I am of the old school - not every punch merits a complaint.  Sometimes when grown men play like children a take down may be in order.  This is not for the police or a jury to figure out - it is for men to work out as men.

But the greater story remains - it is not about the alleged assault - it is about the nightmare at BISD boiling over to allegedly violent arguments between BISD employees.  This is how I know the end is near.

ORIGINAL POST

I will continue to update the numbers as the day progresses - but I have a busy morning.  I have provided links with all of the numbers.  Yesterday's two posts give you all you need to know - especially as related to problems with the mail ballots.

We cannot expect Armando Villalobos to do his job.  How will he investigate himself and Cookie Covarrubias?  On that note the fact a Poll Watcher accurately eye scanned and estimated Cookie Covarrubias had the most mail ballots does not change the issue of law.  The Poll Watcher broke the law.  Jim Barton who claims to support respect for our vote had no problem aiding this poll watcher in breaking the law.  His intent was clear - to aid Yolanda Begum.  This is no different than what politiqueras do.  The mere fact by eyeing the ballots this poll watcher estimated Cookie Covarrubias had the most mail ballots does not mean there was fraud.  By his own words the poll watcher said he/she did not know the total count.  The key is the total count - not merely having the most.

The BV will demand the SOS and AG investigate all of the mail ballots for fraud and this poll watcher.  We need to know which candidate appointed this poll watcher and whether or not this poll watcher contacted the candidate in addition to Jim Barton.

Jim removed his post and now claims he will post a correction.  Here is his original post - Jim reminds me of an old story my mentor told me.  He was working in the library at the University of Chicago when the Soviets sent a replacement article  for the currently published encyclopedia.  Beria has fallen out of favor so the Soviets wanted the favorable article cut from the books and replaced with a new article on a different subject.  Needless today the University of Chicago refused.

Here is the original post

http://www.docstoc.com/docs/121702511/JimBarton

How CAVA responds to this will tell everyone whether they are about protecting their candidates or protecting the vote.  I did  not have to think for one second to denounce Cookie Covarrubias once the real numbers were out.  I also had no problem questioning Arturo Nelson's mail ballots - I also voted for Arturo Nelson.  Also let's not forget, Tapias signed CAVA's bogus pledge, but appears to have mail ballot problems.  How many people voted for Tapias based on his signing of CAVA's bogus pledge.

BISD

I am told at least one of two police reports related to the alleged Jimmy Haynes assault on Troy Whittemore and his wife will be released by this afternoon.  I will try and get it.  The report should have a nice surprise.  The second report which may not be ready is Jimmy Haynes assault report against Troy Whittenmore's wife.

But here is the scoop - why did Jimmy Haynes leave the scene instead of waiting for the police?  It  does not help your case when you leave the scene  to avoid the police and then run to the police to file an assault report against your accuser.

Because I have no hope the Brownsville PD will do their job or Villalobos will do anything but trash the reports, my advice to Troy Whittenmore is to file a discovery lawsuit against Whittemore and then use the lawsuit to get his bar tab from Carinos, and any video tape Carinos may have of the incident.  It will also allow Troy's attorney to depose the woman Jimmy Haynes was drinking with.  It is my understanding Troy's wife has a video of Jimmy Haynes leaving the scene.

HEALTHSMART PAID THE CITY OF LUBBOCK $4 MILLION DOLLARS FOR THE SAME LAWSUIT OUR TRUSTEES DISMISSED

http://lubbockonline.com/crime-and-courts/2012-04-23/healthsmarts-4-million-settlement-accepted-city-council

Below is an analysis from a Lubbock insider in how the munipal elections and polls influenced Healthsmart's decision to settle before the election.  Those who stood with Healthsmart were sent packing.  The belief is, Healthsmart settled before the election rather than have a less favorable mayor calling the shots

