IT IS TIME CRIMINAL CHARGES ARE FILED AGAINST CARL MONTOYA AND SYLIVA ATKINSON

Troy Whittemore, his wife  and Jimmy Haynes are on solid ground if at this time they file criminal charges against Carl Montoya and Sylvia Atkinson for civil rights violations.  In fact, in my opinion, with the FBI fully aware of what is happening would be remiss in their duties if they did not initiate the criminal investigation against these two puppets of the corrupt 4.

Summary:

    Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States. For the purpose of Section 242, acts under "color of law" include acts not only done by federal, state, or local officials within the their lawful authority, but also acts done beyond the bounds of that official's lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim.
    The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.
TITLE 18, U.S.C., SECTION 242
    Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnaping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

WALLS OF BISD ARE COMING DOWN
TO THE TRUMPETS OF JUSTICE - PART 2

The battle between Troy Whittemore and Jimmy Haynes is heating up. I have confirmed BISD suspended both Troy Whittemore and his wife. I have no confirmation of Jimmy Haynes' status.  Some say he has been suspended, while others are saying people in his office state he is unavailable for appointments at this time.

I was thinking about dropping this story until I got a phone call advocating for Jimmy Haynes.  I was happy to take the call.  Before I get into what this person wants people to know, I want to talk about something else this person said.   This person told me that in  April 2009,  Presas-Garcia called Troy Whittemore as a member of the Planing and Zoning Board and threatened him as a BISD trustee if he did not approve a project she had an interest in as a realtor.  Yeah, that would be a crime.  I do not know if it is a  felony or a misdemeanor.  But if I were Troy Whittemore I would certainly take any contemporaneous evidence I have and demand a  full investigation by the Office of the City Attorney and the BPD.  Let them sort it out.

It seems to me Presas-Garcia used the assault incident to justify punishing Troy Whittemore for what happened in 2009.  In the end she got what she wanted because the City Commission overruled the Planing and Zoning Commission. 

Here is the thing - all of these administrators lose their cases because they hire local attorneys who have  close to zero knowledge of the law.  Troy Whittemore can literally sue BISD today for retaliation and harassment.  Both claims form a basis for Troy to avoid the Administrative Procedure Act.  The exceptions to abstention are well documented.  It is 100% illegal to to suspend someone from their job as a public employee for filing a police report, or for refusing to give into the demands of a corrupt BISD trustee.  I am so certain of this, BISD's insurance company would most certainly give BISD an ultimatum - reinstate Troy Whittemore and his wife or they will refuse a defense for BISD.

But this is why BISD gets away with this - the local attorneys have zero knowledge of the law.  Through their incompetence they allow this corrupt school board and their trained monkey Carl Montoya, to use the administrative process to build a bogus case.  It is absolutely futile for any of these administrators win under the administrative process.  Competent counsel, meaning not in Cameron County, know that the exceptions to the APA allow them to get into federal court now - not 6 months from now - as they languish in limbo pay their attorneys to accomplish nothing.
On to Jimmy Haynes - some of what his advocate told me was just too bizarre and is in fact the type of advice an attorney gives their client which gets their client indicted.  I will not get into those claims because they are not coming directly from Jimmy Haynes.  A part of this story, I have withheld because I wanted to see the witness's name in the police report first.  This advocate for Jimmy Haynes told me that Julie Salinas, another administrator at Hudson Elementary school, was at Carinos with Jimmy Haynes.  This advocate for Jimmy Haynes is confirming she was their.  But this person is also saying Jimmy Haynes' police report will confirm Julie Salinas' husband was also there.

I have seen the log in sheet verifying this, Jimmy Haynes is seen on a regular basis visiting Hudson.  This has caused a lot of stress among the Hudson staff as an atmosphere of Peyton Place seems to be in place.  I have spoken to no one who is claiming an affair.  The only person who knows the truth is Julie Salinas' husband - he knows whether or not he was at Carinos.  I am told that after the incident she walked to the car by herself and that her husband was no where to be seen.  I was told this the first night when the story broke.  In my view he could have already been in the car, or maybe still at  the bar paying for the tab, or using the bathroom.  But it is Jimmy Haynes' advocate who wants everyone to know that he was not alone with Julie Salinas but in fact with both Julie and her husband.  I am publishing this only because it is Jimmy Haynes who is asking that people know this so as to stop the rumors.

