ANOTHER DAY OF HOLIDAY

I need just one more day. The hormone therapy was going well and the fatigue was starting to go away. My next injection is Thursday so I will not be able to attend the Pan Am event. I always feel better the day after the injection. Anyway, yesterday I slept all day and got nothing done. I promise the BV will be back on Wednesday.

BUT SOMETHING QUICK ON ZAVALETTA AND IS FRIVOLOUS MOTION IN THE LIMAS CASE

Ed Stapleton once again proves he practices law by winging it. He does this because of the corruption and incompetence of the Cameron County judges. Which I find interesting because he files this frivolous motion for Peter Zavaletta, in the defamation case because of Limas' corruption, expecting Judge Alejandro to just ignore the law, or face an allegation he is protecting Limas. The entire point of the motion is to use the judicial corruption as a tool to win.

On the issue of the Judge Limas, judges have "absolute immunity" for all acts taken as judges - even when they use the bench to engage in criminal conduct. I have been fighting this ruling by the Supreme Court for 20 years. Zavaletta and his drunk mouth piece have accused me of everything under the sun for fighting this ruling. Now poor old little Peter is the victim and he wants the court to ignore the Supreme Court.

Judges are immune even for damages incident to criminal conduct as a judge. A state judge can be found criminally liable under 242 although that judge may be immune from damages under 1983. See Imbler v. Pachtman, 424 U.S. 409, 429 (1976); O'Shea v. Littleton, 414 U.S. 488, 503 (1974).

This is pretty basic law - and what we see in Ed Stapleton's care for the law is no care - which is why in the Rubio case he failed to file a timely mandamus in his ballot access case for TSC. Guys our courts are corrupt because lawyers like Ed Stapleton just wing it and use their name to get what they want. He sees no need to check the law before he acts - why? because our judges are corrupt and incompetent. He knows it and he uses it to his advantage.  The AG has to represent Limas on the issue - lets see how well Ed does when the same lawyer who will represent Alejandro explains to Alejandro judges are absolutely immune from damages for criminal actions while done as a judge.

Just one of the many con-jobs the US Supreme Court has imposed on the people. As to judge Limas these sanctions are going nowhere, although I believe in the right case maybe just maybe the Supreme Court may reverse itself.  This is why I have filed so many of these case.  Any attorney who knows the system knows that once the Supreme Court sees a problem enough times it will take the case and possible reverse itself from a previous bad ruling.

As to the issue of Death Penalty Sanctions - they are nearly impossible to get unless you can show the client was party to the wrongful conduct. Further, the 13th Court of Appeals has already found sufficient evidence for  the case to proceed, at least as to the Herald. No right minded judge would even consider this motion until all appellate remedies have been exhausted by the Herald.

Finally, to get sanctions you must have an injury. This is Peter's argument - because a driver was drunk when the accident was caused he should get $50,000 even though Peter suffered no injuries. Just because Limas took a bribe does not mean Peter or anyone else suffered an injury.  The underlying facts and law remain the same.

Just had to comment on how Peter Zavaletta and Ed Stapleton are using the incompetence and corruption of our courts to win without regard for the law or due process rights of the people Peter allegedly defamed.

Now I have to clean my desk and mop the floor - then I will finish this piece I have been working on since the weekend.

inasmuch as I gave the case whcih shows I am right - how about you give the case which shows you are right - you are so stupid you assume people are too stupid to simply google it

It law it is about the law - not about what some people want the law to be.

The victims here are the individuals allegedly defamed - are they to have no remedy because of their conduct of a lawyer - the law is pretty clear on this issue.

If the evidence and law support their causes of action then the brine means nothing because the law would have given them their victory

The law is everything - right or wrong - on the issue of judges being immune even for criminal conduct I oppose this - I do believe the compromise might be that if they are convicted then then can be held accountable

Why kind of injections do you receive that help with your fatigue? What kind of fatigue do you experience and what have you been diagnosed with? I ask not to be nosy, but to expand my knowledge base. I suffer from similar symptoms and have chosen to quit taking my meds. Never say never.

I have andropause - I receive testosterone injections and I also take 50,000 units of vitamen D (which is a hormone) every Friday - the testosterone can help with the fatigue

I agree with the 6:18 AM comment. Most of your readers would agree. This keen sense helps the citizens that care understand, how con-artist groups and candidates mislead them in order to support their self-serving agendas.