"The settlement came, I believe, because of the pending local elections. The incumbent mayor—thought to be sympathetic with Parker’s side-- was being challenged by a credible mayoral candidate. Another council seat was being vacated and a candidate who had done media consulting for John Barr—Parker’s attorney—and who had tried to get a candidate elected two years ago (a candidate known to be championed by Carlos Quintanilla) announced over a year before the elections that he was running for the opening council seat. With the known relationship with the Parker side and with a credible challenger filing for the seat at 5:00 the day of the filing deadline, this candidate was forced to declare before the election that he would recuse on all Parker/Healthsmart related issues…this made his election moot for the Parker side and he ultimately lost his election. With the rumors running rampant that the incumbent mayor was seriously behind in the polls, the HealthSmart side got very serious about settling their case before the council turned over. We believe that the council rejected one offer. Then the offer for $4,000,000 came and was accepted approximately two weeks before the city elections. The incumbent mayor went on to lose by a 65% to 35% landside. Long story short—it looks like years of legal moves finally came to an end. Two council seats including the mayor turned over…another seat, held by and incumbent thought to be sympathetic to the Parker/HealthSmart side, is in a runoff on June 23 to keep his seat. The newspaper is still wanting to get the audit public just to see the case to closure. The city manager and their outside lawyer seem pleased with the settlement and glad to have it behind them citing just over $2,000,000 in legal fees having been spent on the case (net—Parker paid $850,000 and the insurance company paid $500,000 to settle his own cases in Dallas). Parker paid the city $3,000,000 the day of the settlement with $500,000 payments due in May and June."

On the mail ballot issue, I can only deal in evidence. During the initial stage the total number of mails ballots in terms of % is a strong indicator of fraud. This is the only data we have at this time.

BUT HERE IS ANOTHER AREA candidates need to look at

Someone can have what appears to be a reasonable number of mail ballots and still have been party to fraud.

I strongly recommend every candidate who has a concern about their opponent's use of mail ballots demand they be checked for the following problems:

Let's say a candidate received 25 mails ballots - you need to check to see if [1] in every case the only vote on the ballot was for that candidate and [2] did the ballot show the voter received assistance. If these two variables are in place I will bet the farm the mail ballot was harvested illegally.

In this case it does not matter how small the number of ballots were harvested - those responsible need to be prosecuted.

We must not limit this investigation to only those who won.

I applaud the BISD board majority for living up to their fiduciary duty and giving away millions of dollars of taxpayer money by dismissing the HealthSmart lawsuit. How proud they must be! Citizens, you must exercise your voting rights in November and change the board majority and refile the HealthSmart lawsuit. You should ask what motivation did the majority have in dismissing the lawsuit. You should ask what motivated them to rehire and pay off Rendon? Why are they trying to settle the Gonzales and Juarez lawsuits? All of this has been layed out in the Voice and it is extremely clear that the majority is corrupt. Bid rigging? Escobedo's middle name. Kickbacks? Probably. No doubt that the havoc by the board and our incompetent superintendent has placed staff like Haynes and Whittemorte under such pressure that infighting occurs. As a past administrator I have never been so ashamed of BISD. I know that the FBI is interviewing BISD past and present employees, hopefully will investigate, and bring charges against those deserving. Keep repoting Wightman.

I heard both Mr and Mrs Whittemore were sent home today and Haynes was not. What is up with this?????

"it is for men to work out as men."

Perhaps there is more to the story but it would be best for both gentlemen to leave it as it is. End of story.

Greetings Sir,

After reading your post, I am in the belief that you did not approve of the police department's handling of the Carino's situation. Thanks to God and our many brave servicemen/women, we are all entitled to our own opinion. However, neither you or I were there at the time of the incident. We do not know how many officers were on hand or what the officers on scene had to handle; as I'm sure that arriving to handle something like this may be chaotic.
You say that you do not have faith in the police department. That generalization is quite a put down from an intelligent and well respected person as yourself. It would be like putting down any other organization because of the actions of a few. Saying that you don't have faith in the Army because of the actions of a few soldiers or not believing in teachers because of a few bad apples.
I venture to say that while the department has officers in high positions that may unfortunately make their decisions in a political manner, it is not the fault of the entire department. After many years in this community, I have met many fine officers who have proudly served the department and the community they are sworn to protect.

Blessings,

TJ

Thank you for the manner in which you phrased your concerns.

Maybe I was not clear - I did not mean to say the entire department -my regular posts deal with problems at the administrative level.

In fact if you have read my many posts I am very, very protective of our officers.

I always remind people to mind the police and understand they are here to protect us. But like you said - there are a few bad apples.

Several months ago I did a post wherein the office admitted in his report the 17 year old girl was texting when she ran the light and nearly killed a man on a motorcycle - she was not ticketed for texting - under 18 in Texas it is a crime

I only deal in specific cases when I go after the police - and again when I say the police department I am referring to the administration. I do not trust the administration to deal with the handful of bad apples.

I know there are many officers who are fed up that they arrest people for DWI only to have a higher up reject the report or have the DA drop the charges.

I know this is disheartening for these officers. I will always defend these officers and stand with them.

I have spoken about the great charity work by the BPD Association.