If Jimmy Haynes was also suspended his attorney would be nuts to not immediately sue BISD for retaliation for Jimmy Haynes going to the FBI.  BISD has no business interfering with criminal complaints.  If public employees are made to believe they can be suspended for filing assault charges, or going to the FBI with criminal complaints against Trustees then no public employees will ever file criminal charges.  I am 100% certain Judge Hanen will take BISD to task for this.  I am also  certain BISD's attorney as hired by the insurance company will make known to BISD they will not defend BISD under these facts.

This is the lie Yolanda Begum had posted yesterday by her henchman, Jim Barton, against Erin Garcia.  Now let's test the lie to reality and facts.

In the mayor's race wherein Ahumada beat Ernie Hernandez, Ernie Hernandez did in fact run a large mail ballot campaign in round one.  Once again Jimbo Barton proves there is no lie or deception he will not tell or run to protect the dishonest and vile Yolanda Begum.

Now Jim will say what he said is not a lie, because he did not say it - he was just quoting a liar. Now there is a standard for ethics.

Jim claims a poll watcher told him Cookie Covarrubias had the most mail ballots in addition to providing the names of the politiqueras who signed the ballots.  I took Jim at his "word" and called for an investigation based on what he said and no one else.  He then deletes the post thinking he can hide the evidence and then attacks me with distractions which have nothing to do with the story.  Why?  he is running cover for the dishonorable vile and pure evil Yolanda Begum. 

Had Erin Garcia not entered the race no one would have given Yolanda Begum the time of day.  She is not qualified at any level.

At no time does he present any evidence that anyone knew anything to indicate Cookie Covarrubias would use politiqueras, which for the record has not been proven - although I believe it based on what I now know.  I endorsed Cookie based on qualification and Jim Barton cannot refute this so he uses distractions and lies.

In fact he now claims the allegations were not by a poll watcher (so you lied  for effect Jim?) but just a rumor - a rumor which turned out to be 100%  correct and could only have been made by a poll watcher.  The investigation will move forward not withstanding Jim's boorish recanting of his original claims.  Only Jim and those he drinks with believe his explanation.

Every day the BV  rejects outrageous claims against Jim and his wife, Montoya, Erasmos Castro and Jerry McHale - why? because they are all distractions.  Unfortunately when Jim cannot refute claims made against him he jumps to the distraction and then allows for any false or defamatory statement any one wants to post in support of his distraction.  This is boorish,  It is unethical.  But like he said - you cannot get blood  from a turnip so he is not concerned with being sued.  This is a very, very dangerous form of ethics.  In reality it means he has no ethics.

Yolanda Begum is in for the fight of her life if she fails to denounce Jim's conduct and the vile conduct of her supporters.  She cannot fight this campaign on the merits so she has turned to vile evil people to fight dirty in her name.  Yolanda Begum is one very dishonorable person and has no standing to speak ill of the Hernandez family.  Birds of a feather are not entitled to speak ill of one another

WHY POLITIQUERAS WORK THE SHERIFF'S, DA'S AND JP RACES FOR FREE

Linda Salazar did not pay the politiqueras to work the mail ballots.  They do it for free.  Sometimes they do it for free without any prodding by any candidate.  The politiqueras sometimes work the campaigns based on promises by the candidates, and sometimes they work the campaigns as a gamble as to which candidate will help them earn money on the side.

Four years ago I documented a  conversation I had with Sheriff Omar Lucio at Coyote Canyon (back when the food was eatable).  I asked him about the politiqueras and he told me there is no need to pay them.  He told me they work his race, the DA's race and the JP races for favors.  It is about tickets.

I will bet the farm that if someone were to pull a list of the number of tickets dismissed or reduced in Linda Salazar's court it would shock people.  The key is to see which ones were done without a hearing and simply dismissed sua sponte by Linda Salazar.  According to Omar Lucio the politiqueras bring him the tickets and he has them dismissed.  The same for the JP courts and the DA.  The accused wrongdoers then pay the politiqueras for getting the ticket dismissed or criminal charges dropped or reduced.

I documented this four years ago.  No group came forward to act.  The people at the court house know how it works.

The mess continues because people celebrate their ignorance and lies.

Such as Jim Barton has changed his story and has attacked me for having relied on his original story, CAVA has made it clear it will not support an investigation against the poll watcher.  Why?  We all know why?  It will expose Yolanda Begum. 

CAVA is a con origination using the tragedy of the harvesting of the mail ballots to help Ruben Peña settle a personal score against the Hernandez family.  I agree 100% Ernie stole the election from Ruben.  This I do not dispute - but when CAVA refuses to back an investigation against a poll watcher who clearly broke the law honorable people ask why.  The answer is - to expose the truth about Yolanda's poll watcher could help Erin Garcia and in the realm of settling this personal score for Ruben Peña anything which could help Erin Garcia is to be ignored - even if it means CAVA supporting illegal conduct.