I have been attacked by other social media for defending the police against comments like pig or chorizo.

I greatly appreciate how you phrased your concerns - I wish all comments were as professionally written as yours - but rest assured - while I can see how a reasonable person could interpret what I said the way you did - I did not mean it that way.

Thanks again for your comment

I think things may have gotten a bit out of hand at Carinos between two adults. Maybe this should be left as a private matter between them to resolve.

I hope no one was injured and if egos were bruised then I hope they can all move forward because they are all good people at heart.

As always,
Gracias y que te la pases bien amigo.

I think people who know both sides need to tell them exactly what you said -

But the bigger issue of the BISD boiling over into the public forum is a big story.

Apparently Tuesday's BISD meeting was a nightmare. I finally got to interview people who were actually there. It appears Luci Goosey is done with Presas-Garcia and Atkinson - this battle will go public very, very soon

Luci wants Sylvia out the door now - Luci sees getting rid of Sylvia as a way to safe face for her own sins

This female blood bath should be interesting

Cat fight! Got to love it. And please note that the Super's comments in the Herald report on the Pace Athletic Coordinator Football Coach were juvenile to say the least. There's alot more to the Pace head coach story than is reported. And give us a break, Cata, really "it's all about the kids?" You and your cronies incompetence, self-serving agendas, have cost the Pace student athletes any chance. Don't blame poor interum head coach or anyone else, it is ALL on you. You could have handled this months ago....why didn't you??? Were you using this position as a bargaining chip? Didn't work did it? Words cannot express the contempt these students, parents, teachers and administrators at Pace should have for you. Montoya, you are an incredible joke.

I don't know about you, but I think it would be a great start at saving face.

Go ahead Luci do it, you might end up being a hero.

The district unfortunatley have lost a lot of great administrators and employees as a result of the stipends for early retirement these last two years. It seems that the grownups have left the district and all we have left are attention seeking children.

Ted Parker, John Barr, Carlos Quintanilla, named by a Lubbock insider as instrumental in the HealthSmart fiasco in Lubbock. These are the same people that were confidants and advisors to Cata Presas Garcia while president of the BISD Board. Add Defenbaugh, also associated with them and it is no wonder why the board majority is seen as corrupt. At least Lubbock's city council was not swayed by these con artists. I believe that of the majority 4 at BISD, not all are corrupt, but 1 or 2 incredibly naive and gullible. Due to the recent revilatiion that HealthSmart settled with Lubbock and paid attorney fees and damages, it might be beneficial if one of the majority that voted to dismiss BISD's suit and "gift" 14 plus million to HealthSmart ask to reexamine their incredibly stupid decision. You might be able to save some credibility. And while you are at it, get some immunity from the proper authorities. It is apparent that the majority is not getting along. This with some administrators going to the FBI and spilling their guts leaves this district on very shaky ground. Those that are fed up with the decisions that have been made are finally able to laugh at the majority's scramble to appear in control. Thank you Bobby Wightman

check out this article on John Barr - it tells you why Ted Parker hired him and why is was reliable in working to corrupt the BISD Trustees

http://www.dmagazine.com/Home/1990/05/01/betrayed.aspx

check out this opinion wherein John Barr settles lawsuit brought against him. This man has no conscience

ftp://opinions.ca5.uscourts.gov/pub/93/93-01052.CV0.wpd.pdf

"On September 22, 1988, Grogan, Barr, and one of Barr's law
partners met with appellee Walker, who was in charge of the police
Internal Affairs Division, and charged that Forsyth had engaged in
criminal and administrative misconduct during the undercover
investigation.4

4 The appellants alleged that Barr used the illegally
intercepted conversations to punish Forsyth and Kirks for not
cooperating with him regarding Charles Bruton and Grogan's toxic
waste disposal.
-

The appellants settled their claims against Barr,
Grogan, and the Dulworths;"

John Barr is a very dangerous man and will do just about any thing to protect his clients.

I was fed this story through a very very old post - in fact the headsup came through as a spam - I checked the IP address and it appeared as US government - but I may be wrong - sometimes the exact minute of the post is not accurate and I end up looking at the wrong IP

Why on earth would BISD suspend these people on something that happened on their own personal time away from the district. Is BISD crazy. Are they just totally nuts!!! I do agree that these adults need not to charge each other with assault. Just drop it and concentrate on what BISD is trying to do to you. They are simply adding salt to your wounds. Do Not Give Them That Satisfaction my dears. DO NOT!!!