Since the company doing the EIS is not a neutral party (hired by SpaceX) I wanted to make sure that we had the correct submission information.
I spoke to Jackie Johnson of Cardno Tec today, she is the project manager in charge of the gathering the information for the EIS. All the email submissions go straight to her. Stacey Zee is with the FAA but they listed her name in the brochure with Cardno Tec's info, that's where the confusion came in. She said the FAA's server couldn't handle the volume of submissions they expect to receive.

Jackie said the study will likely take until the end of the year. When the Draft EIS is completed another meeting will be held at that time. She thinks the entire process will take approximately a year and a half.

However, you MUST email and ask to be sent a copy of the Draft EIS. It will be sent out in the form of a disc. They will not automatically send you one unless you specifically request one.
Today May 30 is the deadline.

All of our elected officials have supported this project without our knowledge or consent. Please copy them on your FAA submissions and direct questions, concerns and comments. I called all three of their offices to register my opposition yesterday. SpaceX will not benefit Brownsville, I don't care how you slice it. By the way, if they succeed in moving out to Boca Chica, this DOES NOT pave the way for more businesses out there. In fact, quite the opposite as they are looking to buy up whatever land they can get their hands on to guarantee that no one is nearby.
The one big problem with that? Their presence will limit our access to Boca Chica beach. Twelve launches a year is merely an estimate.
By the way, the Texas Open Beaches Act was amended in 2009 to uphold and further guarantee public access to our state owned beaches and was then made a part of the Texas Constitution. Senator Juan "Chuy" Hinojosa from the Upper Valley, sponsored the measure.
Additionally, according to one department head at UTB, SpaceX's presence here does not automatically guarantee more high paying jobs for Brownsville. Most of the jobs will likely be filled by people from outside the area since we do not have the appropriate training locally.

ELECTION NEWS AND BISD

BISD UPDATE:

I am bored with all these nasty comments that I am biased against Jimmy Haynes - reality check - the only reason he has not been fired for refusing of late to cooperate with Enrique Escobedo is the BV verifying and then posting that Jimmy has reported these matters to the FBI.  Even Escobedo is not dumb enough to have Jimmy fired at this point.

The other issue is, I am waiting on these two police reports. Today I was told at least one will be ready tomorrow.   I have not reported something because it is such that lifes could be ruined.  I have demanded that Troy Whittemore verify this person's name or that I see it in the police report.   Troy has lawyered up and is speaking with no one.  Now I have a credible source telling me there will be at least 2 interesting names in the police report.   If this claim is correct, Troy Whittemore's credibility will be in question.

There is no doubt in my mind something happened.  Hopefully Carinos' has a video of what happened because that will be the best evidence.  Unfortunately Hudson Elementary School is the Peyton Place of BISD.  It seems cross accusations exploded outside Carinos.  At this point my advice to both sides is, withdraw your criminal complaints before careers come to an end.  I do not doubt  that some form of assault happened.  But I am of the old school - not every punch merits a complaint.  Sometimes when grown men play like children a take down may be in order.  This is not for the police or a jury to figure out - it is for men to work out as men.

But the greater story remains - it is not about the alleged assault - it is about the nightmare at BISD boiling over to allegedly violent arguments between BISD employees.  This is how I know the end is near.

I will continue to update the numbers as the day progresses - but I have a busy morning.  I have provided links with all of the numbers.  Yesterday's two posts give you all you need to know - especially as related to problems with the mail ballots.

We cannot expect Armando Villalobos to do his job.  How will he investigate himself and Cookie Covarrubias?  On that note the fact a Poll Watcher accurately eye scanned and estimated Cookie Covarrubias had the most mail ballots does not change the issue of law.  The Poll Watcher broke the law.  Jim Barton who claims to support respect for our vote had no problem aiding this poll watcher in breaking the law.  His intent was clear - to aid Yolanda Begum.  This is no different than what politiqueras do.  The mere fact by eyeing the ballots this poll watcher estimated Cookie Covarrubias had the most mail ballots does not mean there was fraud.  By his own words the poll watcher said he/she did not know the total count.  The key is the total count - not merely having the most.

The BV will demand the SOS and AG investigate all of the mail ballots for fraud and this poll watcher.  We need to know which candidate appointed this poll watcher and whether or not this poll watcher contacted the candidate in addition to Jim Barton.

Jim removed his post and now claims he will post a correction.  Here is his original post - Jim reminds me of an old story my mentor told me.  He was working in the library at the University of Chicago when the Soviets sent a replacement article  for the currently published encyclopedia.  Beria has fallen out of favor so the Soviets wanted the favorable article cut from the books and replaced with a new article on a different subject.  Needless today the University of Chicago refused.

How CAVA responds to this will tell everyone whether they are about protecting their candidates or protecting the vote.  I did  not have to think for one second to denounce Cookie Covarrubias once the real numbers were out.  I also had no problem questioning Arturo Nelson's mail ballots - I also voted for Arturo Nelson.  Also let's not forget, Tapias signed CAVA's bogus pledge, but appears to have mail ballot problems.  How many people voted for Tapias based on his signing of CAVA's bogus pledge.

I am told at least one of two police reports related to the alleged Jimmy Haynes assault on Troy Whittemore and his wife will be released by this afternoon.  I will try and get it.  The report should have a nice surprise.  The second report which may not be ready is Jimmy Haynes assault report against Troy Whittenmore's wife.

But here is the scoop - why did Jimmy Haynes leave the scene instead of waiting for the police?  It  does not help your case when you leave the scene  to avoid the police and then run to the police to file an assault report against your accuser. 

Because I have no hope the Brownsville PD will do their job or Villalobos will do anything but trash the reports, my advice to Troy Whittenmore is to file a discovery lawsuit against Whittemore and then use the lawsuit to get his bar tab from Carinos, and any video tape Carinos may have of the incident.  It will also allow Troy's attorney to depose the woman Jimmy Haynes was drinking with.  It is my understanding Troy's wife has a video of Jimmy Haynes leaving the scene.

Below is an analysis from a Lubbock insider in how the munipal elections and polls influenced Healthsmart's decision to settle before the election.  Those who stood with Healthsmart were sent packing.  The belief is, Healthsmart settled before the election rather than have a less favorable mayor calling the shots

"The settlement came, I believe, because of the pending local elections. The incumbent mayor—thought to be sympathetic with Parker’s side-- was being challenged by a credible mayoral candidate. Another council seat was being vacated and a candidate who had done media consulting for John Barr—Parker’s attorney—and who had tried to get a candidate elected two years ago (a candidate known to be championed by Carlos Quintanilla) announced over a year before the elections that he was running for the opening council seat. With the known relationship with the Parker side and with a credible challenger filing for the seat at 5:00 the day of the filing deadline, this candidate was forced to declare before the election that he would recuse on all Parker/Healthsmart related issues…this made his election moot for the Parker side and he ultimately lost his election. With the rumors running rampant that the incumbent mayor was seriously behind in the polls, the HealthSmart side got very serious about settling their case before the council turned over. We believe that the council rejected one offer. Then the offer for $4,000,000 came and was accepted approximately two weeks before the city elections. The incumbent mayor went on to lose by a 65% to 35% landside. Long story short—it looks like years of legal moves finally came to an end. Two council seats including the mayor turned over…another seat, held by and incumbent thought to be sympathetic to the Parker/HealthSmart side, is in a runoff on June 23 to keep his seat. The newspaper is still wanting to get the audit public just to see the case to closure. The city manager and their outside lawyer seem pleased with the settlement and glad to have it behind them citing just over $2,000,000 in legal fees having been spent on the case (net—Parker paid $850,000 and the insurance company paid $500,000 to settle his own cases in Dallas). Parker paid the city $3,000,000 the day of the settlement with $500,000 payments due in May and June."

I will be compiling results from the Cameron County Elections Office, the Secretary of State's office, and the Herald.  As the night progresses I will probably update to a larger list of the Congressional Candidates, for now I am only the top four vote getters. In the mail ballots if I see an usual number I will make a notation that an investigation is needed.  Not that reality matters to some people, mail ballots are not illegal.  My first indicator of a problem is when someone gets 20% of the early vote, but 30% of the mail ballots.  These is an example of the variables I look for.   The sequence of the names is right off the sample ballot.

As you  can see, this is a lot - if I missed something important to you let me know.

In this race Cameron county will only be reporting the returns for Cameron county.  This race extends far north of Cameron county.  This is why I will be looking to the returns posted by the Secretary of State.

Click above for early returns - I have no way of knowing which county reported early voting - but in that county Vela has a solid lead - with Garza coming in second.  The % are holding - appears may be a run-off between Garza and  Vela, but Troiani's numbers appear to be improving  Villalobos is going no where - these numbers really mean nothing at this point.  - Lets see how they change once Cameron County reports -

ROGER ORTIZ FORWARDS COMPLAINT TO DA TO INVESTIGATE POLL WATCHER WHO LEAKED INFORMATION AND IN  FACT LIED

I have interviewed Roger Oriz on the issue of an alleged poll watcher releasing information to Jim Barton.  To be clear, based on what I know CAVA stands for anything but Citizens Against Voter Abuse.  CAVA was warned to choose its associates carefully.  CAVA seems to think they are above the law.  They are not.  CAVA and their supporters need to be taken to task.

The integrity of the electoral process includes poll watchers not violating the law.  This will be a test of CAVA to see if they denounce this poll watcher, Jim Barton, and Yolanda Begum if it is shown her chosen poll watcher made the false claims.

For the record, I would not have signed CAVA's pledge - it was and remains a bullshit pledge by a con-artist organization using the tragedy of ballot harvesting to push their candidates.  CAVA is no better and perhaps worse than the politiqueras because by fraud they claim to be otherwise.

The only coward is Jim Barton who as part of his bizarre support for Yolanda Begum posted false accusations by a poll watcher who clearly violated the law.  What does it say about Yolanda Begum when her henchmen are willing to violate the election code to get her the win?  It says her henchmen are politiqueras of the worse sort.

To be clear, the fact the accusations are false does not mean once we see the real numbers, after the ballots have been really counted, the count will show Covarrubias did receive the most mail ballots.  A lie does not become truth because eventually once the count is done the lie by chance becomes truth.  It was still a lie when told.

Roger Ortiz told me that no count of the mail ballots has been done and that the following statement in Barton's story is 100% false, because no numbers exist.

"Now, a poll watcher has sent this observation: "I'd say that Cookie Covarrubias had a majority of the mail-ins. Thomasita Chavez and Adriana Garza were the names listed as the "assistants" on most of these ballots."

Roger Ortiz read the claims as alleged by Barton and is now forwarding them on to the DA for criminal investigation.

I have completed the criminal complaint for the Office of the Secretary of State. 

For arguments sake, I will assume at least part of the post is true.  Anyone who knows me knows I have no sacred cows.  I  fully support every mail ballot being investigated for fraud.  Let the axe fall where it falls.  I do not care who the candidate is, I fully support criminal prosecution against any candidate who harvests mail ballots.

Roger Ortiz also said there is no way any poll watcher would be able to know who got the most votes.  Roger Ortiz also told me that any such report by a poll watcher would be a violation of their oath.  There is a process which is to be followed and this poll watcher did not follow it.  Further, poll watchers agree to not work with any campaign while performing their duties.

Yolanda Begum who has used Jim Barton to run her dirty vile campaign since day one chose two of the poll watchers.  It will not take much investigating to see which one violated the law.

This will certainly be an issue in the run-off campaign, assuming the people of Cameron county fell for her politics of shiny objects  campaign.  People, Yolanda Begum is a vile and evil person.  She has supported her relatives being called whores, adopted children being less valuable to the family than biological children, and implying Erin Garcia went to a black student body law school.

MESCALERO SPEAKS
 IN DEFENSE OF BOCA CHICA

Editor's Note:  The BV would oppose any utility development of the area.  The problem is a viable solution.  You cannot preserve Boca Chica if people are not educated about its beauty and unique plants, animal life etc.  Once you educate them, they will want to preserve it, but also go to the beach.  This will cause some additional damage.  While it is illegal to ride in the dunes it is done all of the time because there is no one from the county enforcing the law. 

I am not sure I have a problem with an entrance fee to Boca Chica.  By having a county employee charging a fee it will also allow the county to better bar any sports vehicles from the beach.  I also have no problem with the county charging a garbage bag fee the visitor gets back when they bring back the garbage bag filled with their trash.

All of the above are proactive things the county can do to preserve this treasure.  Far too many of the people who use Boca Chica have proven themselves to be bad stewards of Boca Chica.  I am so tired of seeing how people disrespect this treasure - so in my mind a fee which has the effect of protecting Boca Chica would be a good thing.

I hope more people will come forward and defend Boca Chica.  Different people might disagree about the mechanics of defending Boca Chica, but what is important is that we stand together to prevent any development, beyond that which is needed to protect this natural treasure the beach.

HERE IS MESCALERO'S DEFENSE OF BOCA CHICA


Exactly as I feared. Already hopes that if utilities are extended to Boca Chica we can get some of those "projects" developed. Let's put up some historical centers and a visitor's center. We will then need bathrooms and maybe a snack bar and on and on it will go. And, to pay for the centers and upkeep and to repair all the vandalism, we will need a beach access fee. It might not be Padre Island but it won't be Boca Chica.

And the same goes for Palmetto Hill. Check out how degraded the habitats are out there and yet they hold so much life. Any construction will probably be on the higher elevations known as lomitas (little hills) to avoid flooding. These lomitas are a biologically unique area in the world. Not another inch should be cleared. And the same for the coastal prairie out there. In the alternative I would suggest an information center somewhere in the vicinity of the border patrol checkpoint with monuments at the actual sites. By keeping any buildings in one spot it minimizes the impact on the environment and probably reduces construction costs. Being near the checkpoint may redue vandalism.

Also, it is a false statement to say that Boca Chica will never become Padre Island. I've lived here long enough to have hung out on the Island when there were only three free standing restaurants and only a small handful of hotel/motels and look at it now.

THE PEOPLE OF BROWNSVILLE EXPECT ALL SIGNS TO BE TAKEN DOWN BY WEDNESDAY, UNLESS YOU ARE IN A RUN-OFF

I am so happy that the taking down of the signs is about to begin.

My predictions on the race is - Maria de Ford will be in a run-off - with whom - I do not know.  Cameron county has a large number of retired females and they tend to vote for female candidates.  I would normally say this would pretty much only guarantee either Erin Garcia or Yolanda Begum in the run-off, but there are so many men in the race it is any one's guess.

Sheriff Lucio has a good chance of winning out right - if he does not I expect he will have well over 40% of the vote.

The Congressional race is any one's guess - I predict one man one woman in the run-off.  The male spot is going between Ramiro Garza or Filemon Vela.  Villalobos and Troiani have long been out of the race.  Monday Troiani's campaign was reduced to taping torn pieces of paper to mailboxes asking for votes.

Sylvia Benevides will win for two reasons - the advantage with the female voters, and the fact her opponent did not run a campaign

I predict Arturo Nelson will win with no problem.  Veronica Farias ran one of the most vile campaigns I have ever seen.  And not that reality or actual knowledge of the law matters to Veronica Farias, an expunged criminal record does not bar me from using press reports or archived files I have on her in a political ad.  She is either mindbogglingly ignorant of the law of so unethical she has lost all sense of reality.  For the record I did not run the ad, but from my personal files I could have documented everything in the ad.  The expungment of a criminal record does not include the files of private citizens.

I have no idea who will win in the Cornejo-Lopez/Rubane match up.  Almost every lawyer I know has a very low opinion of Cornejo-Lopez.  In Cameron county she has the Latina name going for her, but a lot of people do have her associated with Limas and Rosenthal - so who knows.

I was lucky in that I got to vote in the JP race and constable race.  I voted for Avila for constable and Covarrubias for JP.  Avila should at least be in the run-off.  As to Covarrubias, I do not know. There are too many men in the race to impact the split in female voters for Garcia and Begum.


ANOTHER LOST HOLIDAY

This is another holiday lost to form over substance. The politicos will go out and proclaim gratitude to those how have given their lives for our freedom.  What have they done to prove they care about our freedoms? Until the Brownsville City Commission restores our right to Freedom of Speech - here is a new rule - they do not get to participate in Memorial Day celebrations.

I LOVE WHEN A MORON POSTS A CHALLENGE

A moronic anony poster while salivating and getting a woody challenged the BV to post his pathetic comment that the alleged assault at Carinos is only a class c misdemeanor.  This person actually believes no one would bother to check.

If the matter goes before Ben Neece I would  fully expect him to  convert the assault to a class c.  Ben Neece is an intricate player in the corruption at BISD.  I can assure you his name has been discussed extensively with investigators.  Let's not forget the Texas Commission on Judicial Conduct continues to investigate Ben Neece for allegedly converting Juan Montoya's alleged  felony DWI's to misdemeanors.

If Jimmy Haynes is arrested and brought before the municipal court, Ben Neece would do well to recuse himself.

Now dude, are you still feeling good about opening this door for discussion?

Now for the triviality of the law.

Sec. 22.02.  AGGRAVATED ASSAULT.  (a)  A person commits an offense if the person commits assault as defined in Sec. 22.01 and the person:

(C)  in retaliation against or on account of the service of another as a witness, prospective witness, informant, or person who has reported the occurrence of a crime;

Depending on how the investigation pans out, Jimmy Haynes could be looking at either a Class A misdemeanor or even a felony charge.

Let there be no mistake - the BPD is going to blow this off, but even if they do not Armando Villalobos will make sure it goes away.  Remember this is Brownsville where in our police department takes pride in its lack of enforcement of Domestic Abuse laws.  A woman was allegedly assaulted here.  To the Brownsville PD  - this a the normal community standard so no  crime was committed.

CLARKSVILLE, TX (CAMERON COUNTY)

CLARKSVILLE, TEXAS (Cameron County). Clarksville was near the mouth of the Rio Grande, opposite the Mexican city of Bagdad. During the Mexican War a temporary army camp stood there, with William H. Clark, a civilian, in charge. Clark set up a country store and served as agent for the steamship lines using the port. The town quickly developed; houses were built up on stilts to be above high water. During the early part of the Civil War Clarksville thrived on the trade of the Confederate blockade-runners, but in 1863 it was captured by federals, who held it most of the time until the end of the war. The last battle of the war was fought four miles away at Palmito Ranchqv. In 1867 Clarksville was almost destroyed by a hurricane but survived during the days of the river steamer. In 1872 it received another blow when the railway was built from Brownsville to Point Isabel, and severe storms in 1874 and 1886 finished it. In 1953 the river had changed its course and flowed over the site of Clarksville.

I did not know this about Clarksville.  There needs to be an historical marker placed at the mouth of the river making note of this.  It would be awesome if a properly sanctioned archaeological dig could be organized to bring life back to this very important city in terms of America's civil war history.  This is something tourist would go see.

THIS CARTOON MAKES MORE SENSE THAN THIS MORNING'S POLITICAL ADS

And before I hear it, no I did not buy the Herald - a 3rd party made the ads available to me.  My dogs Buster and Keaton are trained to steal the neighbor's paper and bring it to me while I have my morning coffee.

One ad I did like was former Judge Garza's ad explaining the truth about what happened in Judge Nelson's court and calling out Vernica Farias.  Maria De Ford ran an honest ad about herself.  It may not be obvious to her, but her nursing background does give her an advantage in examining the true value of a lot of the forensic evidence in rape and murder cases. 

Beyond that the rest of the ads were dishonest and misleading.  Oh, maybe I missed one other honest ad.  Let me tell you something about attorneys missing hearings - happens every day.  The judges do not check with lawyers to see if they have a trial  or hearing in another court set for the same day.  There is a general set of rules as to which hearing or trial comes first.  The fact an attorney does not appear at a hearing by itself means nothing.  Further, judges will appoint attorneys and then withdraw the appointment based on a request from the attorney, the inmate, or based on an attorney not being able to attend court.  Cornejo-Lopez in this ad proved herself to be particularly deceitful.

DO YOURSELF A FAVOR - JUST IGNORE THE ADS

Oh, Ed Stapleton talking ethics is like a Klansman talking about the importance of racial equality.  Let's see Ed's record of late:  In the Bob Hedrick child pornography case Stapleton argued  that our courts should declare that based on contemporary community standards it is okay to privately possess child pornography.

Yolanda Begum, do you agree with your political hack?  Does Brownsville's community standard make it okay to privately posses child pornography?  Yolanda the people want to know - do you agree with Ed Stapleton or such as the rest of Brownsville, do you find Ed Stapleton to be as vile.

Then Ed in what caused lawyers all of Brownsville to laugh to a near state of a coma suggested that Charlie Atkinson as a possible enemy of Bob Hedrick may have been behind a plant of the child pornography on Hedrick's computer.  The only problem with Stapleton's argument was, the events concerning Charlie Atkinson took place after the FBI had already caught Hedrick with the child pornography.

Do tell Yolanda Begum - have you promised Ed Springton he can get away with this kind of vile and dishonorable conduct in your courtroom?

WALLS OF BISD ARE COMING DOWN TO THE TRUMPETS OF JUSTICE

BREAKING NEWS:

JIMMY HAYNES ALLEGEDLY ASSAULTS TROY WHITTEMORE AND WIFE AT CARINOS

Troy Whittemore is on the phone telling me that Jimmy Haynes also assaulted his wife.  The allegation is Jimmy Haynes had alcohol on his breath. The Brownsville police officer was made aware of this and refused to chase Jimmy Haynes as he fled the scene.  The allegation is the police arrived less then a minute after Jimmy Haynes fled the scene.  Witnesses claim he appeared intoxicated.  If this allegation is true, then the police officer allowed for an angry drunk  driver to get on the highway back to Harlingen.  There must be an investigation. 

On the police officer, the chief of police needs to investigate the matter and if found to be true that the police officer was told Jimmy Haynes appeared intoxicate the police officer needs to be suspended pending a further investigation.  The Brownsville PD and DA Villalobos have a very lax attitude about DWI.  Until we have a police chief willing to force his/her officers to enforce the law on this issue our streets will not be safe.  The witnesses are saying Jimmy Haynes only had a 45 second lead on them.  In any city but Brownsville the police would have pursued Jimmy Haynes.  But this is Brownsville where children drive drunk and kill themselves and friends.  Why? - because on this issue far too many police officers refuse to enforce the law, and we have a feckless mayor.

The BV verified for the 3rd time current BISD administrators have met with the FBI. Within the last 2 hours or so, it is being reported by eyewitnesses that Jimmy Haynes, BISD Purchasing  - (Correction Operations not Purchasing)  Assistant Superintendent  - who has claimed Escobedo ordered him to make changes on the BAC contracts - allegedly assaulted Troy Whittemore, AA Paredes Elementary school (correction Hudson not Paredes).  The event occurred at Carino's restaurant. 

It is being reported that Jimmy Haynes accused Troy Whittemore of being the source who has been leaking Jimmy Haynes claims about alleged contract rigging and going to the FBI.  I can say with 100% certainty this is the first I have heard of Troy Whittemore being involved in any of this.  My source as to the claims against Enrique Escobedo was from a friend of Haynes who claims Haynes told him directly - and it was not Whittemore.  Jimmy Haynes might want to check with his attorney about the leaks.  I have no idea who his attorney is, but in Brownsville attorneys are like cackling hens - nothing is secret.

I have numerous sources telling me all hell has broken out at BISD, and Presas-Garcia and Loosey Goosey Longoria are determined to pay off Antonio Juarez and Hector Gonzales immediately.  It is also my understanding that the FBI is now monitoring every post on the BV and are fully aware of the threats by some of the corrupt board members to make Aguilar and Colunga pay their own attorneys  fees if they do not agree to settle the lawsuits with Juarez and Gonzales.  This is a crime.  It would not surprise me if the FBI has adviced Aguilar and Colunga to give in so as to justify immediate action by the FBI against those board members who have made the threat and Antonio Juarez and his lawyers.

But pay attention people - my sources are telling me that Cadillac Cata and Loosey Goosey are unmoved by any reporting at the BV and that  they fully intend to move forward with their plans. It is once again on Tuesday BISD's agenda.

In the story which follows we know the name of the company we believe to be part of the contract rigging.  We know the names of the owners, subcontractors and "consultant" advising them.  Restated, we know all of the players.  These documents along with the law have been forwarded on to my source who is the go between myself and the former and current BISD administrators meeting with the FBI.  Although this morning I learned the FBI may have already been turned on to this deal.

The key provision below requires that "the board must require that the cost savings projected by an offeror be reviewed by a licensed professional engineer."

In the Third Addendum ¶ 4  states no engineer has been assigned.  Why?

Now, BISD  can come back and say, "well we will assign an engineer once all of the bids are in."  Inside sources are saying this issue was discussed and a high level administrator specifically ordered that no engineer be brought in.  I am not using the name of the administrator because my source is secondary and not primary.  In a matter such as this, I want to hear from the BISD employee who is alleging this administrator ordered the engineer be kept out.


ENGINEER REQUIREMENT

"(i)  Before entering into an energy savings performance contract, the board must require that the cost savings projected by an offeror be reviewed by a licensed professional engineer who has a minimum of three years of experience in energy calculation and review, is not an officer or employee of an offeror for the contract under review, and is not otherwise associated with the contract.  In conducting the review, the engineer shall focus primarily on the proposed improvements from an engineering perspective, the methodology and calculations related to cost savings, increases in revenue, and, if applicable, efficiency or accuracy of metering equipment.  An engineer who reviews a contract shall maintain the confidentiality of any proprietary information the engineer acquires while reviewing the contract."

Of further note, which we are following, is the bond requirement. I am hard pressed to believe that any bond company would provide a bond without strict compliance with the education code on the issue of the engineer.  So they either provide the engineering report, or they waive the bond requirement.  Is this reality evidence the story is suspect or evidence of the level of incompetence of Carl Montoya?

THE BOND REQUIREMENT

"(e) Before entering into an energy savings performance contract, the board shall require the provider of the energy or water conservation measures to file with the board a payment and performance bond relating to the installation of the measures in accordance with Chapter 2253, Government Code. The board may also require a separate bond to cover the value of the guaranteed savings on the contract."

Nonetheless, I think what has BISD insiders concerned are the players.  This is what brought this to the attention of the insiders and my source.  The good news is we have insiders now feeding us contract information which could be related to contract rigging.  Everything is immediately forwarded to my source who is working with those meeting with the FBI.

You should also know addenda 1 and 2 were extensions of time to file bids.  For whom did they provide the extensions?  Well, we know.
